Kagan helped shield Saudis from 9/11 lawsuits

Elena Kagan, President Barack Obama’s latest nominee to the Supreme Court, helped protect the Saudi royal family from lawsuits that sought to hold al Qaeda financiers responsible in the wake of the Sept. 11, 2001 attacks.

The suits were filed by thousands of family members and others affected by the Sept. 11 attacks. In court papers, they provided evidence that members of the Saudi royal family had channeled millions to al Qaeda prior to the bombings, often in contravention of direct guidance from the United States.

But Kagan, acting as President Obama’s Solicitor General, argued that the case should not be heard even if evidence proved that the Saudis helped underwrite al Qaeda, because it would interfere with US foreign policy with the oil-rich nation. She posited “that the princes are immune from petitioners’ claims” because of “the potentially significant foreign relations consequences of subjecting another sovereign state to suit.”

In an interview with the Philadelphia Inquirer published Tuesday, the mother of a man who was killed on United Flight 93 in Pennsylvania said he didn’t know why Kagan argued that the case not even be heard. By keeping the case off the dockets, the Saudis were spared scrutiny of their finances.

“We had hoped she would be with us so that we could have our day in court,” Beverly Burnett said.

“I find this reprehensible,” said Kristen Breitweiser, another family member whose husband was killed in the 9/11 attacks, said at the time. “One would have hoped that the Obama administration would have taken a different stance than the Bush administration, and you wonder what message this sends to victims of terrorism around the world.”

The Obama Administration’s decision to intervene in the Saudi-al Qaeda case so irritated two Republican senators that they introduced legislation aiming to ensure that Americans have the ability to sue foreign governments.

Sen. Arlen Specter (D-PA) and Sen. Lindsey Graham (R-SC) offered a proposal to amend the Foreign Sovereign Immunities Act, which Kagan cited as one reason the Saudi case should not be heard. Both senators said that US citizens should be able to sue foreign governments if they are found to be supporting terrorist activity.

Specter, who has since become a Democrat, was unusually blunt.

“She wants to coddle the Saudis,” he said.

    I believe Ms. Kagan may have been correct to the letter of the law regarding the Foreign Sovereign Immunities Act. However, the consequences (9/11) of Saudi monies channeled to terrorists should be considered a war crime and subject to prosecution in The Hague.
    The holders of the accounts and the order to finance this or that identified terrorist group
    should be easy enough to track.

    I'm torn on leaving. I've lived in lots of places, and still end up back in the US (in Texas, no less!) I think part of me just doesn't want to give up, even though rationally I know full well that there's really nothing to be done about the fascist takeover and the mouthbreathers who are letting it happen– almost willfully contrary to their own best interests.

    I just haven't decided if I'm really willing to stick it out here, standing up for what I believe in, and maybe getting hurt because of it, knowing that some gunsucking teabagging meth-head out there might actually shoot me for disagreeing with him. Hells, I've already had a couple heated encounters over the last year or so.

    I haven't been terribly impressed by what I've heard about Kagan. She sounds solidly “establishment”, and I don't get the impression she'd be the kind to check the full-fledged reichwing activist judges now occupying so many of the Court's seats.

    At first glance, it certainly looks like the Court would shift quite a bit rightward on most issues.

He is the one that told Ms. Kagan that she was to argue that point and Attorney General Eric Holder's staff prepared the government's brief to the Supreme Court that Ms.. Kagan was to argue from. We only have to be instructed by our client to proceed to to do that and we are obligated to formulate the best arguments we can to advance the positions that our clients tell us to take. And Lindsey Graham ought to know better.

    If we're bothered about the oil, and the Saudi Royal family was complicit, why not just invade like we did Iraq… at least this time we'd be hitting those that had REAL connections to Al Qaeda.

If there some of the 19 terrorists who supposedly survived when those planes crashed, then obviously they were not on the 4 planes that crashed that day and the names are wrong.because not one person survived. Among the 19 who died – at least 12 were Saudis, a few with unknown nationalities, an Egyptian, 2 from the Arab Emirates, and 1 from Lebanon. I agree with Sandi2 that when none of the terrorists on the planes on 9/ll were Iraqis why did we invade that country. As bad as Sadaam Hussein was he did keep Iran in check and we have yet to see what they will do once they have Atomic weapons of mass destruction.     Interesting the Fed has not done much on technology to clean up spills. Fire departments do it all the time. The Fed had to go purchase material to contain the spill. What? They did not own it?
