US fires head of agency that oversees oil drilling

Salazar tells NBC Birnbaum resigned

MSNBC reports,

The head of the troubled agency that oversees offshore drilling resigned under pressure Thursday, Democratic sources said, as President Barack Obama moved more aggressively to take charge of the Gulf oil spill.

Interior Secretary Ken Salazar confirmed to NBC News that the head of Minerals Management Service resigned, despite earlier reports she was fired.

Birnbaum was pushed out after she and her agency came under withering criticism from lawmakers of both parties over lax oversight of drilling and cozy ties with industry.

The Obama Administration has fired the head of the agency that oversees oil drilling and the collecting of oil royalties, AP reported on its live wire feed Thursday morning.

“AP sources: Elizabeth Birnbaum fired as director of the U.S. Minerals Management Service,” the brief said.

Birnbaum didn’t attend a press conference organized by Interior Secretary Ken Salazar on Wednesday.

Salazar announced plans earlier this month to split the Minerals Management Agency into two divisions: one charged with oversight of resource extraction, and another charged with collecting revenues from such extractions. Critics say that the fact the agency is supposed to both oversee drillers and collect money from them put the division at an inherent conflict of interest when it came to oversight.

According to the Washington Post’s WhoRunsGov, Birnbaum was expected to take over as head of one of two new agencies.

Birnbaum was appointed by President Barack Obama in 2009. According to her bio page at the agency’s website she assumed duties on July 15, 2009:

As MMS Director, Birnbaum administers programs that ensure the effective management of renewable energy, such as wind, wave, and ocean current energy; and traditional energy and mineral resources on the nation’s Outer Continental Shelf, including the environmentally safe exploration, development, and production of oil and natural gas, as well as the collection and distribution of revenues for minerals developed on federal and American Indian lands.

Before her appointment, she was staff director for the Committee on House Administration, where she oversaw strategy development, budget management and staff activities for the committee that manages legislative branch agencies. From 2001-2007, she was Vice President for Government Affairs and General Counsel for American Rivers, where she directed advocacy programs for the nation’s leading river conservation organization.

At the Department of the Interior, Birnbaum was Associate Solicitor for Mineral Resources from 2000 to 2001, supervising and managing a staff of attorneys that provided legal advice, developed regulations and conducted litigation on minerals issues for the Minerals Management Service, Bureau of Land Management, and Office of Surface Mining and Reclamation.

In addition, she was a special assistant to the Interior Solicitor, from 1999 to 2000, overseeing legal policy on a range of natural resource issues, including mining law, public land management and hydropower licensing. From 1991 to 1999 she was counsel to the House Committee on Natural Resources, where she handled legislative and oversight activities for the Department of the Interior, U.S. Forest Service, and electric power marketing administrations. From 1987 to 1991 she was counsel for the Water Resources Program of the National Wildlife Federation.

No other details are yet available.

    Why does Salazar have to go? I have been following this story since the day of the explosion. The Coast Guard was on top of it, BP held news conferences stating that they had it under control, and Salazar held news conferences restating all available information. Unless you have political officers on the rigs representing the government you have to take the rig operators at their word. This is a BP problem, not an administration problem.

    Americans have long voiced and voted that they do not want government “interference” in business but are the first to condemn the government when businesses cut corners and pass on external costs to the public. How is the government suppose to duplicate technical expertise of every industry in order to clean up and do the work that businesses did not want to spend the money to do for themselves? The problem is a lack of accountability by corporations and a deliberate dismantling of government regulation and enforcement.

    Good. Heads are rolling. Let's hope Salazar will be next. In the event, lawyers are cautious and conservative by nature. Birnbaum is no trendsetter, no inspired advocate of policy change. Which is what MMS needs if we are truly to see a shift in the hitherto unproductive (except in terms of money) energy policy.

    “Unless you have political officers on the rigs ….” I tend to agree with you. I think going forward there is going to have to be some kind of regulation where government trained engineers are able to “sign off” on various procedures. However it is going to create a huge new bureaucracy. Not sure how it is going to work. Still my 2 cents is that Salazar was not dis-ingenuous in this mess. There are stories that MMS has been signing off on stuff, accepting pre filled in forms (filled in in pencil to be done over in ink by the department was the story) and so on. So, seems like she needed to go. Salazar, still willing to give him the benefit of the doubt.

    Interesting resume. She was in charge at MMS less than a year, and I wonder if ObamaCo gave her any instructions to straighten up MMS.
    Looks like she was going back and forth between government and environmental NGOs. She didn't work for corporations.
    So it looks like Obama put her in a position where she might have been inclined to do some good. However, MMS was so corrupt she may not have been able to do much to change things before the spill (assuming she would or could have changed MMS).
    And now she's been axed, probably more to make it seem like ObamaCo's actually doing something.
    This is a potential good guy who's gotten pushed out. Will ObamaCo help keep the lid on by putting an oil co. insider back in charge?

Everything became plastic, and the promary mission of federal agencies turned from supervision to profitmaking, and from regulatory commitment to partnering and collusion. Birnbaum's expertise as a scientitst aside, bureaucratic good intentions are no match for Big Energy's intentions of extraction by all means possible. The Mineral0Management Service is now awash in a sea of scandal rather than “well”-defined tranquility, and probably wishes it were overseeing leasing rights on the moon rather than in its own backyard ~ aka our oil drenched, oil-choked, oil-dependent shores, inland waters, estuaries, bays, and gulf stream waters. It is especially telling when prostitute parties funded by oil lobbyists are caught influencing if not wholly determining by the sheer audacity of their influence-peddling 'enforcement policies for MMS rig regulations. All risks aside, the answer to when a duck is not a duck, is when it ceases to quack, its lungs fill with oil droplets, its feathers molt but do not recover, its back scalded by unfiltered rays tearing through a much depleted ozone. Even Blackwater Security would be annoyed at the lack of esprit de corps shown by MMS in its vapid loss of regulatory willpower, circumlocutously allowing permitting and inspections to take a back seat to continued and renewed drilling.

The Feds knew the risk but preferred to meditate on their party favors' navels, which is to say Big Oil supplied them with so many favors they forgot to look at the details of governing or protecting our shores, and went wholesale into the leasing business…haven't you followed the whistleblower comments? Everyone appointed or connected with this bureaucracy is no better than the last. They all need to be moved out as intellectual pinheads when it comes to practical solutions. Appointing commissions is not going to fix the corrosive nature of graft in all its subtle forms, lobbyists, wild partaying, and powerful campaign contributors included.

    I agree, though, he is not primarily to blame, the whole department of Interior is and he is just at the head of his appointed class, that is all!
