Barry Cooper fights the law, wins: Odessa drops all ‘KopBusters’ charges

Exclusive: Cooper to release City of Odessa from $40 million civil suit

Barry Cooper, a former Texas police officer who turned against the drug war and executed a reverse-sting operation against the Odessa police department, will walk free on all related charges, an attorney for Ector County announced Tuesday.

Cooper, perhaps the nation’s best-known drug war activist thanks to his “Never Get Busted” DVDs, set up a fake marijuana grow house in Odessa, wired it for sound and video, then used an anonymous letter to bait police into a Dec. 2008 raid.

The letter was delivered to a local church, which eventually turned it over to police. Not long after that officers came crashing through the door.

Cooper, his wife Candi and another individual who assisted their operation were all arrested two months ago on the Class B misdemeanor charge of Making a False Report to a Peace Officer in relation to the Odessa sting. Candi’s arrest took place at the family’s apartment in south Austin and Barry turned himself in days later at the Texas capitol building, with a typical showman’s flare.

A detailed report on Cooper’s arrest was featured by RAW STORY.

The decision against prosecuting Cooper was made by Ector County Attorney Cindy Weir-Nutter, who had not returned a phone call at time of publication.

“The statute in Texas requires that the false report be made during an investigation, and there was no ongoing investigation,” she told The Odessa American. “You have to be able to prove all elements of the offense beyond a reasonable doubt.”

“The county attorney’s office did not believe they had enough facts or evidence to convict Barry or Candi,” James Gill, Cooper’s Austin-based attorney, told RAW STORY. “In other words, they did not commit any crime.”

“We’re very excited that the county attorney’s office has decided in this way,” he added.

“We knew we were right,” Cooper told RAW STORY. “We knew we designed that sting to where we weren’t breaking any laws and we knew that when the Rangers came and tricked Candi and forced me to turn myself in … We knew they were wrong too. We’re thankful that a prosecutor had enough guts to say, ‘This isn’t right.’”

Cooper added that he would now drop the City of Odessa from a $40 million civil suit he filed against numerous entities and individuals, including the Williamson County Sheriff’s Department, the Odessa Police Department and the Texas Rangers.

“[Odessa] decided not to prosecute us so there’s no point in dragging them through this lawsuit, but we’re going to turn it up on the Texas Rangers for false arrest and retaliation, because it’s clear that’s what they did.”

“It’s about time we had some good news,” Candi Cooper said. “We have been through it lately. To hear this, it’s very wonderful for our family.”

Odessa resident Tammy Grimes, who was also charged for her supporting role in the sting, said she was “extremely excited” at the outcome.

“I’m very thankful for the good work that [Weir-Nutter] and her staff did,” Grimes said. “I’m very happy and pleased.”

The Texas Rangers may yet refile the charges in Odessa. The maximum penalty for Making a False Report to a Peace Officer in Texas is six months in prison.

Both Coopers are still being prosecuted by Williamson County for the same charge in a different case, where Barry claims to have caught a police officer stealing $45 from a reportedly suspicious package, as part of another “KopBusters” sting carried out in 2009.

That officer, Cpt. George Nassour, had Cooper served with civil suit papers on the evening of August 24, alleging slander and libel.

    So unless the Ranger’s can’t read the Texas law I’m baffled why they would pursue charges. According to this DA, without an ongoing investigation there cannot be a false report.
    I also wonder how they planned to get past the hearsay aspect and the fact that the church did not FILE a report but merely informed the officers. I have drunk used bag tea cups stronger than this case!

    This is modus operandi for the police. They dont need charges filed or a prosecution. In most cases just the arrests provide the fear and intimidation they intended in the first place.

    Usually its a protest where the people are illegally and unconstitutionally rounded up, sometimes beaten, held for up to 3 days, and then finally released without charges. Why charge anyone, they achieved their ends, stopped them from protesting, got to beat a couple up, and made sure they didnt protest for another day or two, and made more people afraid to protest when the fear that abusive cops will make false arrests and then drop charges.

    And its a win win situation. If they abuse a citizen and get away with it great. If they dont, and there is a lawsuit, why the citizens pay for it, the cops dont.

