Veterans’ group: CIA blocking lawsuit over experiments on troops

An advocacy group working on behalf of Vietnam veterans has asked a federal judge in California to sanction the CIA, saying the spy agency has been blocking efforts to uncover its role in alleged experiments on US soldiers from the 1950s to 1970s.

The Vietnam Veterans of America filed a lawsuit on behalf of six Vietnam War veterans in January, 2009, claiming that the CIA had used an estimated 7,800 US service members as “guinea pigs” in experiments involving “at least 250, but as many as 400 chemical and biological agents,” according to Courthouse News.

Among the chemicals the lawsuit alleges were used on the soldiers were LSD, sarin and phosgene nerve gases, cyanide, PCP and even THC, the active ingredient in marijuana.

The lawsuit described it as a “vast program of human experimentation” that was “shrouded in secrecy” and carried out without the informed consent of the experiment subjects.

“In 1970, [the CIA] provided Congress with an alphabetical list showing that they had tested 145 drugs during Projects Bluebird, Artichoke, MKULTRA and MKDELTA,” the lawsuit stated, as quoted at Courthouse News.

As the defendant in the suit, the CIA is obliged, by judge’s orders, to hand over data relevant to the lawsuit. But the VVA has asked a judge to sanction the CIA, saying the agency has ignored or blocked its requests for information, and has released only a small portion of the relevant documents.

The VVA’s first attempts to obtain CIA data on the experiments “have been pending for over a year, during which time [the CIA] have attempted to sidestep their discovery obligations at every turn, withholding (or even refusing to search for) large volumes of relevant, responsive documents [and] refusing to provide … witnesses to testify about their document searches and certain substantive topics,” the motion (PDF), filed in a California federal court this week, states.

The VVA says the CIA had refused to use “a routine protective order” that would restrict any sensitive CIA data to within the courtroom, and instead blacked out large parts of relevant documents. The plaintiffs say the CIA refused to provide the names of the test subjects involved, allowing only the names of the six defendants who filed the lawsuit.

“Even more unbelievably, it appears that defendants have yet to search even the most obvious location for documents — Edgewood Arsenal itself,” the motion states, referring to the location northeast of Baltimore where the experiments are said to have been carried out.

The motion states the CIA “served no responses or objections whatsoever” to the VVA’s second and third requests for information.

The motion asks that the judge, in addition to sanctioning the CIA, also order the CIA to pay the VVA’s costs associated with its attempts to obtain CIA information.

Judge James Larson of the US District Court in northern California will begin hearing arguments in the case on Sept. 29.

The VVA describes itself as “the only national Vietnam veterans organization congressionally chartered and exclusively dedicated to Vietnam-era veterans and their families.”

A 2003 report (PDF) from the Department of Veterans Affairs states that “between 1950 and 1975, about 6,720 soldiers took part in experiments involving exposures to 254 different chemicals, conducted at US Army Laboratories at Edgewood Arsenal, MD. Congressional hearings into these experiments in 1974 and 1975 resulted in disclosures, notification of subjects as to the nature of their chemical exposures, and ultimately to compensation for a few families of subjects who had died during the experiments.”

    I entered the Air Force in Sept of 1962 and went thru basic training at Lackland AFB.We were sent to Brooks AFB to one day to be involved in an test.We were given pills to take and told to hang around in the day room where we watched T.V..played cards.We were interviewed about our experience of the day after taking the pill.I must have been given a placebo because nothing happened to me.I do recall other troops claiming they could see the colors of certain sounds and some were talking crazy.

    LSD is not always a negative tool, you could go off into the woods and be completely at peace ‘at one” with nature and the world, psychedelics are potentially “sacred” and perhaps “holy” in the state of mind they can induce in “pure of heart” and morally prepared people in a benign, natural, non-violent setting. No one will understand a word you’re saying that is true. The fact that this tool was demonized and got into the hands of the military and what is perhaps the most secretly kept information is not the experiments done with the drugs but that certain chemicals may not actually be a destructive tool if used carefully and consciously, however the cleansed perception will perhaps “cut through the bullshit” as they say and one wouldn’t be able to participate with a clear conscience in systems and programs one is aware that exacts harm and damage on living things.     They’ve been experimenting on all of us over the years. This is widely known and declassified. More than likely they are continuing with similar experiments. The govt has never held it’s people in high regard and I would say today they hold us with even less regard. We essentially have a rogue govt that offers little to no transparency or accountability. 911 was the achilles heel to the loss of power we the people use to posses. Of course I have numerous questions about 911 as do the 911 victim’s family members. Only about 30% of their questions were answered and I’d say that’s fairly accurate for me as well. I hope we can take our govt back and put it into the hands of the people again. This will only happen when we vote out all the status quo-establishment politicians. We must give up the illusion of the left/right paradigm & put in politicians who will serve the people and honor our constitution.

