Exclusive: Obama ‘won’t have the courage’ to rebuild the liberal wing of the Supreme Court

President Barack Obama should have the courage to try to rebuild the liberal wing of the Supreme Court but he probably won’t, free speech attorney Marjorie Heins told Raw Story in an exclusive interview conducted Saturday.

When Obama appoints a new Justice to replace John Paul Stevens, “that Justice wouldn’t make a dent in the 5 justice right-wing majority that ruled in Citizens United,” Heins said.

Heins, founder of Free Expression Policy Project, and longtime director of the ACLU arts censorship project, pointed out Anthony Kennedy’s going to be the swing Justice regardless of whom Obama appoints to replace Stevens. “Obama has had a record of being very slow with judicial appointments below the Supreme Court level,” said Heins. “And that’s of course where most cases are decided and that’s a real problem. At the Supreme Court level, he won’t be slow, but he’ll probably be very cautious.”

“In the days when we had Black and Douglas and Brennan and Marshall there really was a liberal wing on the Supreme Court,” she continued. “And now what we really have is a right wing and a moderate wing, we don’t really have a liberal wing anymore. Or liberalism has moved so far to the right that we can’t recognize it. Obama should have the courage to try to rebuild the liberal wing, but he probably won’t because he doesn’t want to create any more controversy and opposition than necessary in Congress.”

This weekend Justice John Paul Stevens confirmed that he plans to retire during Obama’s first term as president. Sen. Arlen Specter (D-Pa) told Fox News Sunday he hopes Stevens waits a year, to avoid gridlock while Senate business is so backed up due to battles over health care legislation.

“I think we need someone who will step into Justice Stevens’ shoes, who will be very tough on the issues of executive power,” Specter said. “A federal court this past week declared the warrantless wiretapping unconstitutional. I think we need the kind of balance that Justice Stevens has provided to offset the majority on the court which is in favor of executive power.”

Justice Stevens, in his passionate Citizens United v. FEC dissent, wrote of the majority’s threat to democracy, because one of the fundamentals of free speech is that all, not just the richest or most powerful, need to be heard. Vast majorities of Americans who identify as members of each of the major political parties are unhappy with the Supreme Court’s decision, which fundamentally changes campaign finance laws in the United States.

In a detailed article posted to the Free Expression Policy Project website immediately after the Supreme Court decision, Heins highlighted Stevens’ description of the majority’s argument as “aggressive judicial activism” suffering from “glittering generality.”

Heins guesses he wrote the Citizens United dissent in the way he did because he wants it to be remembered. “Stevens is about to turn ninety and still plays tennis,” she said, laughing. “He’s incredible. One of the ironies of course is Stevens was the author of Pacifica, the case that allows the FCC to censor what it thinks is indecent on the airwaves.”

Stevens is considered a first amendment champion now, but in 1978, just after he was appointed to the court, Heins says, “He didn’t get it. He wrote this Pacifica decision which he ought to apologize for some day, and perhaps he even will. But certainly in Citizens United he’s trying to make a very strong statement against this kind of — beyond judicial activism — it’s very unusual what the Supreme Court did.”

The key swing vote on the Supreme Court used to be Justice O’Connor, Heins points out, but now it is Kennedy. “Kennedy is usually pretty good on first amendment issues although in this case his interpretation was ‘oh the first amendment doesn’t allow us to make distinctions between speakers.’ That’s what Stevens was referring to as a ‘glittering generality.’ Of course government can make distinctions between speakers! Corporations are not individuals and they don’t have the same rights as individuals, but Kennedy did not agree with that.”

    I agree… what has Obama done… except pass through 94% of his proposals to congress (Higher than any Prez since FDR)… get Health Care through a broken Senate, start dismantling DADT, eliminating US sponsored torture, getting low cost loans to students, rebuilding US bridges in foreign policy, make us respected around the world again, stand up to Israel, get agreement for nuclear arms reduction with the Ruskies. You betcha… Obama needs to go so we can get the perfect replacement that doesn't exist.