    You know cops have the highest suicide rate. Thats from keeping all that evil shit inside. There are no “good” cops. Every cop knows a “bad” cop who lied under oath, stole, took drugs, or got out of a drunk driving, domestic violence charge cause they are cops, and that “good” cop did nothing, kept silent, not only dont they turn them in, theres a culture that you’re just supposed to ignore it.

    Well if you know a bad cop and you dont turn him in, well you might not be a “bad” cop too, but you certainly arent a “good” cop!

    I still think Barry Cooper is a brave man, worthy of praise for taking on those crooked cops, but I’m starting to get annoyed with his antics. That little detail about the letter delivery to the church regarding the christmas tree grow in Odessa was left out of the original account of the incident. Cooper knew the letter was what alerted the cops to the house, yet he publicly speculated that there were all sorts of other, illegal reasons that they found out about it. Without that letter, the cops never would have known. Same with the suspicious packages containing the $45.

    There’s no reason for him to drop the lawsuit, they were wrong to arrest him. What he’s just done is to tell those jackass Texas cops that he was bluffing all along anyway, so go ahead and continue to abuse him and his family!

    I sure hope Barry doesn’t waffle on the civil suit the crooked Capt. Nassour has filed against him. There’s the video showing the Capt. is a thief. While on duty to boot. He may be hoping Barry doesn’t have the money to defend himself, but if it gets to court, it will humiliate the Captain and bring discredit to his department. Barry better not flake out on this too.

    You know what would seriously hinder the cops arresting innocent protesters? If they knew the protesters would immediately be taken before a magistrate to answer for the charges. That would force the cops to prove that they had probable cause to arrest, and then the whole thing would be immediately thrown out, with the protesters free to rejoin the protest.

    That’s only if he went to trial and was acquitted. They then could not refile charges on the same case. However, if charges were dropped, they can be refiled at any time, regardless of the reason they were dropped. That would not be double jeopardy.

    The prosecutor said she did not have enough facts or evidence to prosecute, but you never know with these Texas cops. More facts or evidence could turn up later that they somehow missed earlier.

    I think the lady has mis-stated what the law actually is, because “without an ongoing investigation there cannot be a false report” makes absolutely no sense. False reports are made all the time, and a report, real or false, is what gets an investigation started in the first place.

    If I picked up the phone, called the cops and told them my neighbor stole the rims off my car when I knew he hadn’t, it’s not a false report unless the cops were already investigating him?

    You think they’re not out of money now? The PDs MAKE money by selling property confiscated from suspected drug dealers. They don’t even have to charge you with anything, they can simply roll up, guns drawn, and tell you to hand over the keys of your Cadillac Escalade because they suspect you bought it with drug money. It’s up to you to file all the paperwork and get a civil case going against the PD so you can prove you came about that car by legal means.

    AFAIK, this is why Cooper reported it to a church and not directly to the police.

    ‘In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial”

    And this is EXACTLY the reason they put that in there. Justice will never be served holding people without charges indefinitely.

    Not only that, the Supreme Court decided that if the prison thinks a sex offender isnt rehabilitated, even after he has completed his sentence, why the PRISON can decide to keep them forever! Look it up!

    Actually the cops came to his house in another incident a couple months earlier trying to draw him out again to make an unwarranted arrest and inimidate him by harassing him his wife and children, then I’m sure they weren’t going to press charges and release him like this time.

    Only that time he has his door barricaded and everyone refused to leave the house. The cops DEMANDED they come out and Barry demanded they show him a warrant. When Barry got his camera out and started filming them from the second floor, they turned on all their spot lights on him to burn out the camera view. He replied, yea? I got a spot light too, and got out his military grade spot light and tunred it on THEM! With the light turned on them and them blinded, having no idea what he was doing, he coud be loading up a tank while they are blinded, they freaked out, finally they backed down and turned off their spot lights and Barry continued to film the incident, which is probably why they didint illegally smash his windows and storm the house a la Waco!

    Look, Barry isnt the brightest guy in the world, I mean he WAS a cop for many years. However he has a good heart and one of the only cops who says, this is wrong im going to say something I’m going to DO something about it. BARRY IS A HERO! He is our generations Serpico. His stings are right on but his “antics” like running for DA and writing things on his forehead is weird. Manson does that.

