Senate bill would make airport body scanners mandatory

A bipartisan bill introduced in the Senate requiring all airports to use full-body scanners lacks sufficient privacy safeguards, says a prominent watchdog group.

The Electronic Privacy Information Center says the bill, introduced in the Senate by Sen. Bob Bennett (R-UT) and Sen. Amy Klobuchar (D-MN), “contains particularly weak privacy provision[s] that ignore many of the problems with the devices already uncovered.”

The bill (PDF), known as the Securing Aircraft From Explosives Responsibly: Advanced Imaging Recognition (“SAFER AIR”) Act, would require all commercial airports in the US to use full-body scanners as their primary screening method by no later than 2013. The bill is a response to criticism among some lawmakers that the DHS has been dragging its feet on implementing the technology.

Full-body scanners have been in testing at some airports in the US for several years, and the Department of Homeland Security ramped up expansion of the screening program after the Christmas Day bombing attempt. Some 48 airports have installed the machines so far, and the DHS has purchased 450 of them.

The bill includes clauses designed to protect passengers’ privacy, such as a requirement that the images the scanners create “cannot be stored, transferred, copied or printed.” It also forbids security personnel from having cameras near the machinery.

Those clauses are designed to allay the fears of privacy advocates, who worry that images taken by the machines could be used to humiliate travelers or even create child pornography.

However, the bill’s privacy measures appear to be little different from the policy already set out by the Department of Homeland Security, which states that body-scanner technology is used in such a way that it “cannot store, print, transmit or save the image.”

But, as RAW STORY reported earlier this year, the machines being installed at airports have a setting that allows them to store and transmit the images, and the Senate bill includes no provisions excluding minors from being scanned.

There have been several high-profile cases of screening technology being abused. In one heavily-publicized incident, a TSA worker in Miami who was scanned as part of a training session allegedly assaulted a co-worker who had mocked the size of his genitals.

In another incident, a British airport security worker was reprimanded after making comments about a co-worker’s breasts after a screening.

The Electronic Privacy Information Center has filed a lawsuit against DHS asking for program to be suspended “pending an independent review.”

But Sens. Bennett and Klobuchar insist there is “no excuse” not to implement the technology.

“As the threats against our nation’s air transportation networks continue to evolve, the screening technologies we rely on to identify and counter these threats must evolve as well,” Klobuchar said in a press release. “With so much at stake, we need to make sure we are using the best security tools and that all security forces are working together to stop potential threats before they get off the ground.”

“Magnetometers are not enough in this post 9/11 world, where threats have increased but screening technology has largely remained the same,” Bennett said. “With much more advanced technology on the market, there is absolutely no excuse for the delayed implementation.”

    Force Bob and Amy to have their genitals photographed EVERY SINGLE TIME they fly. And the genitals of their spouses and children…spread-eagled like a subject for dissection.

    Force them to hand over their laptops and cellphones so that all records can be copied and traced and studied and compared and co-related with data from the FBI and local police. Let them have their machines back 8 weeks later. Maybe. They can afford to buy new computers every weekend.

    Force them to undergo complete luggage searches… in public… with confiscation of bottles of water, tubes of hand-lotion, and nail-clippers… as well as any and all medicines. After a few weeks of strangers pawing through their underwear, they won't mind having underwire bras or elevator shoes held up for consultation and further examination every time they fly. Besides, if their brains fry from dehydration, who will note the difference?

    I don't fear some charismatic fanatic in a cave nearly as much as I fear rulers who take advantage of each alarm to strip us of yet more rights. They both “hate us for our freedoms”, but only our own politicians and our own fearfulness can actually harm us.

    After the so-called “underwear bomber”, I'm surprised that Congress hasn't mandated that everyone fly naked. Fine. Since the skies will be safe, they won't require private planes, but can fly naked along with the rest of humanity.

