Supreme Court Justice Alito: My fundraising for conservative causes is ‘not important’

Statement and fundraising appear to conflict with Code of Conduct for United States Judges

Supreme Court Justice Samuel Anthony Alito, Jr. said his involvement with a conservative fundraiser was “not important” after being confronted by a Think Progress blogger Tuesday night.

At a fundraising event for the right-wing magazine American Spectator, Lee Fang of Think Progress asked Alito why he thought it was appropriate to attend such a highly political fundraiser.

“It’s not important that I’m here,” Alito reportedly told Fang.

“You also helped headline this same event two years ago, obviously helping to raise political money as the keynote,” Fang shot back, only to receive the same response from Alito before he walked away. “It’s not important.”

The American Spectator fundraising event featured Republican National Committee chairman Michael Steele, Republican Representative Michele Bachmann (R-MN), US Chamber of Commerce board member William Walton, and major Republican donor Paul Singer.

According to the Code of Conduct for United States Judges, a justice should not “solicit funds for, pay an assessment to, or make a contribution to a political organization or candidate, or attend or purchase a ticket for a dinner or other event sponsored by a political organization or candidate.”

In 2009, Alito also headlined a fundraising dinner for the Intercollegiate Studies Institute, which funded the conservative journalist James O’Keefe and Delaware Senate candidate Christine O’Donnell. Alito is reported to have helped the institute raise $70,000.

Alito was nominated to the Supreme Court of the United States by President George W. Bush in October 2005 to replace Justice Sandra Day O’Connor. He has served on the court since January of 2006.

His appointment shifted the court to the right.

“The point is not that Justice Alito has turned out to be exceptionally conservative, though he has: he is the third-most conservative justice to serve on the court since 1937, behind only Justice Thomas and Chief Justice Rehnquist,” Adam Liptak of the New York Times wrote in July. “It is that he replaced the more liberal justice who was at the ideological center of the court.”

The American Civil Liberties Union publicly opposed Alito’s nomination.

“Judge Alito has all too often taken a hostile position toward our fundamental civil liberties and civil rights,” said Caroline Fredrickson, Director of the ACLU Washington Legislative Office. “The Supreme Court is the final guardian of our liberties, and Judge Alito has shown that he lacks the dedication to that commitment.”

After that thug Scalia’s shameful tenure on the SCOTUS bench, why are we surprised by any of his SUCK-cessors’ actions?

  • http://pulse.yahoo.com/_NO4EXXA4CF5SCNMNNV4UX2WK6Y Scott

IMPEACHMENT!! add Roberts too. They both said under oath that they respected precedent and would follow the principle of stare decisis. Then they have overturned over a century of rulings and laws regarding corporate campaign finance with Citizens United. They are activist and corporatist judges and need to be removed from office for purjury and/or treason. Won’t happen, but a guy can dream.

  • Anonymous

Alito, Roberts, Scalia, and Thomas are advocates, the antitheses of judges. There will be very few cases coming before the court that cannot easily be perceived as conflicts.

  • Anonymous

Right, The Senate Judicial Committee just had a hearing on weather to impeach a Federal Judge (they did a lousy job of it BTW) but the mechanism is there and ready to roll. This is a good prima facie case for impeachment.

Ginni Thomas is the head of an anti-government POLITICAL organization.

The group sells crap to raise funds…crap that is apparently NOT made in the USA by American workers.

Justice Thomas does not recuse himself from cases where he has a clear-cut conflict of interest.

    All of this is tolerated…why??

Right. Having a Supreme Court judge openly in the pocket of one of the political parties is ‘not important’. He would likely say the same thing if he was caught taking bribes.

This court and its right-wing judges make a mockery of justice. The conflicts of interest are pervasive and if there any shred of integrity left in this nation’s government, these activist judges must be removed from office. MUST BE REMOVED FROM OFFICE. 250,000 assembled on the Mall to see Cobert and Stewart. A million need to march on Washington to impeach these partisan thugs.

This is part of the Reagan Revolution. When the deregulation of the media was enacted it set the stage for Murdoch and others to own the information that the citizens of the US are feed as News. We are done until the bottom shocks the fools that vote against their own interests. The regulations that have been removed since Ray Gun was the patsy of the corporations need to be reenacted one by one. Additionally the surrender of our soverienty to the WTO needs to be undone. Get used to it, we are fucked big time and will be begging for someone who can bring back the middle class. How are things in China right now? Booming, they are even having some issues to deal with that a collective of workers are putting forward. Soon we may be able to get some jobs back because our poor will work for the wages that used to go to China when the workers were without any options.

