‘Draconian’ Arizona law will cause civil rights violations: Hume

Brit Hume of Fox News says the “draconian” new Arizona immigration law will be unpopular and predicts it will lead to civil rights violations. But he also thinks it was reasonable for Arizona to pass what he called “emergency policy.”

The law will allow police to demand proof of residency if they have “reasonable suspicion” that a person is not in the country legally.

“I think it’s going to be quite a trick to train the police officers in that state so that they can carry out this mandate to check anybody who they have a reasonable suspicion of being in the country illegal, without engaging in profiling or violating their civil rights,” Hume told Chris Wallace Sunday. “I think that’s going to be very difficult to do. I think there probably, and inevitably will be, some civil rights violations.”

He thinks it is unclear if it will stand up to a court challenge, but despite the opposition it has already faced Hume thinks civil rights violations are an acceptable trade-off because he is scared of illegal immigrants.

“The question really though is, that seems to me, did Arizona act reasonably here under the circumstances by passing this somewhat draconian law? And the answer I think, may well be yes, because they are facing a serious crisis down there induced by the presence in their midst of a lot of illegals, some of whom are causing terrible problems,” said Hume.

According to Fox News, the law makes it a state crime to be in the US illegally, legal immigrants must carry identification, police must check for documents with “reasonable suspicion” and citizens can sue local governments for not enforcing it.

Judge Andrew Nopalitano says the bill will bankrupt the state of Arizona and Hispanics will flee the Republican party in droves. He expects a federal judge to stop it as soon as it is used to stop someone.

President Obama called it “misguided.” And Rep. Raul Grijalva (D-AZ) was given an anonymous bomb threat for stating he opposed the law.

    He didn’t need to say so since he actually provided one. In fact, I suspect he was going for a bigger one than he actually achieved.
    One news report suggested he may have stolen a full fuel drum from the hangar area and loaded it aboard the plane, obviously to make a bigger bomb and kill more people, innocent people who just happen to work there.
    For anyone to try to spin this as a ‘non-terrorist act’ is beyond the pale.

    As far as I know, No “federal worker” died. The IRS like the FED… are both private corporations. The only “federal employee” is the IRS commissioner himself who “oversees” the private company called the IRS. I think Rachel knows this…. or should. As should everyone.

    Maybe I’m confused! A few individuals hijack a fuel laden plane and fly it into a building to kill as many Americans as they can. An individual loads his own plane with fuel and flies it into a building to kill as many Americans as he can. What makes one terrorism and the other not? Is it the size of the plane? Is it who owns the plane? The nationality of the pilot? The number of individuals involved? Or the grievance they have against the government? Does he have to instill terror in the whole country or just a subset of workers for the government or just the poor innocent people who watched the plane coming directly at them?     Congress THOUGHT it created it but it didn’t. Just look at the 1100 manual and it tells you so. Congress only created the Commissioner’s Office. He then hired the private collection agency people and used them as the tax collectors. In fact, I defy you to find any IRS employee listed as an Employee of the United States Government with a United States Employee Identification number that has been hired by any District Director in the country. Now I suggest you look at 27 Code of Federal Regulations Section 250.11 and therein you will find the definition of “Revenue agent.” That definition reads “Any duly authorized Commonwealth Internal Revenue Agent of the Department of the Treasury of Puerto Rico.”

    I now refer you to the “Secretary” described in 26 U.S.C. 6301. Does it not state, “The Secretary shall collect the taxes imposed by the internal revenue laws?” Yes it does. Now Congress mandated this by 68A Stat 775 and you cannot disagree. Does not 26 U.S.C. state that this “Secretary” may make a return based on the information he has if a person does not make a return? Yes it does. Does not 26 U.S.C. 6001, 6011 and 6012 refer to this “Secretary?” Yes it does.

    Now, if the Revenue agent decides to prosecute, he approaches the Attorney General and this “Secretary” as noted in 26 USC 7401 to prosecute upon concurrence between both the Attorney General and this “Secretary,” is this not correct? Yes it is and all the above is undisputable. Is it now contrary to any rational man that this “Secretary” can only be one person and not many.

