Lawyer: Video proves murder of 7-year-old by Detroit police was ‘not an accident’

A&E film crew for “The First 48″ was present during police raid

An attorney for the family of a 7-year-old girl who was killed by a police officer’s bullet during a weekend raid at their home said Monday that he saw video of the raid that contradicts the police department’s version of what happened.

Attorney Geoffrey Fieger said he watched three or four minutes of video that showed police fired into the home after lobbing a flash grenade through the window. He said this contradicts the police department’s story, which was that the officer’s gun discharged during a struggle or collision inside the home with the girl’s grandmother.

“There is no question about what happened because it’s in the videotape,” Fieger said. “It’s not an accident. It’s not a mistake. There was no altercation.

“The gun was fired before anyone goes through the door. There are lights all over, like it’s a television set.”

A camera crew for the cable television crime-reality series “The First 48″ was at the raid, although Fieger declined to say whether the video he watched was shot by the crew.

A&E spokesman Dan Silberman said neither he nor anyone else from the network would comment about the case.

Fieger said more than one camera was recording at the scene.

“It demonstrates conclusively, beyond a shadow of a doubt, what happened in this case,” the attorney said. “The pictures don’t lie. It’s got sound and everything.”

Michigan State Police detectives have taken charge of the investigation.

Detroit police were trying to obtain any footage of the raid captured by the film crew, which had been shadowing city homicide investigators almost daily since early this year, Assistant Chief Ralph Godbee said Monday.

Godbee said Detroit police would not be commenting on the tactics they employed during the raid, but that the department was not concerned that the film crew had any affect on how it was conducted.

The target of the search, a 34-year-old man suspected of killing a 17-year-old boy, was arrested in the upstairs unit at the two-family home. Police had warrants to search both units, and relatives of the girl were seen Monday going in and out of both.

    every article i saw about this story on digg before this stuff about the video had tons of comments (80% +) saying that it was the mother's fault for fighting with a cop and that any 'good' mother would have been covering her child with her own body… i have a feeling they knew that's exactly what people would say and that's why they came up with the story they did.

    I find this reprehensible that the Detroit Police would attempt to take this killer down in a home with innocents. Who trained these bozos? Wouldn't it have been safer to capture him in a controlled spot. I hope the person or persons responsible, yes you higher ups, get their due!

    They have, you just don't hear about them but very very rarely. A few weeks ago a Everett, WA cop got off the hook for murder after he shot a unruly drunk driver 7 times in the back in front of another officer. The other officer saw no reason at all why his fellow cop should have shot the guy, the accused officer was spared a prison sentence only because the jury was confused and stupid. The jury let the pig off the hook and now the cop that told the truth is all alone in a department full of pigs that hate him in a town that loves him.

    Sociopaths seek power, that's why police departments are filled with gruff mustachioed pigs that all get horny every time it's time to rally around a fellow pig who got lucky enough to murder someone. Same thing with the troops, they join because they “just want to kill someone” as they say time and time again.     These stories are always reported as individual isolated incidents, but really they are a trend and part of the big picture. We live in a police state with more restrictions on our freedoms, more abusive police, more intrusive government spying and governments at every level that tolerate or celebrate it.
    The pigs from small town police forces to SWAT teams to military and mercenary outfits have been emboldened by Bush and again by Obama.

    This is the most outrageous and foolish act by police that I have heard of since four police officers were killed in Oakland, Ca. by one man. In Oakland they went in after a known cop-killer without ascertaining if he was still armed or even where he was in the apartment. When they approached a closed closet he shot through the door killing several officers. If you don't know where the suspect is, or how many civilians are in harms way, you surround the building and wait him out. Its common sense and good police procedures. I don't know what these cops were thinking.

    A lot of cops did tours of Iraq in the Army Reserve where they got a taste for busting into houses and killing everyone inside. Now they can't turn it off. Once they get unlimited power and blood lust, they can't stop. It's their drug. It's bad now and it's going to get worse. Police departments need to weed these asshole out. The problem is almost all of them are cut from the same limited IQ, power hungry cloth.I live in a suburb of Detroit. All the cops I've ever encountered around here are looking for any excuse to fuck someone up. It's true that there are a lot of criminals around here, but the cops assume everyone is a criminal. They need to look in the mirror.