Does Justice Alito recuse himself when donors to his fundraisers coincidentally appear in front of SCOTUS?

One assumes that Justice Alito agrees with the fund’s disbursements to High Priestess of the Breaking Winds Christine O’Donnell, and conservative cinematographer, Planned Parenthood punker, pimp renderer, convicted phone system scammer, and ACORN denouncer James O’Keefe. If so, I find it hard to evoke any confidence in Alito, one of the most conservative justices ever (but compared to Thomas he is both left and thoughtful).

This activist Supreme Court, in the Citizens United decision, recently gave freedom of speech rights to Corporations, a move that thows out 100 years of campaign fiance laws starting with the Tillman Act of 1907 (which forbade corporate campaign contributions). The court’s ruling resulted in corporations being able to contribute unlimited moneys to political campaigns, basically dominating media markets during elections, and to do so in complete secrecy. 2010 saw an explosion in secret spending; 2012 will be a flood, a debacle. there is little doubt in my mind with Justice Thomas and Justice Scalia attending strategy meetings with the Koch brothers, and this fellow Justice Alito raising money for conservative causes they should all three be removed from the court. This is absolutely unconscionable. The Supreme Court is not supposed to be right or left although it is. It is supposed to try cases based on the Constitution. The Constitution is a very simple document and as far as I’m concerned is hard to read it too many ways.

get these people out of the court immediately

It’s very simple. He willfully and knowingly violated the Code of Conduct. “I am the law, and I’ll make it up as I go along if I so desire.”

Impeachment and removal from the bench is the only logical path. We would do so to any liberal judge. The standard should be no different for any other judge.

Alito’s remarks and actions have disqualified him from serving, and I use that term VERY liberally, considering his SCOTUS rulings so far, on our Supreme Court. Let him go serve on Iran’s Supreme Court, if he feels so wedded to ideology. He took an oath. He violated it, and continues to do so. He must go. Period.

The authoritarian Roberts Vatican majority that controls the Supreme Court is arrogantly corrupt. Bush v. Gore demolished the Court’s legitimacy; Citizens United shattered any bedrock on which that legitimacy might have been rebuilt.

Today’s United States Supreme Court is what federal law denominates a R.I.C.O., a racketeer influenced corrupt organization. It’s decisions have the force of power, but are bereft of legal and moral authority.

  • elizabethcostello

Keep in mind that Alito is the guy who told the Senate confirmation panel when he was nominated for the US Court of Appeals that he would “recuse himself on any legal matter involving Vanguard Funds” . .. which he owned shares of. When he was on the bench, he refused to recuse himself in the first Vanguard related case he heard, and in fact overturned a judgment against Vanguard.

And – the Senators who confirmed him for the Supreme Court KNEW he had in effect perjured himself before the prior panel, yet still confirmed.

    WTF . . . to the 10th power.

Neither President Obama nor AG Holder can “oust” him.

Holder could appoint a special counsel to look into his (and Thomas’s etc. misdeeds), but according to the law, Alito either must resign or be impeached as a federal judge.

It has happened before, and since he clearly violates his judicial code of conduct he has to go. NOW!

This man and Roberts cannot be taken out of the court. As everyone knows it is lifetime. This means all they have done so far to wreck America for all things not corporate or right wing, they can continue to do. People keep pointing out how they both lied during the hearings. Well of course they do. This is how they get in.

We have no objective Supreme Court. What we have is several right wing activists. We might as well dump the court. And we cannot do that either. All we can do is hope one of them dies off before the next election.

It should be obvious by now that we are under attack from an enemy within, and they are being aided and abetted by four SCOTUS justices: Roberts, Scalia, Thomas and Alito.

It’s very suspicious that Roberts specifically requested the Citizens United case be brought before the court for a ruling, even though none of the parties to the lawsuit appealed. Think about that. For one thing, that means the Citizens United case was not even properly before the court. So what motivated Roberts to ignore legal procedure and single out this particular case for an immediate ruling? What was the urgency? And that ruling came down in very short order last January, conveniently giving plenty of time for it to make a serious impact on the midterm elections.

