TX GOP platform: Re-criminalize sodomy, make gay marriage a felony

Texas Republicans are a conservative lot. Still, it’s difficult to imagine mainstream GOP voters demanding their neighbors be jailed for engaging in a little hanky-panky behind closed doors.

Nevertheless, the state’s Republican party has voted on a platform [PDF link] by which their candidates will stand, and it includes the reinstatement of laws banning sodomy: otherwise known as oral and anal sex.

The party’s platform also seeks to make gay marriage a felony offense, which may be confusing to most given that the state does not sanction or recognize same sex marriages, meaning any such ceremony conducted does not bear the weight of law. Whether this means the GOP wants gay couples married in other states to be pursued through Texas as dangerous criminals, the party did not specify.

“We oppose the legalization of sodomy,” the platform states. “We demand that Congress exercise its authority granted by the U.S. Constitution to withhold jurisdiction from the federal courts from cases involving sodomy.”

Texas first passed an anti-sodomy law in 1860, setting the penalty at 5-15 years in jail. The ban was finally overturned in 2003 by the landmark Supreme Court decision Lawrence et al. v. Texas. The court found that two men arrested in their own home by Houston police, who charged them with engaging in sodomy, were not committing a crime. Indeed, the court said the men were “free as adults to engage in private conduct in the exercise of their liberty…”

To the contrary, the Texas GOP platform goes even further in attacking homosexuals, adding:

We believe that the practice of homosexuality tears at the fabric of society, contributes to the breakdown of the family unit, and leads to the spread of dangerous, communicable diseases. Homosexual behavior is contrary to the fundamental, unchanging truths that have been ordained by God, recognized by our country’s founders, and shared by the majority of Texans. Homosexuality must not be presented as an acceptable “alternative” lifestyle in our public education and policy, nor should “family” be redefined to include homosexual “couples.” We are opposed to any granting of special legal entitlements, refuse to recognize, or grant special privileges including, but not limited to: marriage between persons of the same sex (regardless of state of origin), custody of children by homosexuals, homosexual partner insurance or retirement benefits. We oppose any criminal or civil penalties against those who oppose homosexuality out of faith, conviction, or belief in traditional values.

In addition to this, the Texas GOP seeks to end the state’s lottery, which provides millions in funding to public education; restrict citizenship to children born in the United States whose parents are citizens; end federal sponsorship of pre-kindergarten schools; impose a jail sentence on any illegal immigrant in the state; shut down all day-labor centers; cut off all bilingual education after a student’s fourth year in a U.S. public school; legalize corporal punishment in public schools; mandate that evolution and global warming be “taught as challengeable scientific theory”; and demand that Congress evict the United Nations from U.S. soil and end American membership in the global body.

In spite of this, Texas Governor Rick Perry went out of his way to extol the virtues of Mexican-Americans and at one point even filled his convention stage with dozens of minorities, essentially using them as props to promote Republican tolerance.

“None of that stopped the convention from adopting a platform full of messages guaranteed to turn off big segments of the Latino vote,” News 8 Austin noted. “Meanwhile, the shrillest of anti-illegal immigrant messages could be found in the vendor booths next door. One popular booth proudly displayed pictures of terrified Mexican women and children apparently rounded up, trying to enter the country illegally.”

“Hispanics will make up 78 percent of Texas’ population growth over the next 30 years, compared with only 4 percent for whites, according to demographic projections,” The Houston Chronicle reported in a story examining the GOP’s platform. “Minority children already make up 66 percent of the state’s 4.8 million public school enrollment — and Hispanics could surpass whites in the state’s overall population by 2015, estimates show.

“Not one of the state’s 181 legislators is a Hispanic Republican.”"

