AT&T pushes Supreme Court to demolish right to join class action lawsuits

A case that has quietly made its way up to the Supreme Court’s docket threatens to unhinge one of America’s key consumer protections: the class action lawsuit.

Telecommunications provider AT&T is pursuing an argument in front of the nation’s highest court that would permit companies which require service or employment contracts to explicitly forbid signatories from joining class action lawsuits.

If they succeed, any company which requires contracts could implement the prohibition on lawsuits, effectively shielding the grandest abuses of corporate America from judicial reprisal if customers or workers were to band together. Instead, AT&T seeks to force signatories into an arbitration process through a preselected, privately owned firm.

In the world of binding mandatory arbitration (BMA), firms almost always find for their employers.

A 2007 report [PDF link] by consumer advocacy group Public Citizen looked at 34,000 arbitration cases in the state of California over an eight-month period and found that the largest BMA company retained by the credit card industry decided in favor of corporate interests 94 percent of the time. Out the 34,000 arbitration proceedings, corporate clients initiated all but 118 of the cases.

“Binding mandatory arbitration is a systematic, privately funded denial of justice for consumers,” Public Citizen’s Laura MacCleery said in a media advisory. “It is a get-out-of-jail-free card for corporate hucksters.”

And it’s not just consumers who could be dramatically affected if AT&T is successful: it’s workers too. Employment agreements and union contracts could also take to banning class action litigation by forcing individuals into a BMA agreement.

Currently, bans on class action lawsuits are illegal under most state contract laws, but there are many circumstances where BMA agreements are permitted. Attorneys for AT&T argue that their contracts should trump state laws under the Federal Arbitration Act of 1927, which holds that prohibiting litigation in a contract is acceptable so long as the arbitration process is as fair as a courtroom.

While there is hope that the court will decide against AT&T — it shut out a similar claim by rival telecom provider T-Mobile in 2008 — the Roberts court, largely seen as sympathetic to big business, may yet side with the telecom.

The suit comes out of California, where Vincent and Liza Concepcion sued AT&T in 2006 after discovering a series of fees attached to a pair of allegedly free mobile phones. Other citizens across the state joined their class action, eventually convincing the Ninth Circuit Court of Appeals that AT&T should be sanctioned. AT&T asked the nation’s highest court for a review earlier this year.

The case is AT&T Mobility v. Concepcion, set to be taken up by the Supreme Court next week. Public Citizen has an extensive archive of material related to the case.

Class action lawsuits in recent years have prevented phone companies from secretly extending contracts every time a customer makes small changes to their monthly service; stopped hidden monthly charges by mobile content providers who falsely advertised their services; and forced Internet search provider Google to take additional steps to protect users’ privacy.

    If the conservaturds in the supreme court do favor at&t’s argument then they should always from then on be called on their supposed support of states rights trumping federal law.     Since the Bush appointment of activists judges Roberts and Alito the rights of individuals have been under constant attack. It should be interesting to see where Kagan and Sotomayor come down on this issue. I fear this will be the first of many more such cases as the Republicans start to flex their muscle in the wake of Tuesday’s election results. Soon there will be no remedy left for working Americans but revolution. I abhor violence, but given the state of the economy and how many people have lost their jobs and houses, anger and frustrations are starting to boil over, and soon it will reach the flash point.

    This push is in line with the Robert’s court logic , perverted as it may be . If a corporation is the legal equivalent to a person , then the court will say that class action is a form of mob rule and will probably give the corporations exactly what they want , to let the bully (big money) rule .     Obama often drives me up the wall with his passivity, but I’ll give him credit for two things: he voted against both fascists Roberts and Alito, and he nominated Sotomayor to the court. People should always remember this.

    Who knows how Kagan will vote, though. If Kennedy shows some sanity for a change, it will up to Kagan not to flip. Any guarantee as to whether she will?

    The corporate masters expect a flash point and planned for it. Why else do you think they pushed the Patriot Act and continue to attack Habeus corpus. And they are really behind the detention camps. We are repeating the history of Russia from industrialization to their revolution.     The constitution specifies ONE crime and ONE punishment. The crime is treason, the punishment is hanging. Personally, I think we should USE this mandated prescription. In fact, I tend to be for it for most of the rich class, damn near the whole of congress, and certainly the ENTIRE last administration. I can’t think of anything that is more needed right now. The rich have screwed us for 3 decades and have NEVER gotten any penalties from it. I think it’s time they pay and pay BIG TIME. I’m for the confiscation of ALL their ill gotten gains, the removal of the family from their home, and the complete abandoning of them just like they have done to us. If their God wants them to be rich, they will be again. I’m all for removing the money from all their too goddamned rich friends, too, so there won’t be any loans or gifts, since they won’t allow US any of those either.

    Since they declared war on US, I say we take it right on back to THEIR front doors. I have a wood shop, torches are easy to make and pitchforks can still be bought at home improvement stores. Scythes are a bit difficult to find, but I bet we can locate enough.

This SCOTUS, under the treasonous scum bag Roberts has never met a corporation it didn’t love FAR more than any human being alive or dead. I think it’s time for an impeachment of a Supreme Court judge. He clearly LIED under oath that he wouldn’t go around making activist judge moves, and he did so within the first 5 years he’s been polluting the court. This scum bag needs to be sent packing, and to jail if possible, EVERY decision the court has made since he took office should be thrown out, and the traitor hung from the closest lamp post to the SCOTUS.

    The big push to create a corporate court aka arbitration has been going on for some time. This corporate court is not voluntary.

    In many cases you will not get the job offer if you refuse to sign arbitration agreement papers.

    When signing up for credit cards many of the aggrements have in fine print language that reads all disputes will be handled by arbitration.

