Justice Department to probe foreclosure practices after series of scandalous allegations

In yet another sign that the foreclosure crisis in the US may be getting out of hand, a Florida woman has gone to the press about having her home broken into — by an agent of her mortgage bank.

Nancy Jacobini of Orange County, Florida, says she was three months behind on her mortgage payments, but not in foreclosure, when she heard an intruder breaking into her home.

Panicked, she called 911 and spent 10 nervous minutes on the phone with a dispatcher only to discover that the intruder was an agent of her mortgage company, JPMorganChase, who had come to change the locks on her home.

“Someone is breaking … somebody broke into my house!” a frightened Jacobini can be heard saying on a 911 tape obtained by WTFV channel 9 in Jacksonville.

According to WFTV, the bank claims Jacobini never established a mortgage payment plan, and the house was assumed to be vacant as there were no utilities at the address. But the news crew found electricity and running water in the house.

A JPMorganChase representative told the news crew that the company had made a “mistake” in attempting to change the locks, and that the company has no right to change the locks on a home that hasn’t been foreclosed and which is occupied.

As some blogs were quick to point out, the bank agent’s move may have broken Florida law.

“We now have confirmed instances, including 911 calls, of banks hiring people to break into homes where the foreclosure has not yet taken place, and in some instances, they’re breaking into the wrong house,” writes Karl Denninger at the Market Ticker blog. “That’s illegal — until the bank has a court order giving them possession, they don’t have possession and they have no right to be there.”

Denninger describes the bank agent as a “thug.”

In another notorious instance last month, a Ft. Lauderdale, Florida, man had his home foreclosed by Bank of America — even though he had paid cash for it seven months earlier.

“I feel like I’m hanging in the wind and I’m scared to death,” Jason Grodensky told AP. “How did some attorney put through a foreclosure illegally?”

The news comes as lawmakers in Washington grow increasingly alarmed over allegations of foreclosure fraud in the wake of the housing collapse. On Wednesday, Attorney General Eric Holder held a press conference to announce the Department of Justice would be carrying out a probe into foreclosure practices at mortgage banks, The Hill reported.

The move came after House Speaker Nancy Pelosi and 30 other House Democrats called for an investigation into how banks are carrying out foreclosures.

“We are aware of the charges that have surfaced in the newspapers in the last couple of days, and we’re looking at them,” said Holder.

Among the allegations the attorney general was referring to was the phenomenon of “robo-signers” — bank agents who approve home foreclosures without reading the necessary documentation to determine if the house is due for foreclosure.

On top of the federal investigation, “authorities in at least seven states are probing whether lenders used false documents and signatures to justify hundreds of thousands of foreclosures, and the number of these inquiries will grow, according to state officials and legal experts,” reports Bloomberg News.

Last week, Bank of America announced it was freezing foreclosures in 23 states over allegations of wrongdoing. JPMorgan, the bank involved in the alleged Florida break-in, quickly followed suit, suspending foreclosures in the same 23 states. Ally Financial, formerly known as GMAC, did the same last month.

    Few Americans keep up with the corruption by Banks, while Law Makers turn a blind eye, some even protect/defend the banks criminal conduct. Well Obama has take aim on the problem and putting his ducks in a row. This conduct done to this lady has been done to homeowners all over the US. Many people followed the Banks lies and left their homes. Banks don’t have homeowners deeds/ signed names illegally and overcharged interest over 1000 per cent. Obama asked Americans don’t leave your homes but many followed the GOP/Banks and left. The DOJ is finding more crimes committed by the Banks as the banks shareholders have filed lawsuits before the DOJ files theirs.

    Well, Anthony, my first thought on reading this is–I would have got out my gun and only then called 911.

    This is really bad and is going to lead to some hapless mortgage co. employee getting hurt–they’re trying to make a living too–and some homeowner within his/her rights dealing with the guilt of shooting a fellow human being.

    The “thug,” or “intruder,” was likely a contractor who was operating from forms provided to him by the bank. He probably assumed that everything was kosher, since he had documents claiming that he was performing a legal action. He is as much a victim of the bank’s criminal actions as the homeowner. What if he’d been shot? This is all on the bank’s head, and heads should roll.