I know people that are in terrible situations and have been denied Food Stamps and Welfare because they still possess “assets” that they could liquidate for quick cash – you know, like their only car or their personal possessions.     Actually, if you read the Republican Party platforms in many states (even California, the Carolinas, etc) you will find that their GOP platforms on the issues of homosexuality and other issues are very much the same.     Thats why Jesus never mentions it as well. There is nothing immoral, wrong, or sinful about being gay. Jesus, however, clearly states he HATES hypocrites. If you preach goodness, then promote hate and twist the words of the Bible, you are a hypocrite, and will be judged and sent to hell. Homosexuals will not go to hell, hypocrites will.

    This is very similar to the religious bigots of the past, where they took Bible passages to condone slavery, keep women down, and used Bible passages to claim blacks as curses who should be enslaved by the white man.     Whilst reading this at first seems amusing because it's so darn ridiculous, the more I think about it the more it troubles me. Society is seriously in a bad way when people with these views have a strong chance of being voted into power because if they do that position of authority is going to act as a form of validation that sure incredibly discriminatory views are acceptable. They are not.

Society does not condone it. Murder is a crime,people pay for it and nobody celebrates it. To put a gay lifestyle into the same category as murder is nonsense, and to co mpare it with problem gambling is an inappropriate comparison. Gambling ruins lives, gay lifestyles in and of themselves do not.     Two things to say whenever anyone insists that ones sexuality is a choice:

    1- If people choice to be gay, then obviously people also choose NOT to be gay. Can you tell us about how you came to the decision to be heterosexual (assuming you really are heterosexual)?

    2- If your position is gay people do not deserve any civil rights protections because they choose to be gay, as opposed to a black person or a woman who did not choose their race or gender, do you agree that people should not have any civil rights based on their religion? After all, religion is a choice, it’s a lifestyle. No one is born Christian or Hindu or Jew etc.

    what exactly does “pro-American” mean? Im an American. I've lived here all my life, as have my parents, grandparents, great-grandparents, and great-great grandparents before me. And I think that laws restricting individual rights is just about the most un-American thing you can do. You do remember from some long ago grade school lesson that the basic tenants of American belief, the ones we started a revolution over, are “Life, Liberty, and the Pursuit of Happiness.” That “all men are created equal.” How is criminalizing what two people do in the privacy of their own bedrooms, or making it illegal for them to care and provide for their children pro-individual rights and responsibiltiy. And, perhaps from the same grade-school lesson, that the very first amendment to your beloved Constitution (actually the Bill of Rights–and, if you can cite any portion of it other than the 2nd amendment and your vague notion that there is something called “freedom of speech,” which apparently only applies if you agree with the speech involved, I will eat my own foot) provides for separation of church and state. How can it be “pro-Constitution” to essentially legislate church dogma? I've got no problem with religion, but it is amzing to me that Republicans are so quick to incorporate the Bible into the Constitution (with awesome catch phrases like pro-Family, pro-America, and pro-Values as if people who do not go to church every week and who do not live in families with a mother, father, 2.5 kids and a dog somehow hate America), when it is expressly forbidden, but completely flip out at the notion that the Constitution might create an expectation of privacy or, I dont know, the right for all Americans to live their lives and love who they want. Also, how did the military get involved here? Do gay folks and/or immigrants somehow affect our military strength? Seems to me that our awesome military is kicking some ass (whether or not they should be there is a different question). What about gay immigrants! Oh my God! Better keep them out or we'll be taken over by the Chinese because our military will completely cease to operate. But I suppose I'm jus an illiterate, anti-American liberal half-wit.

    I am a Texas Republican. Personally and religiously I support traditional marriage for many reasons. However, I adamantly disagree with government telling me what I can and cannot do in the bedroom. Government should be small; the power of the people to enjoy life and pursue happiness should far surpass the power of the government. The next thing you know they will start trying to outlaw premarital relations, and then it will be against the law to go to second base, and so on and so on. How crazy can lawmakers get?

It is categorically true that a very few number of nitwits and zealots send a very false image of American society to the rest of the world. What I find most frightening about this article is this statement from the Texas GOP “opus”, “We oppose any criminal or civil penalties against those who oppose homosexuality out of faith, conviction, or belief in traditional values.” I do believe that may be interpreted to mean it is within a GOPs right to “gay bash” or take any action “criminal” or otherwise to uphold their faith. I find that terrifying.