    This is what happened right after the American Revolution. The Conservatives hijacked the nation and stacked the courts with corrupt judges. The people got tired of it and shut down many of these courts until something was done about it.

    Currently the U.S Chamber of Commerce is out to stack the courts with politicians instead of judges. Roberts on the Supreme Court is a politician, he is certainly not a judge.

    Conservatives fighting against the people each minute at a time.

    Well, maybe my wording was a bit over-generalizing
    But what makes you think I’m siding with AT&T on this?
    I want them out of business.
    For them to be out of business, consumers need to choose other much better networks with no clauses… like CREDO, for one example, or any other such smaller companies that still respect our right to privacy and do not try to subvert the justice or political system to their own benefit.
    I do blame many consumers… most or not I can’t say, I don’t know the stats… but I do blame the millions who either don’t care about what companies like AT&T and Verizon do or don’t bother to look it up or stay abreast of events……OR, and most importantly, only choose services based on the convenience of them being the easiest to subscribe to.
    THOSE people I’m only blaming because they lessen the effectiveness of boycotts.

    But of course, I’d have to blame these corporate scumbags like AT&T first and foremost for being the selfish greedy anti constitutional sociopaths that they are.

    Here in TN, GOP gvo.-elect Haslam SPECIFICALLY mentioned tort reform as one of his platform planks on how to reduce health care costs….and now that TN is 100% GOP, let’s see how crazy it gets.     Trial lawyers are hardly the “little guy” who needs legal protection. All their “clients” get is a coupon for future purchases, or a $5 check. Meanwhile, they shake down one business after another. The businesses understand that the lawyers are greedy, represent no one (I’ve never met “my” lawyers even though I get notices that I’ve “won” regularly), and just want money. So they pay them off (in millions), and leave nothing for the anonymous “clients” because the clients rarely suffered any material loss.

    Of course, the sole class action suit that SHOULD be allowed is the one of the American people against the U.S. Government. Let’s not “settle” that case — let’s send all those criminals to jail!

    USSC is going to cite provisions in the Homeland Security legislation which already force employees of government contractors into mandatory arbitration.

    Based on that, IMO, this goes 5-4 Roberts Alito Scalia Thomas Kennedy siding with AT&T based on the argument that Congress has already said they approve of this.

    They either *just do not get it* or they *get it and just want to monopolize with impunity”. This is not about the money. This is about keeping them honest with the power of numbers. When AT&T brings top $$$$ lawyers into court, the class members must have adequate representation as well. Our government no longer protects us from monopolistic business and class actions are one of the few remaining check-and-balance systems we have left.

    The Supreme ‘Corporation’ Of The United States is the finest court system money can buy. This fact was proven during this mid-term election season with all the unbridled corp cash flowing in from God only knows where. It was called “Citizens United vs FEC”. Corps are people now and money is free speech. He who has the most cash gets his candidate (puppet) in office. Us poor taxpayers and decent citizens are at the mercy of the very people we trust to protect us. Who needs a foreign invader when we have our own invaders right here in this country, specifically in that big white house on the hill. WE HAVE GOT TO FIX THIS!!!!!

    A reminder: a few years back Southwestern Bell bought the then independent AT&T corporation. It then proceeded to ditch its “SBC” facade, and adopted the AT&T name and logo for itself. Much like a movie villain would kill people, slice the face off of his victim, and then wear it as mask.

    Maybe this particular twist of a story of corporate consolidation doesn’t seem like much, but I think it’s important somehow. The name/logo change indicates a desire to change their own image, in an attempt to hide from something.

    Also, it’s important to remember that, whenever you hear the talk about how AT&T helped the Shrub Misadministration with its warrantless wiretaps, this was when it WAS its own company. How would its acquisition by SBC affect any attempts to issue fines or sanctions upon it (like that’s ever gonna happen now)? I’m betting that the current “incarnation” would be able to shrug it off by saying “that wasn’t us, that company is dead now”…

    Remember how the Republicans were so against activist judges when Obama nominated Kagan and Sotomayor. They claimed they didn’t want anyone on the Supreme Court that would act this way. Yet when Roberts and Alito were being nominated, all they could do was heap so much praise on them that you’d think they were going to bend over and kiss their behinds all day long. So where are their voices now? Probably won’t be hearing anything about this. It really make you realize how despicable they really are. And the Democrats could have done something about this when they had the ability. Very few spoke up.

    Remember when Bush said we should fight the enemy over there so we don’t have to do that here. How wrong he was about the enemy just being over there.

    Very soon, you will have to sign a legal waiver for every single thing you buy, service you use, and privately owned business you enter, or visit either in the real world or on the web. That way companies can circumvent the law entirely. BMA will be the only avenue. Just read it again.

    There are so few sure ways to make a bet and know you will win. This is one of those bets. I will bet the Supreme Court will either weaken it so that it will barely exist, or they will demolish it altogether. After all corporations are people. So they now have it both ways. They can use the clout as corporations and at the same time cry foul because they are now people. They can come before the corporate Supreme Court as both victim and corporation. Either way they are protected. We are not of course, but they are. After all if there are rules to protect us from the bilking of the corporations, that would hurt the corporations that are human beings now.

    The Roberts court, don’t you just love it?

    If this goes thru then kiss your money goodbye…they are all crooks not just AT&T. Look it up. But everything is on hold waiting on this decision. All cellular contracts have anti class action clauses. Look at yours. Its already there.

    At least if you arbitrate your small claim against ATT and win you have a chance of getting some money. (However, you may be exposed to their costs if you lose–need to check the rules on that).
    On the other hand, if your claim is swallowed up in a successful class action, after Attorney’s fees, costs, etc., you’ll likely get a few penny’s back, if anything.
