BP ultimatum: Let us drill or funds will dry up

Oil giant BP is telling lawmakers that if it isn’t allowed to get new offshore drilling permits in the Gulf, it will not be able to afford to pay for the damage caused by the Deepwater Horizon oil spill, the New York Times reported in its Friday edition.

The Times reports the UK-based oil giant is on the warpath against a drilling reform bill passed by the House earlier this summer that would effectively bar BP from getting new drilling permits in the US.

The CLEAR Act, passed by the House in July, includes an amendment (PDF) that states any oil company that has received more than $10 million in safety fines, or has seen more than 10 workers killed in the past seven years, is barred from being granted new drilling permits. The Times notes that, currently, only BP fits that criteria.

BP officials reportedly insist that their warnings to Congress don’t mean that they are backing away from the $20 billion escrow fund the company established to pay damages to victims of the oil spill. But the Times reports that BP is using some of its voluntary payments as “bargaining chips” with lawmakers.

“As state and federal officials, individuals and businesses continue to seek additional funds beyond the minimum fines and compensation that BP must pay under the law, the company has signaled its reluctance to cooperate unless it can continue to operate in the Gulf of Mexico,” the Times reports.

“If we are unable to keep those fields going, that is going to have a substantial impact on our cash flow,” BP America executive VP David Nagle told the newspaper. That situation would make it “harder for us to fund things, fund these programs.”

The Times reports that 11 percent of BP’s oil production is in the Gulf of Mexico, and the fields there account for about a quarter of the company’s profit. BP’s profits for 2009 were about $14 billion. Thus, Gulf fields would account for about $3.5 billion of BP’s profits for last year — an amount that seems unlikely to greatly influence the company’s ability to pay out the $20 billion escrow fund, or the smaller voluntary payments measured in millions.

For many businesses and individuals affected by the spill, the numbers debate in Washington is purely theoretical; they say they aren’t seeing the money they’ve been promised.

In a meeting with oil spill victims in New Orleans Thursday, Kenneth Feinberg, the Obama administration official responsible for paying out BP’s escrow fund, got an earful from frustrated residents.

“Mr. Feinberg took over and was supposed to be so generous with the funds, and I got my first check and it was half of what BP was paying me,” boat captain George Rick said, as quoted at WDSU TV.

WDSU reports:

And still others haven’t been paid at all.

“With this new claims process they were going to speed it up,” said boat captain Kenneth Kreeger. “Where’s the speed? The speed came to a stop, just like your business, just like my business.”

Feinberg vowed to personally review some cases but insists the claims facility is working around the clock.

But before a check can be mailed, Feinberg said he needs more documentation to prove each claim is legitimate.

“One major problem I’m running into here is the lack of documentation, of proof, to verify these claims,” he said.

BP was also recently criticized for tripling its spending on advertising during the oil spill.

“While BP’s advertising campaign is being executed like clockwork, business and state claims have languished,” Florida Democrat Kathy Castor said.

    Sorry to say, BP likely watched how Republicans control Democrats with loud voices and small threats and too often Democrats bent over backwards or backed down completely. All that needs to happen is Mr. Limbaugh or Mr. Beck to claim the Democrats are responsible for stalling payments from BP because they won’t grant more drilling rights. Assigning responsibility in this way is ridiculous, but Democrats never examine or expose the tactics used against them, they just kowtow to the manipulators.

Congress was poised to step in and handle this thing responsibly, so Barack Obama went into unitary executive mode to protect his corporate masters. There’s no $20 billion.     Here’s an ultimatum, BP.

    Come up with $20B immediately or risk losing:

    1) the right to do business with the US govt

    2) the right to own property in the US

    3) the right to do business anywhere in the US or it’s territories

    3) any existing permits or leases and any right to future permits or leases

    5) the protection of the US military anywhere in the world

    The oil beneath the gulf will still be there. Some other, more responsible company can be awarded the permits, or maybe we’ll decide not to give it away anymore. The “substantial impact on our cash flow,” might just keep you from getting your “life back” for a long while.

    You know what, BP, many of us Americans don’t care if you have to pick up returnable cans to pay your debt to the American people. Corporations have person hood they should be treated as such. I know a person who was behind on his child support and that is exactly what the judge told him same should go for BP. They are not responsible, they have shown that from day one of this disaster. I am sure most of us just want them to clean their mess and just go away. No way in hell should they be left off the hook for one cent of the damage they have done.

    I agree with those who say (a) arrest those who uttered the words of extortion and (b) arrest the board members who allowed said utterance. Then, freeze all BP assets and seize them. Later, we’ll figure out what, if anything, BP is allowed to retain in, oh, 100 years, when the scope of the disaster is determined. By the way, I wouldn’t imagine BP in any form would be around in 100 years.

    Fuck pension funds. The solution is to take care everyone who is alive. Case closed. We don’t need no stinkin’ retirement funds. It’s just another bugaboo. Why should anyone have to spend one second of their life worrying about a retirement plan or their stock portfolio?

    A revolution in thinking needs to occur where everyone in America is taken care of by enforcing the constitutional mandates of equality and providing for the general welfare.

    Simultaneously, of course, corporate officers who interfere with the legislative, executive or judicial affairs of this nation should be arrested, prosecuted, fined and jailed. No longer should Americans tolerate corporate interference, and, as a matter of fact, corporations should die on the death of the founders (plus 20 years to wind down).

    In addition, hoarded wealth should be seized, tax rates should approach 100% on income and assets above a threshold (circa $250,000), and everyone living should have a roof over their head, a job, health care and real food, not necessarily in that order.

    A whole new economy should be started where labor and wages are important not profit or investment. The answers are simple and obvious. Manufacturing and farming should return to the US and they should be run by families or cooperatives. Of course, bringing these ideas to fruition can occur only by revolution and not the ballot box.

    BP has no shortage of oney. If making reparations in the USA for their OWN negligence is costing too much then BP should halt their African drilling projects and apply that venture capital to its damaged debt.

    That’s simple enough, if BP wants to behave like an individual American with unrestricted candidate support rights, let BP live up to its American responsibilities.     They’re only nuts if the Administration and Congress doesn’t back down. The money in the fund is not an eskro account, BP did not put the 20B in an account; the money is tied by written agreement to future income IN THE GULF. It was a poorly negotiated agreement by the Administration and this is the logical, anticipated next step. BP will not be denied new permits and that House bill will die in the Senate. When you consider that 11% of BP’s business is in the Gulf but accounts for 25% of BP income it seems to me that BP should be the party over a barrel if anyone had actually been concerned about protecting the interests of the American citizens and those injured/affected by the explosion and spill. Of course, that opinion is predicated on my 1/2 credit hour in contract negotiation so I’m probably missing the ‘big picture’ or the ‘nuances’ of the negotiation process :-)

    If only it were that easy. What to do with their property holdings? existing leases? Sure, seize them, sounds great but ain’t gonna happen.

    A measure to ban US govt from spending money with them would be easy to pass.
    Banning them from bidding on new leases on govt land might work too.
    Throwing them to the wolves, stop protecting their interests abroad…that might pass and would certainly give rise to some attention in Europe…imagine if oil companies couldn’t rely on US to cover their ass.
    Seizing property? I’m not so sure I’d like to see that. you didn’t suggest it, but many have.

    If you read the article closely, this should have jumped out at you: 11% of BPs wells are in the Gulf…..that means that 89% are elsewhere making money. Also, the fields there account for 1/4 of BP’s profits….that means 3/4 of the PROFITS are made elsewhere.

    Again…that’s EXTORTION Mr President. What are you going to do about it?
