The victim’s crime and sentence here had nothing to do with the fact she was raped. The real fault here is not with the Judge – there was a recommendation of a non-custodial sentence, but the Prosecutor that recommended the ples bargain.

The Prosecutor recommended the sentence. The judge could not impose a higher sentence. She could only disapprove the plea deal and order full trials.

Wrong, the Judge is never constrained by a plea agreement. While the Judge is obligated to hear the agreement, she is not required to accept any sentence recommendation. If that was not the case, we wouldn’t need Judges.

Once the accused pleads guilty, they are guilty. The prosecutor might object and demand a trial, but a Judge can’t.

Why? She gave a sentence inline with the plea agreement. Your anger should be placed with the prosecutor who should have objected to the probation and didn’t. The Judge listened to BOTH, the defense and the prosecutor before giving the sentence. NEITHER recommended jail time.

Blame the prosecutor. And yes, the scum bag should have received a hefty sentence.

After reading through the comments I want to remind everyone. “It is better that 100 guilty men go free than an innocent one be penalized”.

Yes, it is tragic that a 15 y/o was sentenced to a year for “lying” to police. That though, isn’t what this is about. People are upset because a serial rapist was only sentenced to 10 years probation. That is the sentence the defense suggested to the Judge. The prosecutor didn’t object so the Judge accepted the recommendation.

This happens every day in courtrooms across the country. Over 90% of criminal cases end up in plea agreements. If Judges didn’t accept them then we would several fold more Judges and courtrooms. In this case, it was the prosecutor’s job to make a recommendation to the Judge. He didn’t. The Judge can only make a decision based upon what she is given so she did. If the prosecutor had asked for jail time, the rapist would have received it.

No the sentence doesn’t fit. But I would much rather have a system that fails like this than one where innocent are found guilty or people receive totally disproportionate sentences for their crimes.

You know nothing of which you post. The Judge, when presented with a plea bargain has two options: To accept the bargain and sentence accordingly or to reject the plea bargain. If the judge rejects the plea bargain, the defendant has the right to withdraw his plea and go to trial.

You didn’t make your point at all about how plea-dealing helps the innocent. Please explain.

DAs game the plea deal system quite easily by bringing multiple charges, agreeing to drop the most serious charges (that they would have a hard time proving anyway) for a plea of guilty on a lesser charge(s). So, yeah, plenty of innocent people go to jail under this system, because they are trapped and coerced into the guilty plea. Your point (if there is one) above does nothing to rectify that.

This rapist could have been brought up on multiple charges of child molestation, sodomy, etc. In many states the law dictates minimum jail time for even one of those charges, and the judge has no choice in the matter.

This is just an example of an overloaded system, probably corrupt, and has nothing whatsoever to do with keeping innocent people out of jail. The families should at minimum bring civil cases against the rapist, since the criminal court has failed.

If he has committed one he has committed 30 if not more. These girls were at his mercy and scared to death. As usual BR you have it WRONG. The defendant MUST enter a guilty plea to get their “deal” and sometimes an allocution before Sentencing. Then the Judge has the options you describe above, however once the GUILTY plea is entered the defendant can not withdraw his plea. They can appeal but the plea is entered!

I was of the belief that a judge did not have to accept plea deals in the better interest of justice. What in the heck was she thinking? That letting a man who has pled guilty to raping 3 teenagers go free on probation serves justice. Sounds like she has some Wahabi religious background. I guess there are a few lessons here.

1. Never go to the police for anything, even if you are assaulted. They will make a victim out of you and charge you with a crime. That is all that they do. This poor girl only lied because she was scared of her attacker, and they prosecuted her for it.

2. Anyone working for the government is above the law, period. They will prosecute the victim of a crime to the fullest extent of the law for being scared when she talked to the police but if a government employee rapes a little girl, they all look the other way.

As far as I’m concerned, the following people are the real criminals here:

-The officer who arrested and charged this poor victim
-The DA who prosecuted this poor victim
-Obviously, the guy who raped her
-The judge who sentenced her
-The judge who sentenced the raper

All of them should be put into prison unconditionally for a long time. We will not be able to heal as a society until we get these monsters out of their government jobs and into the prisons where they belong.