And we now know with absolute certainty that three other SCOTUS justices have been involved with a group of plutocrats secretly conspiring to what basically translates into at the very least sedition, and at worst, acts of treason. They have publicly declared ‘war’ on Obama a/k/a POTUS. I think that really translates into a declaration of war against the American citizenry in general; and in particular, they seek to dismantle ALL progressive policies. By the plutocrats’ own words, they are engaged in class warfare. The rule of law, our civil rights, our liberties, freedoms and the people in general are all under attack by the plutocrats through their foot soldiers, the republican party (as well as the so-called “conservative” dems) and their heavily funded teatard minions–and are being aided and abetted by the corporately owned MSM.

Also consider that Justice Thomas’ wife received anonymous funding ($500,000+) to start her little teatard group just prior to the Citizens United decision.

And BTW, this isn’t the first time wealthy conservatives have attempted to overthrow our govt. Recall, that in the 1930s prescott bush and a bunch of his republican bankster/corporate buddies attempted unsuccessfully to overthrow our govt. It was also a group of conservatives (banksters/corporations) around that same time that provided the funding that allowed the nazis to rise to power. Prescott Bush even had a file entitled, “the Hitler project.” So the republicans have a sordid history in our nation–and the bastards are at it again.

If they reverse Roe v Wade this would NOT automatically “outlaw all abortions.” It would simply afford states the power to pass anti-abortion legislation once again—legislation that was effectively invalidated by Roe. The last thing the GOP wants—although they pretend otherwise—is a showdown with (healthy majority) pro-choicers in every single state in the Union! They would end up with massive egg on their faces, and abortion rights platforms would sweep Democrats back into huge majorities in both Houses (only GOPers left would be in the deep South, where they are anyway). No, reversing Roe would be a disaster for the GOP, which is why the SCOTUS has been tapdancing around it for decades.

Isn’t their something that can be done about a judge who lies in order to gain a seat on the highest court in the land? This man is a disgrace to the integrity and decency of the court. This current supreme court is definitely NOT a class act! In fact, they are downright disgraceful!

“The Supreme Court is the final guardian of our liberties, and Judge Alito has shown that he lacks the dedication to that commitment.”

The Supreme Court guards nothing. The guardians are the US military, law enforcement, and the people assigned to the physical security of the nation. The court are a bunch of men in robes, who are prone to blackmail, manipulation, and bullying by all sorts of people. The fact that the supreme court is ideological at all is proof of this.

All the more reason why the Senate needs to get rid of the filibuster and Obama needs to make filling judicial vacancies a top priority over the next two years. Long term, the goal must be an anti-corporatist SCOTUS majority and the overruling of Citizens United and other precedent that gives corporations the same constitutional rights as individuals. Corporations should have no rights other the ownership rights of their shareholders.

  • alfredo

Yes, he pleaded ” stare decisis” * to virtually every question on judicial precedence. Unfortunately he has violated that principle every in virtually every case he has participated in since he was seated.

    * Stare decisis (Anglo-Latin pronunciation: /ˈstɛəri dɨˈsaɪsɨs]) is a legal principle by which judges are obliged to respect the precedents established by prior decisions. The words originate from the phrasing of the principle in the Latin maxim Stare decisis et non quieta movere: “to stand by decisions and not disturb the undisturbed.”[1] In a legal context, this is understood to mean that courts should generally abide by precedents and not disturb settled matters.[1]

This doctrine is basically a requirement that a Court must follow the rules established by a Court above it.

The doctrine that holdings have binding precedence value is not valid within most civil law jurisdictions as it is generally understood that this principle interferes with the right of judges to interpret law and the right of the legislature to make law.[citation needed] (In Lily Ledbetter and Citizens United they cited nothing and ruled on matters tha t had not been argued at the trial level) Most such systems, however, recognize the concept of jurisprudence constante, which argues that even though judges are independent, they should judge in a predictable and non-chaotic manner. Therefore, judges’ right to interpret law does not preclude the adoption of a small number of selected binding case laws.

  • elizabethcostello

Exactly. But 3 Democrats–Byrd, Nelson, and Conrad–cross party lines to confirm him to the court.

Some of the worst of the worst (Lieberman, Landrieu, Lincoln, etc.) couldn’t even stomach putting this liar and conservative operative on SCOTUS.