    No, don't think so. Like I said, they're all the same. Their unions will protect their jobs and they won't testify against each other. It's too bad the city get sued instead of the cops. The cops don't have enough money to pay for their crimes, so the tax payers have to pay for them. Maybe enough big money judgments will make them get serious about this problem. This is a local problem nationwide. Citizens of every town and city have to make their police departments and local officials confront and do something about this. If they won't do it, vote them out. I know this isn't likely but nothing else will work.

I have person experience with one of them, and I can swear that most of these police officers are liars, cruel and have no regard for people of the color.     I don't think it's just police depts that are filled with sociopaths. I am really becoming more and more of the belief that it is in the nature of a sociopath to seek wealth and to have power and control over others. And as such, I think the world events of the past several years provides sufficient evidence that banksters and corporate owners/CEOs and their congressional puppets are a bunch of sociopaths.

    A sociopath has NO empathy (consider the debate by certain members of our leadership about the value of having empathy in the recent past) and no ability to feel guilt or regret for anything they do. One person dies, 100 people die, millions of people die–it doesn't matter to them–they could care less. It's all about getting what they want by any means necessary–the ends justify the means mentality. They're also very good actors, which means they're very good liars, and they always LOOK good.

    I think this also explains why everything is so topsy-turvy from the norm–war is peace, greed is good, etc.

    So, if this is the case, what we're really dealing with in our country (and other nations as well) is a nasty nest of sociopaths that have succeeded in achieving great wealth and power–and they're destroying the world in the process.

    Why did these cops go in guns blasting just because they saw someone of that residence visiting the neighbor resident where they thought the suspect was? Is this what all of us can now potentially be facing–the cops are searching for a suspect and if your neighbor is harboring that suspect and you're seen going over to their place for any reason, this kind of response from the cops is what we can expect? And then of course, they villify the victims in order to facilitate a coverup. Anyone today that still considers cops to be “peace officers” is a blind fool. More and more it seems one is never in more danger than when in the presence of a cop.

    As an aside: Fortunately, in this instance, a camera crew was filming all of this for a “crime-reality series” which exposed the truth about what happened. But why are these types of “reality” cop shows being pushed upon us relentlessly. I don't watch them because I think they're propaganda, yet so many people do. I wonder what that says about the mental state of our society in general that so many enjoy watching the humiliation, embarrassment and suffering of others.

    IMO, the real purpose of these cop reality shows is to “condition” the people into submitting to the reality of the ever encroaching police state that is relentlessly whittling away our rights, liberties and freedoms.

    You obviously didn't read the article. This family was not harboring a fugitive and it's not yet publicly known whether they were aware that the people upstairs were harboring a fugitive. The guy the cops were after was apparently in the upstairs unit. This family lived in the downstairs unit (sounds like it's a duplex).

    I met someone in San Quentin State Prison who had developed violent behavior in the US Army. After he was discharged he could not turn off that behavior. So, he was arrested for additional violent behavior in California.

    It's what I have been saying for almost 9 years now: No military personnel should be allowed to serve as domestic peace officers until 10 years after their last active duty has past. If it was up to me, never.

    The way the cops raided this house sounds alot like how many of the raids by our soldiers of homes in Iraq (and probably Afghanistan) were conducted while looking for “terrorists” and/or “insurgents”–just kick in the door and start shooting. And when these soldiers return home, many become cops.

    Our soldiers are put through a rigid brainwashing regime designed to dehumanize the enemy such as the Iraqi insurgents, al qaeda, or the taliban–the “brown” people–and that way they will not hesitate to kill them. (Many no doubt get on quite a power trip.) And if they happen to kill an innocent in the process–oh, well, they're just “brown” people and therefore are of no value. And then they come home, become cops and continue on their power trip and treat people in general–but particularly “brown” people–with suspicion, contempt and hatred.

    This little girl’s relatives were harboring a fugitive–who was wanted in the killing of an honor student two days prior. Although I don’t condone the methods used by the Detroit Police Department, her parents bear some responsibility for this tragedy. The facts will come out, despite the grandstanding of Geoffrey Figer. One of his assertions yesterday has already been disproved..

Listen, the cops probably should’ve waited outside for the suspect to emerge, but these people were harboring a suspected murderer.     Add to this the fact that they knew other, NON SUSPECTS, including minors were present and I believe you have a clear cut case of the police handling this situation with complete incompetence and disregard for the public safety they are supposedly sworn to uphold.