    I live in Hawaii now, and my 12 year old daughter flies quite regularly to visit (and vice versa). Do we have any longitudinal data on the safety of these devices? Privacy aside, I don't relish exposure to teratogens or mutagens simply b/c “DHS” fears the Arab boogeyman.

Really… not only would these machines invade our privacy in a very personal way, but they create ionizing radiation which last I heard is carcinogenic and mutagenic in ANY amount. How DARE they require everyone to undergo an xray before they fly. This is madness…. I've come to think these idiots are really into eugenics. This is tantamount to wholesale murder by radiation.

    The privacy concerns are only minimal when compared to the fact that these devices were rolled out without any real safety testing. You receive the equivalent of a chest xray if you are in this thing for 5 seconds. But if they have you stand there for 30 seconds then how much are you dosed with? Plus when you fly over 35K feet across country you get enough radiation to equal another chest xray. Oh and let us not forget your return trip. In no time americans will be wondering why they are glowing and developing strange cancers. Thanks Michael Chartoff, who is a major share holder in the company who makes these, for ram rodding these into action during the Bush administration. You'll find me going for the frisking from now on as opposed to stepping into one of these devices.

Actually, what is being developed is a bit like Minority Report where they predict your actions before you even know what you are going to do in REAL TIME. This technology is not science fiction, some systems claim 75% accuracy in predicting things like where you are going to eat tonight, etc etc.

If a few choice images were “leaked” to the internet etc. at just the right time it might cause enough of a backlash to quash this at least form a time.     These naked body scanners are highly dangerous AND highly privacy invasive.
    The TSA and the DHS state these scanners do not penetrate the skin ( TSA full body scanner Privacy Impact Assessment 2009) and are therefore safe, ie low power x-rays ( in the backscatter x-ray variety). This is a LIE.
    If the scanners did not penetrate skin, then what about leather garments ( effectively very thick skin ). A terrorist could simply wear thick leather underpants and hide explosives inside them. Therefore the scanners MUST penetrate well inside the body ( they clearly show bones ) and WILL fry your testicles guys – if you are thinking about fathering a child, then do NOT fly.

    The real lunacy in all of this is that virtually none of the many invasive law enforcement/TSA procedures the public has been asked to endure has accomplished a tinker's dam towards making us any safer from potential terrorist threats. All of it — from random bag searches in NYC subways to shoe and belt removal to the lovely choice between a very invasive patdown or an equally invasive and humiliating electronic strip search — amounts to nothing more than theater designed to calm some overly hysterical members of the public.

    There is no magic bullet or piece of technology or security procedure that can make us absolutely safe from a truly determined terrorist. All these scanners mean for would-be terrorists is another workaround. As it turns out, there is a very easy (if somewhat uncomfortable) workaround for body scanners; all potential terrorists have to do is to put the explosives where the Sun don't shine. Body scanners cannot detect items in body cavities. As uncomfortable (not to mention potentially really messy) as that prospect may sound, if someone is crazy enough to fly a plane into a skyscraper or place explosives next to his genitals, then the discomfort of inserting explosives into the rectum hardly presents a major difficulty. So we treat the entire public as potential criminals who must submit to a virtual strip searches (strip search heretofore confined pretty much to prisons) absent any probable cause, and for what: in order to introduce a microscopic hurdle for the bad guys. And still, if they are determined, terrorists will find a way to attack.

    As horrific as 9/11 was the threat to the average American of dying in a terrorist attack lies probably somewhere between a lightning strike and winning the Powerball.

    What should be of much greater concern, especially to those who fly with any frequency, is the radiation exposure these machines subject innocent travelers to. It is quite possible that the risk of developing a cancer or other major ailment as a result of the radiation exposure would be greater than the statistical risk of a terrorist attack. When do we stop with this insane, hysterical nonsense?

    ericroded–HAHA–hey I liked your post–I feel the same way,I just turned 69 and recently went to visit my son out in Washington State from Key West ,Fl–I felt like running through the security check points in a couple of places,I guess they would have shot me right? I'm still in pretty good shape,21 years in the US Army and double dipped after 22 years as a Maiman for the Postal Service. Some of these guys in security are real jerks especially in San Francisco,which I had never been too. I got there at 1:30 in the morning coming home from Seattle to San Francisco,to Miami, to Key West.     Some of us are old enough to remember when there were no magnetometers, no security lines, and no X-Rays. Look at air piracy statistics from 1960 forward, and see how much (or how little) security has been improved.