    However, as far as that sting. Its not Barry that doesnt tell you the whole story, it is the media and even RAW. Barry proved how nefarious and crooked the cops are by doing that. This is what happened.

    Barry had a woman write a letter saying she wanted advice about leaving her boyfriend, she was afraid and he was growing drugs in their house. Apparently the church and the cops are in cahoots, becasue next thing you know, they are breaking down Barrys sting house door.

    The church gives the info to the cops “anonymously” saying there is a grow house. Now what is SUPPOSED to happen is the police are supposed to make a buy from someone in the house, or find a Confidential Informant to testify he saw drugs in the house, or worst of all, at least say they drove by and smelled marijuana, to justify a warrant.

    But they dont. They get anonymous tips, or illegally use infra red to illegally spy into your house and then they just lie and say a CI bought drugs there or they could smell marijuana from the street.

    The cops may have done an illegal infra red scan of his sting house and saw the grow light heat for the Christmas trees. And then raided his sting house. Illegally.

    Barry is still waiting for “discovery” where teh prosecution discloses all the evidence against you. Barry is very interested to see how they justified the warrant, since no one in the house could have said their were drugs there, no CI could have said it, and they wouldn’t have smelled marijuana but Christmas tree if they walked by the house.

    Its not necessarily trial and acquittal. There is a point in trial at which a status of “jeopardy” attaches. In a jury trial that is generally when the jury has been sworn.

    Double jeopardy applies for cases where one is acquitted of charges or the judge dismisses the case with prejudice. In this case the DA didn’t proceed to trial therefor leaving it open for future prosecutions.

    The prohibition of cannabis started in individual states as early as 1906, and became nation wide by the mid ’30s. A great deal of the propaganda that was used against pot was racially motivated from the beginning. In the ’20s and ’30s there were significant racial themes associating pot with Jazz and black men seducing white women.

    That was the brilliant stroke. By going to the church and letting them be the middle-man he avoided breaking the law. I love it. Just because an accusation is made that doesn’t give cops the right to bust in and arrest everyone. An accusation is not probable cause. There must be a separate investigation to prove that there is merit to the allegation. These fascists need to be reined in and this is one damn clever way to do it.

    Yeah, this outspoken man might just lose his job over his comments, but they’re comments that have to be made. Once you start reading this blog you’ll get a better understanding of why some cops act the way they do – - because of their political pull – - so they don’t fear retribution, while other officers get hammered for minor violations of rules, regs, and in some cases, laws.

    No, I don’t condone police misconduct nor do I stand up for officers who commit those violations, but I will stand up and fight to make sure cops who do report abuses within their departments are protected from the administration assholes and political hacks who will come after them for speaking out.

    Lt. John Andrews deserves to be protected – - be allowed to keep his job – - from the assholes within the Chicago PD and he should be lauded for taking on the corrupt, incompetent, and ineffective police officers at wherever level they are in the Chicago PD, and Mayor Daley for allowing this situation to continue within the PD.

    If Barry’s willing to continue, and I can’t say I’d blame him if he felt like quitting after what Candi and he have been through…

    I’d say we need a KopBusters movement, Barry and a small team (some with qualifications in law) could take an advisory role and then have ‘cells’ of KopBuster groups coordinating their own actions, with a separate group to specifically handle PR and to ferouciously publicize any incidents were the police, etc. try to avenge the exposure of their corruption.

    Doing this would make the whole KopBusters concept become much more resiliant and reduce the chances that Barry himself could be knocked out of action through litigation/blackmail/etc.

    If planned well, with strong legal and publication/PR teams and with Barry slightly less in the line of proverbial fire, more (and unabated) exposure of corruption should be achievable.

    § 37.08. FALSE REPORT TO PEACE OFFICER OR LAW ENFORCEMENT
    EMPLOYEE. (a) A person commits an offense if, with intent to
    deceive, he knowingly makes a false statement that is material to a
    criminal investigation and makes the statement to:
    (1) a peace officer conducting the investigation; or
    (2) any employee of a law enforcement agency that is
    authorized by the agency to conduct the investigation and that the
    actor knows is conducting the investigation.
    (b) In this section, “law enforcement agency” has the
    meaning assigned by Article 59.01, Code of Criminal Procedure.
    (c) An offense under this section is a Class B misdemeanor.