    The anthrax shot from 2000 and 2003 experimented with the unapproved adjuvant, or booster, squalene.
    As a result of covering up the carnage this caused in the military, we now have squalene in some versions of the swine and bird flu vaccines.
    Squalene causes autoimmune disorders to include lupus, arthritis, brain enflamation, spinal inflamation, strokes, virulent skin rashes and many other severe aliments.

    I doubt if this suit will actually go anywhere. Under the “Feres doctrine,” military personnel have no legal recourse against medical malpractice, shoddy work or living conditions, or even being used as guinea pigs as in this instance. And if they die from any of the above, their survivors have no recourse either. In 1986 the SCOTUS rejected a suit by a man who had been dosed with LSD in a secret experiment (US vs. Stanley, 479 US 1005). At that time I still had a year to go on my USAF hitch. If I hadn’t already decided to get out, that news would have decided for me.

    A number of the GIs who were used as “guinea pigs” in the LSD experiments requested that they be allowed to participate in further tests. They valued the experience. Which goes to show I guess that good can come out of bad.

    LSD’s been shown to be therapeutic for some people, although it certainly wasn’t the CIA’s intent to help these guys. Among those who tried LSD therapy in the early ’60s, before it was demonized, were (if memory serves) Rock Hudson, and Time/Life owners Henry and Claire Booth Luce (she said it saved their marriage).

    The experiments are well documented. The government won’t give up the documents because some of the perpetrators are still alive, and some experiments are still ongoing.

    But you’re wrong if you think you can change things by voting. 80% of U.S. votes are counted by computers called central tabulators that are easily hacked and completely unverifiable. And you may have forgotten Bush v. Gore 2000 where the Supreme Court said that our Constitution didn’t give us the right to have our votes counted, and stopped the vote count. The Constitution also prohibited us from voting directly for President and Vice-President, so even if everyone in the country voted for a politician who would serve the people and honor the Constitution, the political party super-delegates could give the nominations to other candidates, the Electoral College could ignore the popular vote and elect different candidates, Congress could reject the Electoral College votes and select different candidates, or the Supreme Court which has the Divine Right of Kings to issue edicts which cannot be appealed, could intervene again and install a candidate of their own choosing.

    You need to spend a few years studying our Constitution and our electoral system before you can understand that voting can’t change anything in this country. I did. That’s why I advocate that no matter who the candidates or what the issues are, people boycott elections and stop voting until we get, free, fair, open, honest, verifiable elections where every vote must be counted and counted accurately, and the popular vote alone determines the outcome of all elections.

    In the ’08 Presidential election, voters had a choice between a Republican pro-war, pro-bailout, anti-environment (pro-corporate) President, a Democratic pro-war, pro-bailout, anti-environment (pro-corporate) President, and some other candidates with no chance at all of winning in our two-party, winner-take-all, no proportional representation system. So even if every vote had been counted and the President not sworn into office until all the votes had been counted (not in the USA will THAT ever happen), we’d still have ended up with wars, bail-outs, and the BP oil spill.

    Voting alone is not an indication of a democratic system of government. Stalin held elections and people voted, but his government wasn’t at all democratic. Unless there is a level playing field with equal access for all candidates, proportional representation, and open, verifiable election processes, votes are just a sham to make you think you have some say in which unaccountable oligarchs will rule you, when you really don’t.

    You can’t get honest elections by saying, “We demand honest elections, and if we can’t have honest elections, we’ll continue to vote anyway.” The only leverage we have is to withhold our votes until and unless we get honest elections. Without the consent of the governed, no government can claim legitimacy. As long as the stupider half of Americans continue to hold their noses and vote in faith-based elections for what they hope might be the less smelly excrement, all we’ll get is shit.