    Now, I direct your attention to 27 CFR 250.11 again for the definition of “Secretary” as found in all the above. The defining term for “Secretary” is, “The Secretary of the Treasury of Puerto Rico.” That man is Manual Diaz Saldana. Those revenue agents operating in all the states are not United States employees. The Statute mandated to be at the end of each regulation by 1 Code of Federal Regulations (CFR) is 68A State 775 (26 USC 6301).

    Braind, After receiving your comment, I emailed an old friend of mine who used to work for the IRS. Here is his response: “Yes, The IRS is a federal government agency, part of the Dept of Treasury. It’s employees are federal employees, however several years back they outsourced some of it’s functions to nongovernmental commercial corporations, specifically processing of lockbox remittances (Mellon Bank, if I recall) and some debt collection processes. The latter was highly controversial and I’m not sure if the practice continues.”

    You also seem to believe that I somehow still work for the government and am belholden to them in some way. No on both counts my misinformed friend. I am beholden only to my Corps. I work for myself as an investigative journalist and photographer having left the Active Duty Marine Corps after 10 years in 1986, with a discount vacation in Beruit in 1983. Oh yeah dude, nothing but fun in the sun on the beach and 243+ dead Brothers. Surf’s up. And no, I am not on VA disability. Yes I do use VA medical for the Vietnam-Era, and I paid taxes on my military pay, including SSI the entire time I was on active duty, in addition to SGLI (Servicemen’s Group Life Insurance). Accordingly, I would like to have someone tell me now how I, or any other veteran does not deserve that VA medical or the other laughable benefits we “receive.” We paid for it, and a lot of us paid a lot more than others. We do receive though, a casket, a plot in a military cemetery, and a flag. A lot of the time the flag ends up with the VA, there being no NOK (Next of Kin). If our Brothers are informed, they are there to hoist one for us and see us taken care of one last time. Now that is truly something money cannot buy.

    Am I in a position to judge any of these people involved in the absence of direct evidence? No, we can only go by what is being reported and if you trust the lying scum in the MSM there is nothing I can say that will do any good other than my OPINION.

    In addition, nobody leaves our Corps. Ever. We are an international Brotherhood of Warriors who have fought in every American war -right or wrong – since 1775 and even before the U.S. was officially a country. We are and will continue to be America’s elite fighting force until the U.S. ceases to exist and let me tell you, there’s going to be one HELL of a dustup. You would be surprised at how many of us are sick at heart over what is happening and believe me then I say that there will be an in-house investigation when this is all over and quite possibly a civil war the like of which this world has never seen. So don’t despair… yet. And before you condemn all Marines as bumbling savages (O.K., most of us are) take a look at the roll-call of Marines publicly denouncing these insane, criminal wars. I agree that the IRS is a federal agency with one federal employee that over sees a private corporation. I have seen no evidence that there are any other “federal employees”.

    We were stopped by the border police in Arizona last year, despite the fact that we were not near the border and are not Latino. We have dark hair. That's it. Now that the law is tougher, make sure you bring your passports or birth certificates. A driver's license may not be enough under this law. As for us, I doubt we will ever return to Arizona now that this law is in place. We plan to spend our tourist dollars elsewhere and hope millions of Americans who also find this law draconian will stay away, too.

    Please. I had to show proof of citizenship when i applied for a drivers license here 25 years ago. I had to show a birth certificate. Plain fact is, you are required to show ID here anyway. And you can't get a drivers license without proof of citizenship. So there's no issue. If you're here illegally, there's an easy answer. Go Home. Quit draining the system.

He was arrested his wife drove to the station with his birth certificate. The man is a third generation hispanic who doesn't speak spanish.     I would venture to say that most people walking around today could NOT produce proof that they are an American citizen . I am an elderly white American and Navy Vet but I know I couldn’t prove I am here legally . I certainly don’t carry a copy of my birth certificate with me

    I heard that under this law, any cop that violates a suspect's civil rights can also be sued. This puts the cops in a very tight spot and could also end up being a processing train wreck for the courts in Arizona.