The plea bargain was probably made because his other victims did not want to go to court and testify and his third victim would have been crucified in court as she was documented as to lying to the police ( I think she was just scared to tell them who it was though) Sometimes plea bargains are made because the state does not have a good enough case and they accept what seems to most people a crappy plea bargain, knowing that the offender will offend while on probation and then he will go to jail……he will not pass go, he will not collect $200…..
The probable alternative was a trial that he might have won and gotten off scott free…. At least now he cannot work with anymore children… it isn’t right in my book either but sometimes this is the best that they can do…. which really sucks….

I have a 15 year old daughter. She’s been known to be dishonest at times, and been grounded and lost her personal time for it. She’s learned to be more truthful, but I would be a fool to expect 100% Truth from her at all times. If I did, I would be a bad parent. 12 months prison for lying about being assaulted….. I’d expect my daughter to be dishonest too if she feared reprisal from the person or some other peer pressure which would keep her from telling the truth. I’m a 12 year Army Vet, so eventually she’d tell me, and I wouldn’t have to threaten her or abuse her to find out. I’d talk with her at length, show her I care enough to find the truth, and she would walk away with a good lesson learned for future behavior. This Judge isn’t enforcing that same concept. Here’s a girl who gets JAIL for being dishonest, ABUSED in the process, and her Victimizer gets off scot free???

If it was my daughter, every person who had knowledge of the facts; but did nothing, a position to enforce the law to its maximum extent; but withheld the use, the ability to set the correct example to the public; but hid out of worry about ? (what the hell could be more important than Justice in this case)…… would very simply, without prejudice, and with extreme clarity……be dead.

No amount of Witness Protection or ‘Will Call’ sex-offender list would suffice enough to prevent true ‘fairness’ for those who persecute those who gave them the right to prosecute villainy. I would NEVER allow someone who did that to my child the chance to walk the streets again, and any Just Us system that protects its own who perpetrates it, is just as guilty and should be tried on the open streets, as the chance to try it in our CIVIL courts has been bypassed.

He had a lawyer. She didn’t. Of course, that opens a whole new chain of worms, but you are correct.

First, you are very wrong. This does happen every day in every over crowded court in this country. I assume the girl had legal aid since this was New York. If she was lucky she met the same legal aid attorney before the trial as she had during the trial. If she was really lucky the legal aid attorney had some time to research the case and talk to the police before hand, but both scenarios are really doubtful.

Most likely, she met her lawyer for the first time when she was brought into court. He would have explained that if she didn’t plead guilty the case would have been put over for trial and she would have remained in jail another 8 to 14 months and there is no guarantee she would be found not guilty (we all know how much police lie). Her family wouldn’t be able to raise bail so what choice did she have?

Now, you claim you haven’t seen such a travesty. Then, you went on to tell about 30 days for spitting. Was that sentence fine with you? As a lawyer you have to be aware of how the “system” works. The poor don’t get justice. They get the shaft. IF, and that is a big IF, they have a high priced lawyer they rarely, if ever, receive the same sentence as a poor person, especially if they were represented by a legal aid lawyer.

Do you wonder why the prosecutor didn’t make a recommendation? Because that is the way the game is played. The prosecutors are either fresh from law school or too incompetent to get hired in private practice. If you play nice with a lawyer (especially a senior lawyer from a large firm) you might get a job offer. Or, you hope to be remembered. The defense will present evidence showing the rapist to be a family guy who was having “mental difficulties” or some other bull crap. He might even present a couple letters from physicians saying he was depressed and did these acts contrary to his normal self. And the nice prosecutor won’t say a damned word.

And it does happen. Every day. And it is a travesty. And those in the system keep their mouths closed because that is the way the system works and no one cares what happens. And as I said above, the sentence doesn’t fit the crime of multiple rape.

If they plead not guilty, their case might be put over for a year for what otherwise should be a small fine. Would any rational person spend 6 months, 10 months, or a year in jail just so they can be found not guilty of a petty crime?

Plea bargaining seldom help the indigent. This doesn’t help people that have faith the legal system works. But as sure as the sun will rise tomorrow, this will happen again. And again. Not just in NYC, but every large city with a crowded docket. a poor person will receive a disproportionate sentence and a rich person a slap on the wrist.

While we may have modern technology to balance human population as you put it, you should look into other factors that Governments are doing to reduce populations, dumb down the public, and enslave us even more. Look into Agenda 21 and Codex Alimentarius to see what they are doing to our food supply, water, and our land. Agenda 21 is a UN plan to condense the population into certain areas. Codex Alimentarius is control of our food and genetically modifying our food, of course they aren’t required to label it as such. Google these two and read more on it.