    All the 12 gauging BS aside, the story makes some interesting disclosures. Ally Financial, B of A, and JPMorgan-Chase are allegedly suspending foreclosure actions. That’s because their employees are not only out of control, but doing illegal actions to assess mortgage status on masses of home mortgages. Eric Holder announced “a probe into foreclosure practices.” That alone bodes against any real consequences for the giant banks running foreclosure assembly lines.
    A full blown criminal investigation is what the nation needs for these greedy bastards who have destroyed our economy and are collecting six, seven and eight figure bonuses on top of their bloated salaries.

    I’m not saying that to be funny, if someone broke into my house, I’d fear for my life and crack him with a golf club or something. I wouldn’t be “askin’ him questions”, I’d be swinging the golf club. Out of fear for my life.

    Not quite.If the bank had given him documentation to perform a job at the house he is in the clear. He had no intention of breaking into a person’s home. His only intention would have been to change the locks. Generally, a criminal act requires a guilty mind; one knows what they are doing.

    Who ever signed the lock changing order could possibly be charged. It is doubtful though. They could just claim an honest mistake. A court might even think it was a civil dispute and not a criminal one.

    The guy is lucky he didn’t meet a baseball bat though. Or worse.

    There is a claim that there is no illegal intent in taking physical ownership of the houses, so there is no crime. But that does not hold legal water. The banks are not only negligent, they are acting with depraved indifference when one person signs off on 10,000 mortgage foreclosures in a month. It is obvious that they are making no attempt to verify that they own the mortgages, or that the properties are even mortgaged. Such failure is indeed criminal, and the participants in these home invasions, including the executive authorizers, should pay the full price of imprisonment.

    Remember the statement that ignorance of the law is no excuse? If what you say is true — if a guilty mind is required — it would nullify the ignorance of the law provision.

    That is, one can be ignorant of a particular law, do something that violates it, and be prosecuted for that violation. It’s common knowledge. And, obviously, you didn’t have a guilty mind because you weren’t even aware of the law.

    Their fine should be, at a minimum, reimburse the victim for the full value of the home. If they owe, it’ll be paid off. If they owe little, they’ll get cash.

Things were out of hand since before the [official recognized] beginning! And the mainstream press now states things like, oh…” people are just beginning to catch on to widespread fraud within the foreclosure crisis” … even though millions of us have first hand experience. Some of you earlier advocated for the homeowner’s right to shoot/kill the bank agent. I am glad he wasn’t shot. I really am. We need his testimony. Either in court or in interview.

    If they tell him to break inot a house, he should ask for their court order first and check if its valid. And if they don’t have one, refuse the job. Unverifiable documentation by the bank doesn’t mean anything. If someone working for the bank doesn’t apply due diligence to verify that the order is legal, that’s his own fault, and dumb trust should be no legal excuse.

    “fear for my life” is an important point that you should tell the police afterwards. Also, when hitting the guy with the club don’t forget to shout “help! Murder!” so loud that the neighbors can hear you. And after the thug dropped to the ground, check if he has his screwdriver, a dangerous weapon, still in his hand. Make sure everyhting is according to the law!

    Investigative journalists should check if some of those bank hired thugs have already been killed in regrettable cases of self defense. Regarding the scale of this criminal activity, it’s probable at least some people defended their homes against the thugs. Wouldn’t be surprised if the banks stayed mum about their role in some strange cases of burglary.

    Wells Fargo tried to sell my home at a foreclosure sale even though we were up to date on our mortgage payments and had receipts to prove it. It took several frantic phone calls, some at 5 am, to convince Wells Fargo that the right hand didn’t know what the left was doing. We saved our house from sale less than 48 hours prior to the sale.

    What is doubly ironic is that a few weeks earlier we were approved for a loan modification.
    This whole episode was shameful. Two good people (my wife and I) were made to feel subhuman for doing the right thing and paying our mortgage.

    If you can, don’t do business with Wells Fargo.

    Florida doesn’t need a court order for a repossession. About half the States don’t need a court order. If the repossession is challenged, it is up to the home owner to challenge it. The other State do require a Judge to sign the repossession.

    That is why they were changing the locks. Even though they do have to file the information with the court, recently the banks have been found filing fraudulent and false documents.

    The story we are reading puts the lie to that. There IS no such thing as a compassionate bank. Banks can care less about bad press; they already run the government and all the government regulators. What could a bad press possibly do to them, get some ineffectual politician to bad mouth them? Besides, this guy is NOT a “bank employee.”