Duvall (CA), Senator John Ensign (NV), Senator Paul Stanley (TN), Governor Mark Stanford (SC), Board of Ed Chair, and Kristin Maguire AKA Bridget Keeney (SC), she wants to re-establish a family values party, that’s like saying that the Catholic Church cares about the welling being of children in their care, too late for that.

    FYI: You are required to show a policeman your ID when you are suspected of a crime. Not having car insurance, like 90% of illegals, is a crime. Therefore, you have to show ID like every other legal American. Don't have ID, green card, passport, work visa?     Maryland does not require proof of citizenship for a drivers license. If I visited AZ, and was asked to prove legal residence, the only thing I have is my drivers license. I don't think I could prove citizenship or legal residence. I would be deported back to Poland? I don't even know if my grandparents and great grandparents have any relatives there. Not my business, but if I were a gambling man, I would bet that this law is either repealed or found unconstitutional in about a month. Conversely, it could just be a political stunt. There are too many good white citizens in AZ who are making big profits by not paying minimum wage or not paying taxes on their illegals.

    check the website newspaper Iowaindependent.com and you can google man arrested by Arizona it comes up with up dated matters involving this issue. As for the date of the Law, it doesn't matter because the case will be filed with the Federal Govenment which already has a Law. I lived in New Jersey and we did profiling but stopped because of the billions paid in law suits. New York had two major discrimination cases the brought their budget down. It's hard to say who is what race in America these days and we do have other immigrants then latino/mexican. We have immigrants from all over the world but that's another story. Federal Laws override State Laws when it is a violation of Rights and the Constitution. At lease that's what we learned in Jersey.

    It also raised a question on license renewal versus new issuance, the bill was held to clarify the answer.

    Vegas and the Disneys are fine, but all of them are man-made tourist attractions (and BTW, Vegas heat is likewise unbearable). Arizona has natural attractions: the Grand Canyon, petrified forest, meteor crater and Sedona (named the most beautiful city in America by Parade magazine for its red rocks). And there are historical sites, like ancient Native American ruins and Tombstone, site of the gunfight at the OK Corral, which is enacted daily. All of these areas depend on tourist dollars for revenue, so a boycott might prompt an outcry from within the state to overturn this ridiculous law.

    While Arizona has a right to enforce the laws, it's just one state, and nothing it can do can make failed Mexico or its pop. go away, they're here to stay, and have to share the New World.     What determines the reason to stop somebody? When the mormons were chased and killed across this country by christer “sheriffs” were they “profiled?” Feels good doesn’t it?     dennycrane is right (below): Obama has EXPANDED gun owners’ rights by allowing them to pack a piece on federal land, which made way for folks carrying guns in their recent demonstration. Pretty ironic. I am not sure on what factual basis this paranoia exists. Maybe Fixed News whipping up fear again? NRA propaganda? The color of Obama’s skin? Whatever the reason, the paranoia defies facts and belief. Sometimes I wonder if gun owners are trying to make up for other deficiencies.

Hume: ‘Draconian’ Arizona law will cause civil rights violations

A new Arizona immigration allow will allow police to demand proof of residency if they have “reasonable suspicion” that a person is not in the country legally. Fox News’ Brit Hume supports the bill but predicts it will lead to civil rights violations.

“I think it’s going to be quite a trick to train the police officers in that state so that they can carry out this mandate to check anybody who they have a reasonable suspicion of being in the country illegal without engaging in profiling or violating their civil rights. I think that’s going to be very difficult to do. There probably and inevitably will be civil rights violations,” Hume told Chris Wallace Sunday.

Hume called the bill “emergency policy” but said it was unclear if it would stand up to a court challenge.

“The question really though is, that seems to me, did Arizona act reasonably here under the circumstances by passing this somewhat draconian law? And the answer may well be yes, because they are facing a serious crisis down there induced by the presence in their midst of a lot of illegals, some of whom are causing terrible problems,” said Hume.