It’s not everyday that you get someone that tells you and even show you how police can frame you for something that you didn’t do or even intimidate you into doing something. The only “protection” I need is from the people in government. One thing that I see missing is people like Barry willing to stand up and take back the government from backyard bullies that became cops, and to go to the state senate and lobby to get our rights back. There needs to be limits on the ability of the police to arrest without cause and real consequences for breaking those laws.

    There are many police that do a good job, and I honor them for their service. But unlike military service there is significant pay and real power over everyday people. I read a quote once that I think is relevant;

    This is supposed to be a government for the people by the people. So stand up for your rights and write letters and go to the senate, laws can be changed. Our government isn’t broken it’s just in the hands of elected officials who are disconnected from the will of the people.

    You just have to vote and enroll others into the notion that if THE PEOPLE want to smoke pot and they are not hurting anyone, whos business is it anyway? If you want to say that its bad for you, so is eating high fructose corn syrup, drinking, and cigarettes. But its all ok as long as some huge corporation is making a buck off your ill health, right? For them to keep making profit the people must be fed propaganda, kept in the dark about the truth. Hell, who do you think pays for the propaganda?

One thing that I see missing is people like Barry willing to stand up and take back the government from backyard bullies that became cops, and to go to the state senate and lobby to get our rights back. There needs to be limits on the ability of the police to arrest without cause and real consequences for breaking those laws.

    There are many police that do a good job, and I honor them for their service. But unlike military service there is significant pay and real power over everyday people. I read a quote once that I think is relevant;

    “Unlimited power is apt to corrupt the minds of those who possess it; and this I know, my lords, that where laws end, tyranny begins.” –William Pitt the Elder 1770

    This is supposed to be a government for the people by the people. So stand up for your rights and write letters and go to the senate, laws can be changed. Our government isn’t broken it’s just in the hands of elected officials who are disconnected from the will of the people.

    You just have to vote and enroll others into the notion that if THE PEOPLE want to smoke pot and they are not hurting anyone, whos business is it anyway? If you want to say that its bad for you, so is eating high fructose corn syrup, drinking, and cigarettes. But its all ok as long as some huge corporation is making a buck off your ill health, right? For them to keep making profit the people must be fed propaganda, kept in the dark about the truth. Hell, who do you think pays for the propaganda?

    Barry’s efforts are a step in the right direction, but we as a people really need to look at our own complacently and step up and take ownership of a country that is being plundered by profiteers and bullied by corrupt cops.

    You can start by VOTING. Enroll others into your vision of America. We can change the country, but we must ACT!!

    Barry is obviously a man of action. Carry on!!

    If so I would like to thank you personally for your hard work and (considerable)sacrifices you and your family have made to expose the institutionalized perversion of justice.

    I often say only the cops who speak out against the “bad” cops are truly “good” cops and you are one of a very brave few. You are our generation’s Serpico.

    The laws are set up, interpreted and enforced in such a way in America today that the police have such wide leeway that they have become the judge jury and executioner.

    Take traffic laws for instance. On every highway people break the law everyday, car after car after car. The law isnt used to protect public safety anymore. It is used to generate revenue or selectively punish whatever group that individual police officer decides to selectively enforce. Because he can pull virtually any car he wants over because every car is either speeding, tailgating, changing lanes without signaling, yet only a fraction are pulled over by the police and they are invariably minority or poor.

    If a citizen is hurt or killed by a police officer, to begin they have sovereign immunity and one has to prove they were violating established standard procedure before you can sue. So if they consider it standard procedure to choke you into submission and they kill you doing it you cant sue. And if you do get to sue and win the cops dont pay the citizens pay the fines in taxes for their own abuse! And the cop almost never is charged with criminal charges.

    They use false arrest and release without charges as intimidation and terrorism.

    Your tireless work to expose this rotted system is the first step to rehabilitating our justice and enforcement system so that We the People of the United States, can form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity!

    PS I do alot of video/audio/photo editing and special effects, 3D animation, etc. I’d be happy to donate my services if you ever need them!