    Bad press is not very scary to big money; they own the press.

    I have to call bullshit here. In order to get these contracts from a bank, you have to be licensed & bonded. If you have a criminal record, you often can’t do that. Certainly, there are some who weasel their way through the cracks in the very shaky system, but show me the statistics if you’re going to make a claim that “many of those burglars already have a criminal record.”
    Also, despite the popular wisdom that ignorance is no excuse, I expect you’ll find that courts do in fact cut some slack for people acting in “good faith.” If your employer, who is in a position to know, tells you something is okay, and you don’t have an obvious reason to doubt, a reasonable prosecutor would drop charges against the dupe, who could be considered as much a victim as the homeowner, and hopefully go after the real guilty party; the lying rat-bastard banksters who sent him.
    That said, it should be obvious to the contractor that a house with people in it is occupied. It takes no effort to ring a doorbell before you break in to change locks, and for people who do this regularly, they’d have to be dumb to not check and cover their asses. There could be someone with a gun behind that door!
    I call the contractor here stupid, & just trying to get paid. I call the banksters criminal.

    Who do you work for? Do you know 100% of the facts of what your boss is up to? Have you looked into all the regulations relating to your line of work? Are you certain that all his record-keeping is in order, all his taxes are paid properly, all the waste from the business is disposed of properly, etc, ad nauseum? Of course not! You expect that your boss, who runs the business, keeps up with all that. It’s not your job to know, and when you hire on, you make a good-faith agreement. If your boss turns out to be a crook & you have no idea, how is that your fault?

    I don’t work. I am 100% disabled. I don’t have to worry about knowingly or unknowingly being involved in someone else’s misdeeds.

    Being a human, I do not have 100% insight. No one does.

    I have to rely on my own judgement. It is not always 100% accurate, but i would hazard a guess, based on my life experience, that is 95% accurate.

    My only job these days is too look at things without a jaundiced eye as often as possible.

    Again, based on my life experience, I am doing okay.

    The locksmith has a choice whether to participate or not in an activity he or she knows may not be ethical or legal. By participating, he accepts part of the responsibility for the consequences.

    He or she is not compelled to participate. It is a matter of choice, as are the consequences.

    Does the name Russell Allen or Allen Russell aka L & R ASSociates out of Boulder, CO ring any bells? That’s the con that Washington Mutual hired to change our locks and clean out/vandalize our house in 2004 when in fact it was NOT in foreclosure. We have a copy of the work order that WM issued. Over $40,000 worth of our furniture, household items and family heirlooms ‘disappeared’ and two cars were towed and put up for sale…So this is nothing new, this has been going on for years!

    It’s a sad state of affairs. To me, it’s very close to lawlessness if people can lose their homes without a court review. And instead of making it easier for the banks to foreclosure on a property, without having to provide evidence they actually own it, the trend should be in the opposite direction, safeguarding the homeowners! Because else there will be even more fraudulent cases. Without the banks being held responsible, and managers being prosecuted, nothing will change for the better!

    Sorry… I hit “Like” accidentally. One does not have to know 100% of the facts if one has a contract to enter an “unoccupied” home and, upon arrival, sees unmistakable signs that the home is not unoccupied. Cars in the driveway, lights and televisions on, people actually in the house, etc., should be a pretty clear indication that the house in question is, in fact, occupied.

    In Indiana, and a few other States, it would be trespassing if they tried to change the locks. Almost half the States don’t require a Court Order to take back the property.

    Florida doesn’t require a Judges signature. All the bank need do is file the paper work with the county or court and then the home owner needs to start the court action to stop the foreclosure. It was this action that allowed the bank to sell a home that someone had paid cash for and owned outright.