    One of much more likely to die as a result of pilot or controller error than in any other kind of air disaster. That's the way it's always been and that's the way it is now.

    Pre 9/11 I went through Heathrow Airport, London. They asked me to submit to a “full body scan” which they were just trying out. I agreed to this, being a law abiding citizen trying to help law enforcement. Of course, I later find out its THE scan. Had I known at the time, I wouldn't have agreed. They picked me, a middle aged white woman, to practice on.

    The senate bill will still NOT make naked body scanners compulsory for all in the US. Passengers will still have the 'option' of metal detector/ pat-down screening. This option is NOT available in the United Kingdom, where I live. Here the naked scanners are COMPULSORY for all – no naked scan, no flight. The UK is the ONLY country in the world where the scanners are compulsory, every other country allows a choice of screening as an ESSENTIAL privacy safeguard. Not the UK. Though it is clearly only a matter of time before the US also completely removes this privacy safeguard – there is simply too much mony to be made for naked scanner companies. It is an absoulte disgrace. Passengers in America had better hope that they continue with at LEAST this privacy protection, and not turn into a police state like the UK. The Senate bill also euphemistically states that naked body scanners will 'protect personal privacy'. A similarly horrifying euphemism was used at the Nazi extermination camps by the Germans with the slogan 'arbeit mach frei' – work makes you free. Yeah right, and naked body scanners protect privacy!

    I refused to go through the body scanner at Indianapolis just last Friday. I asked to go through the “normal” screening, metal detector, all that. They said I would need “special” screening for not going through the body scanner. The pat-down that followed was so thorough that I no longer need my annual pap-smear this year. I also got eye-rolled at when a female security screener heard “we need a female screener here” for the pat down, which she followed with a highly sarcastic “oh boy.”

    Its very clear they just want us going through these unsafe, unregulated machines for their convenience. They intend to make “normal” screening so invasive we'll feel the body scanners are our only option left. And what do you say on the spot? No? Good luck getting on your flight if you dare speak up or insist they are even at least polite.

    Very soon there will be no option to refuse these things.
    TSA CAN RECORD AND TRANSMIT these images! They haven't even been out long, and look at the incidences already happening. You want to TRUST these people? I wouldn't trust them as far as I could throw that machine…

    I will never voluntarily go through one of these strip-searching cancer machines. I always ask for the pat-down. I make sure anyone I care about does as well. I cannot believe they are running pregnant women and kids through these things. If EVERYONE asks for the pat-down, these things will go away. If the machine ever becomes mandatory here, I will not fly. Period.

    The UK has seen my last tourism dollar.

    Sad that America has come to this. It seems that soon these scanners will be MANDATORY. Then you have to get a skin-X-ray or Terahertz radiation exposure or CANNOT FLY. At more than 800 million airline passengers worldwide each year, there is virtual certainty that people will die of cancer because of this. They might only get sick a decade or two later, but they will die slowly and painfully, and through their own government, not by the hand of terrorists. That billions of naked pictures, even of children, are taken in the meantime is just a bonus for TSA lechers. Sad that America has come to this.

I mean consider whoever wrote this post, they must have been working hard to write that good and it took a good bit of their time I am sure. Want to smuggle explosives or anything else that the metal detector won’t get? You have several readily available options built in to your body for that, also liquid explosives could easily be implanted under the skin with blunt trauma used to trigger. Now, why do we let the TSA digitally or physically molest us for absolutely no security benefit?
