Stevens to retire from Supreme Court during Obama’s term

stevensNEW YORK — The leader of the liberal wing of the US Supreme Court, John Paul Stevens, again has said he may soon bow out, which would open a door to President Barack Obama’s second pick to the high court.

“I do have to fish or cut bait, just for my own personal peace of mind and also in fairness to the process,” Stevens said in an interview with The New York Times online Saturday. “The president and the Senate need plenty of time to fill a vacancy.”

Stevens, set to turn 90 this month, told the Times he did not like to give interviews “because it saves an awful lot of time if you don?t.”

While speculation has been mounting for months that this might be his last session, Stevens told the Times he had not yet made up his mind.

“But the White House is bracing for a summertime confirmation battle, the second of the Obama presidency” the Times noted, after the nomination and confirmation of Sonia Sotomayor, now the first Hispanic US high court justice.

Though beloved by progressives, Stevens, appointed by former president Gerald Ford (1974-1977), maintained in an interview Friday that his judicial philosophy was conservative.

“What really for me marks a conservative judge is one who doesn?t decide more than he has to in order to do his own job,” Stevens said. “Our job is to decide cases and resolve controversies. It?s not to write broad rules that may answer society?s questions at large.”

Stevens recently confirmed in an interview with the New Yorker that he hired a lone clerk for the 2010-2011 court session, suggesting he might be planning to retire.

Regarding the US president, who happens to be a former law professor, Stevens told that magazine: “I have a great admiration for him, and certainly think he’s capable of picking successfully, you know, doing a good job of filling vacancies.”

Among names mentioned as a possible successor if Stevens retires soon is Elena Kagan, 50, formerly at Harvard Law, where Obama and First Lady Michelle Obama studied law.

    I just can’t wait for this Amway Nazi to take over the governor’s office in my state. At least he can’t destroy it: Michigan has never recovered from the last Republican pig we had in office here: the corrupt, cross-eyed cretin John Engler.     Stevens gas been good, and we should be appreciative of the political understanding behind his apparent decision to retire whilst President Obama is in office.

    As vacillating and poorly informed as the electorate appears to be about our new president, can a second term really be a sure thing?

    But it sure would be nice if one of the conservative Justices retired. We don't need to tread water – we need to… progress.

    My guess is Obama, true to his colors, will appoint someone like John Yoo, or Jay Bybee, in the interests of bipartisanship. Too outrageous? How about a lawyer with Wall Street connections, and an understanding of the Constitution every bit as compelling as Obama's, you know, the one that allows domestic spying, the elimination of habeas corpus, the permitting of assassination of US citizens deemed a threat to national security, or that makes it a law that all citizens must purchase health insurance or be fined. Yes. Yes. A black president, a token, is making it easier for the citizenry to join in a gadarene rush to collapse of society and the economy, to be replaced by a security state that has discarded Posse Comitatus. His color has nothing to do with his deplorable politics, but it is enough to join together those who once were opposed to his predecessor, as if the looting of social security 'entitlements' is permissible if a minority goat does it.

    I certainly hope that Obama decides NOT to play Bi-Partison with this decision for the Supreme Court Justice appointment. We have enought Repulivicans Kangaroo Judges as it is. We do not need any more Presilla Owens wannabes under the Reagan, Bush & Bush, Dowey Cheatum and Howe appointments. That would remind me of the courts prosecuting any military General of the Third Riech when some but not all attempted to kill Hitler in Wolfsschanze ( Wolf's Lair). No one came out alive in those proceedings.
