The sheriff of the most populous county in Arizona says he's "not going to put up with any civil disobedience" when the state's new immigration law takes effect.

Maricopa County Sheriff Joe Arpaio says that if protesters want to block his jail, he'll put them in it.

The Arizona law, which takes effect Thursday, requires officers enforcing other laws to check a person's immigration status if they suspect the person is in the country illegally.

Arpaio told ABC's "Good Morning America" he doesn't know "what the big hype is."

He says it's "a crime to be here illegally and everyone should enforce" the law.

    The connstitution applies to EVERYONE here which is why when a tourist who comes to the US and who may go to Mardi Gras, gets drunk and maybe gets arrested for baring breasts or public intoxication or anything liek that is read their miranda rights and why they are afforded the same rights and responsibilities as those of us who were born here are are citizens.
    The connstitution isn't just for American citizens and nowhere in it does it say ANYTHING like that.
    Now maybe you want it to just apply to American citizens because you view anyone who isn't an American citizen as not as worthy as you or perhaps I may be misstating that maybe you just have a problem with illegals but the fatc remains that it protects everyone and the reason is simple it's one of the most beautiful,living documents this world has seen, it's helpeds to provide life & hope to millions if not billions, it serves as a beacon that so many reach for.

    Actually parts of the Constitution do apply to “illegals.”

    In Wong Wing v. U S, 163 U.S. 228 (1896), the Supreme Court stated (in citing a
    previous case and affirming 14th Amendment rights):

    “The fourteenth amendment to the constitution is not confined to the protection of citizens. It says: 'Nor shall any state deprive any person of life, liberty or property without due process of law; nor deny to any person within its jurisdiction the equal protection of the law.' These provisions are universal in their application to all persons within the territorial jurisdiction, without regard to any differences of race, of color, or nationality; and the equal protection of the laws is a pledge of the protection of equal laws.' Applying this reasoning to the fifth and sixth amendments, it must be concluded that all persons within the territory of the United States are entitled to the protection guarantied by those amendments . . . .”

    So you see, all person in the United States regardless of immigration status are entitled to the protections afforded the Constitution.

    If you stop commerce, block services, block government officials, block emergency based services, health services, utilities and public roads…you bet someone is going to remove you and cite you or jail you.

    Being an undocumented alien – absent aggravating circumstances – is NOT A CRIME. THe Feds do not classify undocumented presence as a crime for the simple reason if you charge someone with a crime, you have to prove it beyond a reasonable doubt to a jury and you have to provide legal counsel. Simple unlawful or undocumented presence in the US is classified as an administrative violation – similar to a zoning matter – so the government can deal with it through an administrative process. Typically, this idiot sheriff isn't even able to effectively articulate the law he claims to enforce.

    To answer your question, the Supreme Court has held that the Constitution applies to “persons” regardless of immigration status. And in case you haven't read the Constitution, United States Constitution, Article VI, Clause 2 establishes federal law as the “supreme law of the land.” Moreover, the Supreme Court is the final word on the Constitutionality of any law and of the Constitution. It's called “judicial review.” If the Supreme Court says that the Constitution applies to “illegals” then it does and that is the end of the matter.

    Civil disobedience does not include 'violence'. Civil disobedience is basically when you interrupt the natural course of business or government with smaller “violations” than all out rioting, yet larger than just being a 'protest'.

    Blocking traffic, chaining yourself to doors, stopping commerce, interrupting services.

    It's not really the same as 'peaceful assembly' or using megaphones and yelling chants. And you can be hauled off for it.

    Arpaio is no stranger to civil disobedience. He does it himself when he disagrees with the law. I also consider him a tyrant and a jerk.
    The issue in this law is that now local police are to question your immigration status, and for being unable to prove that you are here lawfully, which is likely to be true of most of os, even if you are born here, you will end up in Arpaio's own jail. The down side, if it gets worse than that, is that an illegal is now afraid to testify to crime. I for example, had a burglary at a commercial building, and it was an illegal immigrant living in the woods nearby who reported it to me, who then called the police. I asked the investigating officer if he was able to ignore the man's immigration status for the moment so the witness could tell the police what happened. The officer accepted the condition, and got the testimony. In Arizona they can no longer do that. Now, if an employer gives a bad check to an illegal, it is the victim who will go to jail. If there is a murder witnessed by illegals, they will be afraid to speak up, knowing that the terrible Arpaio will be coming for them. This will make a serious mess.
    Arizona has a good many US citizens who look just like Mexicans, since the territory was once part of Mexico, and for generations people have crossed the border freely. It is Arpaio's kind, the long knives, who are immigrants to Arizona. Did Joe's ancestors sign in properly when they arrived? I think that should be investigated. It needs to be asked, what gives the white immigrants to Arizona the right to look down on the Mexicans, who have always been in Arizona? The indian tribes of the area knew nothing of a border, and migrated seasonally across what we now think is the border. They are still there, and look somewhat Mexican. White boys are arrogant and think the world is for them, no matter where their fathers came from, but they want to Harass people who look Mexican, whose grandfathers and their grandfathers before them made their home in Arizona.

    Immigration is not the scale of problem it is said to be. It is this season's equivalent of gay marriage, just something to run against. Republicans are at their best when they are against something. Never mind the collateral damage done to the people victimized by unreasonable laws.
    I think that republicans since Reagan have ignored immigration because it drove down wages. This pleases them, with no thought to the customers they lose as people no longer buy the consumer goods.
    I think enforcing a law like Arizona's is impossible to do fairly, and will end up with all of us being required to have our documents ready to show at any moment, as the Germans once suffered from. Do not sell your freedom for some imaginary security.
    Why is nothing said about how to get to the root of the problem? There is a reason there is no work in Mexico.

    I couldn't agree with you more., hence my stating that that non-enforcement is just an excuse to hide behind. There are thousands of examples of selective or non-enforcement out there that get no attention. I perhaps should have been more clear about my sarcasm of “working in the trades, etc.” That was not my opinion but what I consider that of many of the folks that support the AZ. law. I do not support it. I stand by my comment that we do not owe the migrants anything but that does not mean I think they should be treated poorly. First it's the migrants, then it's the homeless, then it's the dissidents. I am well aware of how fascism progresses through well defined steps in order to isolate and eliminate groups they deem unworthy to share the world with. So, I believe you may have misinterpreted my comments. I will try to be more clear in future posts.

    PHOENIX — A judge has blocked the most controversial sections of Arizona's new immigration law from taking effect Thursday, handing a major legal victory to opponents of the crackdown.

    The law will still take effect Thursday, but without many of the provisions that angered opponents – including sections that required officers to check a person's immigration status while enforcing other laws. The judge also put on hold a part of the law that required immigrants to carry their papers at all times, and made it illegal for undocumented workers to solicit employment in public places.

    Over 50% of the undocumented, came into this country legally. Most over stayed visas.
    There are only 2 ways to be an “illegal”, one to cross the boarder at anywhere besides a border check point(but you actually have to prove they did this, just being here isnt proof and reread my second sentence) The only other way to be an “illegal” is to have been previously deported.

    You can actually live your entire life in the US as a resident alien, without every becoming a citizen. You can get a job and not be a citizen(we do have exchange students you know). You can own a huge corp.. like say the washington times and never ever ever become a US citizen, like the rev moon has not.

    being here without papers is not illegal, we are not north korea.