    I’m sure it’s no comfort being disabled, but you apparently have more freedom than alot of people who have to work to support themselves and their families. I am basing my statements on the knowledge of a friend here in Oregon who does this kind of work for banks. Mostly he cleans up trashed houses that have been foreclosed or abandoned, but he also gets the orders to change locks. He hates the work, hates the banks, hates having to witness the misery and ruined lives, but he has 3 kids to support, 2 of whom have serious disabilities. Sure, he has the option of quitting this line of work, but with unemployment in this area over 10%, that would be sentencing his family to homelessness, and his kids possibly to death.
    Ultimately, what I am trying to say to everyone on this thread who seems eager to find an excuse to kill someone, anyone, is to look to the real guilty party; the banksters who happily condemn (tens, hundreds of-) thousands to poverty while they buy new yachts with their bailout money.
    I don’t know what the house mentioned in the article looked like, if there were cars in the drive, etc. I think the contractor in question was pretty dumb to do his job without looking into things, and right or wrong, he could have been killed by a vigilant homeowner, but the guilt of the crime here is firmly on the shoulders of JP Morgan Chase, let us not forget that.

As you stated, he might need the work, but if he’s the one doing the B&E, he’d better make damn sure the house is unoccupied.

    The banks do not have the right to force their way into any locked home, foreclosed or not. If the home had been properly foreclosed, the local police or sherrif’s department would have seen to the eviction of the occupants, and the bank would hold the keys. The last I checked, if you’re locked out of your home, you’re supposed to hire a bonded and insured locksmith, who should refuse to act further if working on behalf of any sort of company or professional interest if there are any signs of occupation of the home until the police can be contacted and proper ownership/occupation of the premises thoroughly established, even if that requires several days to complete.

    People are saying that this thug breaking into houses is “just doing his job” and that it was all an innocent mistake. Absolute hogwash!

    If you really are trying to repossess an unoccupied house you CHECK a few things first. Have a look at the electricity meter, see if it is ticking over, have a look at the water meter, check round the side for a car, see if the letterbox is full of junk mail, actually KNOCK on the front door and call out a few times, ring the doorbell ffs. If the house happens to be occupied, then vacant repossession is impossible so you politely inform the occupier that the bank is in the process of foreclosing and sent you round to see if the place is still occupied. Then you say goodbye and update your paperwork.

    Any thug breaking into houses without even doing a few basic checks only has themselves to blame for what happens next.

    We are going through the same thing right now! Chase paid our 2010 taxes, insisting that either our county tax office, our tax collector, or our township sent them a letter stating that our 2010 taxes were delinquent. After numerous phone calls, lies, insults, and pure ignorance, we finally spoke with someone at Chase who sort-of admits that this isn’t our fault. She wouldn’t come right out and say that Chase made the mistake. She said that it has to be investigated and they will get the money back from our tax office, then remove the escrow from our account. She didn’t say what will happen when our tax office tells them that they will not return the money. But, until then, we have to send our monthly payments in, call Chase and give them a work order number. The number is supposed to allow them to accept the regular monthly payment and put the escrow amount aside. Otherwise, our payment would be placed in a holding account because it would be an insufficient amount to cover the payment + escrow. This has been a nightmare. We feel that they are trying to find ways to foreclose. We have been calling, complaining, sending emails to the FBI, our tax authorities etc…We haven’t heard any feedback from anyone. Will they expect us to give them the whole amount for the taxes that they mistakenly paid for us? If we pay them back, we will be “accepting escrow” and they will continue to charge us monthly. What do we do? We don’t want them to do a tax foreclosure. The taxes are our responsibility, and we want to pay, but we don’t want to pay them to Chase. The tax collector won’t accept payment for them because Chase already paid. They added $500.00 a month to our payments. We were having a hard time with the regular payments. We will lose our home if they make us pay them back for their mistake.

    Wait for them to enter, then shoot. Make sure they are facing you when you shoot. As long as there are signs of forced entry its self defense. If they are running from you when you shoot, your going to prison. A State Trooper gave me this advise after we had a close call with an intruder.

    If your taxes were delinquent, they might have the right to start the escrow account. If they weren’t delinquent, they don’t have the right. Look over your contract.
    Each time we called we made sure that they noted our file. We spoke with just about every employee in every department. Telling them the same story over and over. They made a mistake. Call them every day if you must. Dispute the escrow. If they made a mistake, try to prove it. You have to fight for it. They won’t help you unless you show effort. If they tell you that they are going to do something to help you, call back the next day to make sure it was done. They lie a lot. Write down the names the time and date called. You have to do it all. Even if you lose the battle, you will know that you have done everything you could. The squeaky wheel gets the grease. So far that is all I can offer. You can always try to remortgage through a good bank…good luck.