    A&E should be charged as a accomplice to the crime. I believe that the so called reality TV shows are glamorizing the brutality the police inflict on the public. I believe that the reality TV show causes the police to act for the camera instead of doing their job. I believe that the police are out to get everyone of us, women and children included. We can't trust those we pay to protect and serve us; it is time to stop this abuse by any means.

Soon we'll all be wearing a collar or hosting an implant that can be turned on remotely to discourage “incorrect” behavior or even thoughts. They start with low income people and immigrants and then work their way up the chain. Something has to be done about what Hunter Thompson called “armed white trash” before we start getting Tazed for making illegal left turns, jaywalking, or just asking for directions.

Do you know what everybody that lives in your house does every moment of the day?     I totally agree with you, and most of the cops are exactly that ex-high school sport stars/Army Grunts and also the bullied that get into this job to feel like they have control over their lives and others. As others said that the family was harboring the fugitive is BS. If the fugitive lived in the upstairs apt. and the family with the girl lived in the downstairs apt., why get a warrant for both. It was to cover their bases in case they hit the wrong apt.. They made up the excuse as much as they made up the mother fighting with the police officer saying that they had people seeing family member moving into and out of the fugitives apt..

    It's the old technique of making a case out of the mistake. You see if there is a mistake or a possibility of a mistake, then they lie and say that the victim or someone else interfered with the police and due to their interference made the incident happen. Our society has made its own jail and the stupid stupid idiots on the juror are thinking that it happens to “bad” people and families but not me or my family. They don't realize when a police/fascists state is in full swing, if your not part of the elite/rich or the mechanizations of govt. your sheep to be fleeced and if you even nay once, your slaughtered by the same people you thought where always in your corner.

    Wow! cmon people make mistakes police officers risk there lives everyday to uphold the freedoms most of us take advantage of. They were there to apprehend a murder suspect that would make anyone nervous. It was an accident any way you look at it…. If you really think he meant to kill an inoccent little girl then I think you are probably in the same boat as the people who believe Bush was behind 9-11. Do you really think there is some agenda by the government to spy on us all and take away all our freedoms, its just obserd.     I have been off line for the past 3 weeks, and it seems that nothing changes in the country of my birth. The killing of innocents by the authorities is such an evil epidemic that is (IMHO) sweeping the country.

    I sit down here in French Polynesia, a minority citizen of a country that treats all of us equally. I do not have a worry about being shot to death in my home by a policeman, or a citizen. I am considered a comrade, an equal, and a elder spokesman. I am respected by all, not for my race, nor the fact that I was born an american. I am respected because I worked hard to build up a reputation of trust, and fairness and honesty. I served in the US Military for 20+ years, but today I consider that time as wasted. Nothing that the country does these days gives me any hope at all. The country seems to have broken loose from it's gimbals and is careening around completely out of control. You have destroyed any faith of those who before believed in the fundamental goodness of the average american. No longer, I for one do not trust those who I run into upon our streets here. I no longer lay claim to being or having been an american. I only wish that things would have turned out differently, but today that is turning out to be an enigma wrapped in a riddle and swathed in a connundrum. The average american isn't qualified to sweep streets let alone anything technicial. To me, the smartest thing that I ever did in my life is immigrate to a place where at least my golden years are going to be trouble free. I will never return to the country of my birth, too many bad feelings and regrets. You have let the radicals and the reich wingers take control of what was to be your future and turn it into a hell from which I do not see any possibility of escape.

    Oh, I just got back from my oncologists and gastrointestinal Doctors, they have informed me that the colon cancer I had removed has not reared it's ugly head again, there is NO sign of cancer or of any polyps. All my medicines, treatments, travel expenses and lodging are paid for. Nothing is left to chance… Now when you get a medical system that is as good as France's you may consider yourselves on a road to recovery. But for the present, it seems that you are deep in malignancy and there are no miracle drugs let alone surgery to cure your country of it's ills.
    Just this old Chief's 2 cents…..

    I doubt you live in the City of Detroit. I live and work in the City of Detroit. The little girl’s family was not harboring a fugitive, the fact is their upstairs neighbor was harboring the ALLEGED fugitive. This ALLEGED fugitive has not been charged yet. The police had to arrest someone in the building that night after killing the little girl or they would have looked really guilty and stupid to the world. Knowing the Detroit Police Department, they arrested the first male they saw upstairs.
