If you are outside your own home, even if on your property, it is legal to arrest for public intoxication. The problem with this man's arrest is that the officer was basing his assumption on a can of beer he saw inside the man's home. That could have been anybody's. It shows that the officer was in the home, and that the man was not drinking outside, even if it was his beer. Whether he was actually intoxicated or not, is another story. There is no breathalyzer test given, and no investigation.

Just to be on the safe side, let's assume fully half of them have jobs which don't involve public contact. Even so, that's 183,000,000 cop-days that go by every year.