    In addition to drugging people and assassinating people, the CIA also rigs elections all over the world, including here at home.

    Not all states require that write-in votes be counted. You might consider checking to see if your state happens to be one that does.

    But then again, most voters don’t really care if their votes are actually counted or not, as long as they’re allowed to vote. The apathy of voters never fails to astound me.

    I understand your argument, however it does not hold much validity. Yes, there is voter fraud but it is not as rampant as you allude to. The very fact that incumbents are being voted out and populist politicians are being elected is proof that the system is not completely shot. That’s not to say it isn’t greatly flawed…because it is. I also support having a paper trail and despise these machines as much as you do. That is something we must be active in making happen. But to suggest not voting is absolutely absurd. Your actions put you on the side of the corrupt politicians. By not voting…these bozos are sure to get elected. Your radical thinking is not practical and hurts the patriot movement. Sure there are going to be some areas where votes are flipped to give the status-quo politician the victory, but this is why it’s important to be active in demanding a paper trail in every state and remain active in our push for accountability. The system will never be perfect, all we can do is fight on the side justice & equality and stay active and VOTE! The emergence of a 3rd Party is already on the horizon and this too will also help. Without unity in the pursuit of govt accountability we are sure to fail. You have to work within the confines of the system or the system will destroy you and your voice will be muted..which by not voting it already is. My suggestions will have results…yours will not. In fact, if you believe people will just stop voting all together…you’re living an impossible pipe dream.     I understand your argument, however it does not hold much validity. Yes, there is voter fraud but it is not as rampant as you allude to. The very fact that incumbents are being voted out and populist politicians are being elected is proof that the system is not completely shot. That’s not to say it isn’t greatly flawed…because it is. I also support having a paper trail and despise these machines as much as you do. That is something we must be active in making happen. But to suggest not voting is absolutely absurd. Your actions put you on the side of the corrupt politicians. By not voting…these bozos are sure to get elected. Your radical thinking is not practical and hurts the patriot movement. Sure there are going to be some areas where votes are flipped to give the status-quo politician the victory, but this is why it’s important to be active in demanding a paper trail in every state and remain active in our push for accountability. Without unity in the pursuit of govt accountability we are sure to fail.     As for populist politicians, if you’re referring to candidates funded by multinational corporations, they are indeed popular with those corporations. When Congress has an approximately 11% approval rating, for both major parties to offer up Member of Congress as candidates cannot be considered populist.

It may be that until they can no longer afford TV, that they will remain brainwashed, but that day may not be long in coming. I personally know several people who were unable to afford the switchover to HDTV or cable, and no longer watch TV. There is hope. ;)

Fact of the matter is the Tea Party started under the Bush Administration and had progressive democrats, independants, republicans, constitutionalists, libertarians and even some anarchists. But you probably didn’t know that. Sometimes it’s better to humble yourself a little and not act you know it all. The patriot movement is not equated with the Right or Left or the Tea Party…a recent Rassmussen poll absolutely proves that without any doubt. Americans in general whether left or right want representation and want their leaders to uphold the constitution and bill of rights and to be accountable. You play right into the global elite and the flawed system you speak of by hanging religiously to a party.
    But this isn’t about who is right or wrong it’s about unifying to take our country back into the hands of the people. This is something that most americans can agree on. By arrogantly attacking others who have some of the same desires you have plays right into the hands of the elite. I would think someone who is as well-educated as you would understand that.

    Governments hold elections to get the consent of the governed.

    Elections are the only way that governments can demonstrate the consent of the governed.

    Rasmussen polls only interview voters–they hang up on non-voters.

    If only 21% of voters say that the U.S. government has the consent of the governed, it means that the other 79% are too ignorant to realize that when they vote, they are granting their consent to be governed by whoever wins.

    Not by whoever they voted for, but by whoever wins.

    By voting, they are demonstrating their faith in our electoral system, more than 80% of which is unverifiable, and consenting to be governed by candidates they cannot hold accountable during their terms of office.

    The ONLY time that elected officials are supposed to represent their constituents, is during their terms of office. Before they are elected, they aren’t representatives. Once their terms are up and you can try to replace them, they aren’t representatives. They only time they are supposed to be representatives is during their terms of office. And that is the only time that our Constitution did not give citizens any way to directly hold their representatives accountable.