  • elizabethcostello

He can be impeached. It has happened to numerous US judges for misbehavior.

Even a Supreme Court judge, Samuel Chase, has been impeached. It occurred in 1804, and was the result of his allegedly allowing his Federalist leanings to influence his votes. The Senate did not convict him, however, and he served until his retirement in 1811.

Alito’s behavior is far worse and provable. He’s got to go.

We need a new Threat Level graph for America, so that Americans can be aware of the threat our nation faces, but this one should have the heading:

Republican Threat to American Freedom and the U.S. Constitution.

Then a full list can be compiled showing how dangerous all the Republicans, especially of the Tea Party kind, are to every man, woman and child in America.

Scamuel Olito saying it’s not important that he’s attending an arch-conservative partisan shindig.

Bill O’Reilly calling for the beheading of a reporter, and the next day calling for him to be beaten up.

A “Christian” pastor putting up ‘kill the doctors” posters in North Carolina.

To put it simply, I haven’t seen this level of conservative and Republican insanity and hate since the 1960s, such concentrated hatred for everything liberal about our liberal democracy, that every American citizens’ life is in danger, which will probably make the killings by right-winger Timothy McVeigh in 1995 look tame by comparison, as well as the killings by right-wing religious nuts on 9/11.

Remember the 1960s? Lynchings and murders of civil rights activists. Assassinations of JFK, Bobby Kennedy and Martin Luther King Jr.

The new graph “Republican Threat to American Freedom and the U.S. Constitution” is blinking RED constantly right now. (Hmmm, maybe this is why Red States are RED States).

This is outrageous. There was a time in our country’s history that this behavior would have not been tolerated and a sitting justice like Alito would have have to resign in shame when this became public knowledge. No longer is there honor or accountability of ones actions to be a fair and impartial judge. The justice system has been corrupted by money. No longer is the rule of law the law of the land. This country is going down the toilet really quickly. There was a coup in this country in 2000 and we no longer are a nation of laws but a banana republic. The way things are going I doubt there will an election in 2012 but a removal by coup of President Obama by the monied interests. Morals or any sense of ethics are gone forever All signs point to the American way of life and law forever doomed when we let the war criminals bush and cheney off and the supreme ct. overruled the will of the American people in 2000. I feel so sad for our country that the American people let this happen and there is no outrage. Our Constitution is now a piece of toilet paper.

This is an obscenity. Even Justice Antonin Scalia — by far the most conservative of the nine justices of the Supreme Court — knows not to involve himself in a blatantly political fund-raiser or to contribute to partisan political causes.

Justice Samuel Alito is DEAD WRONG — what he’s doing is a clear conflict of interest that calls into question his impartiality as a justice. It’s a violation of the U.S. Code of Judicial Conduct, to which Justice Alito must be held accountable. There have been lower-court judges who have been IMPEACHED for such conflicts.

EC, the politicians rarely get out in front of the public. That is why we the people have to influence their behavior. I don’t remember street protest over Holder looking the other way or the O man saying he wanted to look forward.

Dear Frank Fart, You are full it. Alito’s behavior just goes to show how little hope or faith we ordinary folk can have in American Justice. America without justice is dead

    Dear Fart,
Your first mistake is comparing Kagan and Sotomayor with the sleaze ball Alito. Both justices appointed by Obama have recused themselves from cases in which a conflict of interest might be perceived. Neither are known to attend any kind of political fundraisers.

Alito, Scalia, and now Thomas have all fragrantly disregarded their duties and their oaths, to rule in fairness to rich and poor alike. All three are absolutely disgraceful. All of this Sharia law stuff is just hateful bigoted paranoia.

I say he made a contribution to a political organization by attending and headlining a fund-raising event.

Yes, and he also threatened the blogger with arrest! He is hostile, and outrageously arrogant. He has crapped on his justice robes. I say throw the bum out, along with Scalia and Thomas.

  • http://gothicromance.net/ Fransway

Well, it should. It hasn’t been written down because these justices are in a place of honor where it is assumed they can govern themselves. Obviously they won’t, and the hubris of their visible support for the wealthy at the expense of the little guy is outrageous. It’s time to impeach Alito, Scalia, and Clarence Thomas.

Shame on you, you toady for the rich. You stand for all that is wrong with this country.

Please post links to any active petitions to remove Alito from the bench – this man needs to be stopped.