    I agree with you, but technically removing a part of the brain would be evolution, not de-evolution. As it is a mutation/ modification not seen before in humans, it's evolving. Evolution doesn't necessarily make organisms smarter, just better equipped to survive.

I was a punk rocker in high school and college in the 80s and politically involved in progressive issues, anti-racist campaigns, homosexual civil rights movements and various other activities including direct actions against big oil and other corporate excess. I hold a Bachelor of Arts from The University of Texas and graduated with 3.8 GPA in my college and a 3.6 overall. I don't own a gun. I live in a racially mixed neighborhood with virtually no race based antagonisms. My children are sociologically color blind. While straight, I have interacted with homosexuals my entire adult life and have very close friends, both single and couples, who are homosexual. My children, one of whom is going through puberty, are entirely non-plussed by all of this.

    I wasn't raised by hippies – I was raised in a very conservative military family. My father is vitriolically homophobic and something of a racist although he is educated at a Master's Degree level.

    My point, Willhize, is that, yes, Texas is a very consevative state. In fact, as this article illustrates, pretty around the bend conservative. In addition to all of the above, I have friends who are conservative who are as horrified as what is going on in the Republican Party as I am. Bigoted, “rednecks, stupid, uneducated, gun toting racist homophobs…” aren't exclusive to Texas – I've traveled the entire lower 48 extensively as a professional musician and there are an abundance everywhere. Maybe more here than other places, but everywhere nonetheless. Blanket generalizations cheapen dialogue and are a common tactic of the people of which you speak so extremely.

    I'm not defending these people. Lowering yourself to their standards nullifies your point and grants them an instant win. There are Texans, Arizonans, South Carolinans and people surrounded by ignorance elsewhere on the right side of history in this. If you truly want to be, I suggest you choose your targets to those deserving rather than the entire geographic area.

    I'm going to admit straight off the bat that I'm not going to sit here and read all of the comments on this thread because, frankly, there are a lot of them and from what I have already seen the rest will be in the same vein of people calling Texans ignorant rednecks diseased with intolerance and bigotry being countered by Texans trying to explain that this is not a sentiment that the whole state shares (with a few trolls thrown in for good measure, of course). So forgive me if I restate anything already mentioned, I would just like to put my two cents in.
    For those of you who are putting all of Texas on blast, please know this: the majority of us do not feel this way. Texas is a very large state and, for those of you who have not had the pleasure of visiting, is surprisingly diverse. Texas actually has the highest percentage of gay parents in the union, at least according to the latest study I have read, granted it could be different now seeing as how that was a few months ago.
    Most Texans would like the government to stay out of their personal lives and their homes, so you can see how this would not make a lot of us happy because it is an invasion of what we hold very dear, out privacy. I do believe that there are those out there who support it, but you cannot say that just because you are from somewhere more Northern that there are not people in your state who feel the same. That being said, that still does not justify the above statements. Texas republicans generally come in about two groups: moderate being the majority and extremist the minority. Unfortunately, one stereotype that does apply is that in smaller, more rural towns there is more intolerance; however I think that you will find that most Texans feel that what people do in their own home is their business and their business alone. Also unfortunate is the fact that whatever GOP member that penned this is relying in the support of said extremist voters, and I can only hope that this disgusting piece of sexism isn't an actual platform and if it is, I will surely be writing my congressmen to let them know what a step backwards for personal liberties this is.
    Finally, for those of you who feel that we are more upset over Texas looking bad rather than being upset over this blatant middle finger to the Civil Rights Act, please try to look at it this way: if someone said something that made your mother (or someone else that you cherish) look bad, would you first leap to your mother's defense or would you argue every point that person made first? Texans have a love for Texas that is hard to understand from the outside looking in, and in all honesty, if you have a problem with that, I could really care less. If you're going to be so quick to generalize and stereotype all Texans, and all southerners for that matter, then you are surely no better than the person or persons who made the statements in the article above.