    If you can’t hold them accountable during their terms of office, they can do whatever they want until their terms are up and you get a chance to try to replace them with somebody else who can’t be held accountable during their term of office.

    In a democracy, people can vote directly on issues and budgets. Nobody can make decisions without consulting their constituents first and representing the will of their constituents. In a republic, representatives can make decisions without first consulting their constituents, but if they do not represent their constituents, their constituents can remove them from office–immediately and directly by voting. It is called a right of recall, something we do not have.

    The Constitution you’re defending did not give us either a democracy or a republic. We can’t exercise our will through our representatives unless we have a way to hold them accountable DURING the time they are supposed to represent us. Afterwards is too late. Harm to the economy, lives lost, and environmental degradation cannot be undone.

    You’re upholding a Constitution written by slaveholding plutocrats to ensure that there would never be a democracy or a republic in the United States–that those who had the money would rule it.

    Imagine a country so tyrannical that the citizens are not even allowed to vote directly for President and Vice-President. That’s us.

    Yes, we can petition our representatives. Our founders petitioned King George with no more success. Petitioning a tyrant is not the same as having power over government by being able to hold elected officials accountable.

    You can’t argue with stupidity like that.

    The framers of the Constitution betrayed the founders who wrote the Declaration of Independence. They did not create a government where all men are equal, they created a government where some were free and some were slaves. BP cannot be held accountable, the Exxon-Valdez oil spill still hasn’t been cleaned up and the victims compensated. The rich cannot be held accountable. We have a system of laws, not a system of justice. There’s a difference. Laws are written by the rich and for the rich. Justice is for everyone–for all, regardless of wealth.

    Imagine a government where a king, dictator, or tyrant has supreme power and their edicts are law and cannot be appealed. Anything they do is legal. Our Supreme Court’s decisions, no matter how absurd, cannot be appealed. They have said that anything a President does is legal.

    You and I don’t want the same things. I want democracy and you want continuing tyranny because either you don’t know what democracy is, or you prefer tyranny

    When an unelected body like the supreme court has supreme power (the Divine Right of Kings) to make decisions that cannot be appealed (and to strike down as unconstitutional any attempts by Congress to legislate around them), you do not have a democratic form of government. You have a tyranny. It doesn’t matter if the tyrants are evil or benevolent, because you still don’t have a democracy. Would you be happy with a king as long as the king belonged to your party or movement or agreed with your agenda? Or do you prefer not to have a king?

    You could be educated also if you stopped calling other people arrogant and did a little research.

    They aren’t the only ones. I’m a victim of something along the lines of social engineering, various types of testing, covert drugging, rape, slander, discreditation tactics surveillance with feedback (more recently, or maybe I just ignored them before) and something awful that gives me “sudden” tinnitus, twitching and fatigue, but mostly in certain rooms. What’s worse, they sic’d some Ericksonian NLP idiots to cyberstalk and harass constantly online. Is this part of a CIA program? Who knows. But everyone should remember that the CIA was not the only agency involved in unethical, immoral and I daresay “unAmerican” experiments and employment of illegal tactics on unwitting/unwilling citizens.

    My story is also connected to the military – but it starts with ancestors in the Cuban navy, a connection through one relative who was a diplomat and another one who was well connected in certain elite scenes that were CIA infiltrated. Because other relatives have suffered something (though not as drastic as the trauma conditioning I’ve been exposed to!) I would suggest that these experiments were not limited to US soil and I don’t think I’m the first to say that.

    What’s worse is that the harassers would have us join communities of mostly infiltrators and people we have nothing in common with who also claim similar types of harassment. Not only do we have to deal with an INjustice system, but we also have to wade through the muck of disinformation and those who would do further harm and discreditation to those of us who have already suffered so much. They would have us be terrorists fighting off the non existing new world order (after all this nonsense belongs to an old world order) or passive dupes. I’ll take option C which is neither.

    When will those in government who KNOW that this is going on finally decide to get a backbone and expose this? This is a country at the forefront of human rights? Prove it. The Veterans’ case is important not just for the justice that would be accorded to them, but to open the door to provide justice for the rest of us.