    I am never one to be too critical of President Obama, I voted for him with an openmind and understanding of the mess he inherited… I have been patient on many things while others where losing complete control but on this he might hear some rage because; this is where many lives can be affected because of justices like Roberts, Scalia, and Thomas…. He must build a strong liberal court….. Women, Minority, Sexuality, the Middle Class, the Lower Class, The Fairness of the Media, America and so many many many more things depends of it…

    I only agree somewhat with this assessment of Obama's political strength of character. The most important reason why he won't be able to remake the SCOTUS is because of the GOP. No matter who he nominates, there will be a filibuster. NO MATTER WHO IT IS.

    So, that being the case, Obama should follow this strategy – are you listening, POTUS? Nominate the most left wing radical he can possibly come up with. Let the GOP filibuster that person out of existence. Then bring it down just a notch. Let the GOP once again filibuster. Keep doing this in tiny increments. The public will become irritated as sh.!t with the GOP by the 3rd filibuster, and will demand they relent. By that time, we'll have someone somewhat in the middle of the road.

    At least it won't be another Scalia.

    I've all but given up on his doing anything outside those bounds – like fighting for the good of the whole country, all of its people, its economy, or its legal system. I don't think he, his advisers, or his political-retread cabinet appointments understand those larger issues or care about them – other than in campaign speeches. I don't think the Republicans do either, but that's our problem – our government is riven by self-selected elites of two ideologies, both of which serve themselves and their special-narrow-interest supporters while leaving the country and its people out to dry.

    I support President Obama. I voted for President Obama. I donated money to his campaign every week of the General Election. I volunteered my time to help him get elected.

    But, The President hasn't really fought for anything thus far.

    Obama only fought for Health Care Reform at the very end when he had no choice. His political life depended on the passage of the flawed bill.

    I voted for him to fight for what he said believed in.

    Instead he has compromised again and again and settled for whatever he could get.

I'm a Democrat & and a proud Progressive..(and I've grown the frick up) and I sure wish Obama would grow a pair & nominate a liberal, but I agree he lacks the courage. And we've had a divisive SCOTUS since 2000 (Bush v Gore..hello!) so he might as well maintain the 4-5 split. I know politics is a complicated & full of compromises but it seems that's ALL Obama has done — vacilitate, back-track, and compromise w/minority Republicans. And many of us are getting real impatient — because this is more of the same BS, not the “change” Obama promised he'd be about.

    We should impeach all of the bench the supreme for many reasons, but there are two that come to mind that have dishonored the court and made it irrelevant as an arbitrator of justice; they are as follows.

    (1) The court has been poisoned by partisan politics to the point that there is no antidote other than the impeachment of the bench.

    (2) Members of this court willfully participated in a crime against the state when they installed G W Bush into office without just cause thus insuring the unconstitutional violations that followed including but not limited to the patriot act. When ones ideology crosses the threshold of criminality other than impeachment of the entire bench there is no other cure for this kind of disease at the root of our system.

    Corky, you are repeating everything the media wants you to repeat. Center Right? That is straight from FOX, CNN, CBS, NBC and ABC – you know … the Liburl media!?! I don't doubt your credentials as a Democrat, I doubt your logic and analysis skills. President Obama has moved to the right on every important issure – even when he had overwhelming majorities in Congress AND with the public. He is an adult and can withstand correction – we need correction after 30 years of half-truths and media concentration.

    Center Right? Issue by issue, America is a Left-wing nation. But after having corporate talking points pumped into your head, day after day, you appear to believe everything you hear on TV. I suggest that you get your white matter to your local library and do some research (turning on Rush is NOT research).

    The bigger point is that the men with the money own the megaphones (TV, Radio, Print) and use the power of repetition to make weak-minded individuals deny reality. For example… your tantrum targets the “hollow Blogosphere” without realizing that the internet is the most significant historical advancement in providing power to the people – ever! But to so-called “big brains” it is “hollow” and sheeple rinse and repeat. Readership of print is down. TV viewership is down. Accuracy and trust in the traditional media is down. But with you insist on repeating the talking point – tht we are a right-center nation. Absurd! Do you live in the South? I know you aren't that ignorant.

    Stop allowing the richest 1% (the corporate owners of TV, radio and print) frame your thoughts – as you demonstrate in your silly rant. I can see you slapping Rosa Parks around for not respecting the bus rules. Please don't allow FOX to do the thinking for you. Think outside the box. Literally, think outside the boob-tube. The air out here is dewy sweet.