    Just a thought? What if Kopbusters went national or even world wide tv and web. kopbusters could make a training “program” for groups of serious minded people to set up “stings” all over the US and then “promote” it on the web and or sell it to cable companies. It would be great if a group like the ACLU used thier lawyers for legal advice and “help” change the laws so that illegal activites could be legal (mary jane) and legal activites be made illegal (no warrants/stealing property ect!)
    Ifany group does this however be prepared for retribution because evil does not like being exposed to its ways!!! If setting up a “drug house”‘ make sure it “wired” with audio,photo and video that is transmitted and recorded live off sight! And set up across and behind the “drug house” to also record any action ! Keep those people from each site seperate to keep secret the reverse sting!
    And if things get “funky” for the arrested innocents , broadcast right away to all the world
    from a” anonamous source” and inform the local population of the act of violence in thier midst !Make it the talk of the town and state!
    Maybe “contests” could be nationally held weekly for most anti American police force, compleate with videos and comments from the local and national politicos whats wrong with this picture? Hell I would get cable just to watch this “show” Maybe any money made off that show could be used to help get people elected that believe in freedom and change the laws!Or used the profits to sue for civil rights violations and make sooo much in legal judgement the public will get tired of paying for substandard protection and incompedent services !
    However “WE” cannot blame all this on bad cops and judges eather!!! If you have not voted with your true convictions or are turning your “eyes” away from what going on and saying “its not my problem and do nothing ” –”YOU ARE JUST AS GUILTY AS THE BAD GUYS ARE!!! ” because you condoned it all this time!!!     I am elated to see the Cooper’s get a well deserved break in their on going battle to expose law enforcement corruption. I personally couldn’t believe the OPD/Williamson Co./Tex Rangers had the stones to pull this crap to begin with. Didn’t they know that a move like that would be a PR/legal nightmare for them. Barry has a lot of people’s attention now….if they wanted to mess with him they might have been able to do it before he achieved any fame…but to do it when the guy is started to get nationally known is just unbelievable, They really must think they are untouchable. In a day of the Lindsay Lohans and Mel Gibsons types where the spot light of fame can magnify a person’s actions/behaviors and destroy their life, this is one instance where I believe fame and it’s magnifying glass may have saved a life. I scares me when I think of what those law enforcement agencies might have done to Barry if he had been an ordinary unknown citizen. They would have gotten away with it too……
    I’m not going to make the rash generalization that all cops are bad….I have met some really great cops that are wonderful citizens as well. Dealing with bad cops has always been a problem. It just seems to me that there’s much more of it these days. Either the increase in information/media technology makes it seem like there’s more of this corruption going on or it’s something else that has increased the level of this behavior perpetrated by some LEO to a new high.
    I am willing to bet that the “seizure laws” in this country have contributed to the problem that already existed….like putting gas on a fire it has empowered that bad cops to ramp up their acts and probably temps the weaker ones to go over to the dark side. Don’t dangle a money carrot in front of any law investigations because human nature will tell you that they will be tempted to stomp all over their Granny’s rights to get a nibble of that carrot. Barry wouldn’t have such a broad range of targets if that law hadn’t gotten passed.
    Just my opinion….

    In your scenario, there is no already existing investigation and so no law broken. The cops would investigate ( maybe!) and see if your complaint had merit, if not, then no foul.

    However, let’s say that your rims were stolen previously and you called cops and reported it, and then later reported to cops that you saw your neighbor do it …THAT would be filing a false report. You intentionally reported something you knew to be false DURING an ongoing investigation. Thats the violation.

    It protects citizens from being busted ( supposedly!) for reporting incidents or facts to cops that MIGHT lead to an investigation; the cops do not want citizens fearful of reporting and afraid to report that which MIGHT be false…and yet might be true.

    ” Material to a ‘ criminal investigation’ basically means that you are trying to subvert and ruin an investigation and throw the cops off course to assist the alleged perps. Barry was in NO WAY guilty of that or anything else….has a normal citizen riding by a discarded bag called the cops and said it was suspicious NOTHINg could be done to that citizen…and so it cannot be done to Barry either.

    Reporting a suspicious package MIGHT begin an investigation, but it cannot possibly be considered ‘ material to a criminal investigation’ because until criminal activity is attched to the package there can be no criminal element involved…understand?
