Will Internet censorship bill be pushed through lame-duck Congress?

A bill giving the government the power to shut down Web sites that host materials that infringe copyright is making its way quietly through the lame-duck session of Congress, raising the ire of free-speech groups and prompting a group of academics to lobby against the effort.

The Combating Online Infringement and Counterfeits Act (COICA) was introduced in Congress this fall by Sen. Patrick Leahy (D-VT). It would grant the federal government the power to block access to any Web domain that is found to host copyrighted material without permission.

Critics say the bill is both a giveaway to the movie and recording industries and a step towards widespread and unaccountable censorship of the Internet.

Opponents note that the powers given the government under the bill are very broad. Because the bill targets domain names and not specific materials, an entire Web site can be shut down. So for example, if the US determines that there are copyright-infringing materials on YouTube, it could theoretically block access to all of YouTube, whether or not particular material being accessed infringes copyright.

Activist group DemandProgress, which is running a petition against the bill, argues the powers in the bill could be used for political purposes. If the whistleblower Web site WikiLeaks is found to be hosting copyrighted material, for instance, access to WikiLeaks could be blocked for all US Internet users.

Though the bill was delayed in September after an outcry from activist groups, it now appears to be back and potentially poised for quick passage in the lame-duck session of Congress, reports DemandProgress.

A group of academics, led by Temple University law professor David Post, have signed a petition opposing COICA.

“The Act, if enacted into law, would fundamentally alter U.S. policy towards Internet speech, and would set a dangerous precedent with potentially serious consequences for free expression and global Internet freedom,” Post wrote in the petition letter (PDF).

The bill is “awful on many fronts,” he wrote at Volokh Conspiracy. “It would allow a court to effectively shut down a site operated out of Brazil, or France, without any adversary hearing … or any reasoned determination that the site actually is engaged in unlawful activity.”

“Even more significant and more troubling, the Act represents a retreat from the United States’ historical position as a bulwark and beacon against censorship and other threats to freedom of expression, freedom of thought, and the free exchange of information and ideas around the globe.”

The Electronic Frontier Foundation has published a list of Web sites it believes are at highest risk of being shut down under the proposed law. Included in the list are file-hosting services such as Rapidshare and Mediafire, music mash-up sites like SoundCloud and MashupTown, as well as “sites that discuss and advocate for P2P technology or for piracy,” such as pirate-party.us and P2PNet.

A TOOL FOR POLITICAL CENSORSHIP?

Free speech advocates argue that Internet censorship laws are inevitably used for purposes other than the ones claimed by lawmakers.

For instance, Australia in recent years set up a “firewall” around its Internet, with the intention of blacklisting child pornography Web sites. But a list of the blocked sites, leaked to Wikileaks, showed that the Australian government was censoring more than porn: The blacklist contained religious and political Web sites.

According to the Melbourne Age:

But about half of the sites on the list are not related to child porn and include a slew of online poker sites, YouTube links, regular gay and straight porn sites, Wikipedia entries, euthanasia sites, websites of fringe religions such as satanic sites, fetish sites, Christian sites, the website of a tour operator and even a Queensland dentist.

“It seems to me as if just about anything can potentially get on the list,” [University of Sydney associate professor Bjorn] Landfelt said.

As predicted by some critics, the “great Aussie firewall” ended up blocking access to parts of WikiLeaks.

    Boy, it sure is great to know that the Democrats get to do it. It will prove to their corporate betters that they are just as cool as the Republicans, maybe even better. Except for Ron Paul — if he gets to audit the Federal Reserve.

    It ain’t going to be a happy new year, folks. Obama et al will be going rogue. What’s to lose; they already probably lost 2012, even if they give us a false flag or go to war with Iran. The only way to survive the coming storm is to localize and grow your own food, and pray that Raw Story survives the coming internet battle.

    The top level of the file sharing pyramid, the place files are posted before they reach torrent and hosting sites, is not on the WWW. (It is a old net, and has Fight Club-type rules, so I am not going to post the name.)

    Anyway, this bill will not even affect the WWW-based search engines that find files on it (like Google) as they do not host the files, they only operate as a directory.

    What I am saying is this is proof that the point of this bill is censoring something other than copyrighted material, if that was the point they would have language to go after the central file-sharing network.

It’s one thing to pull materials down, or send a cease and desist to a webmaster, it’s another thing to pull a website down, to shut a business down without due process. Many websites, especially news websites might be considered guilty of infringement. Even Fox News… Every time Fox News shows another news agency’s clip of an interview or such.. that could be considered infringement, although it falls under ‘fair use”

    And we will never get them back. There will always be a government to tell us, not yet. And just whose judgment will prevail? Where is the cut off point? When is enough, enough? This internet is now, emails, telephone, mail. All of it, all the privacy we take for granted is nearly gone. And the government simply cannot stand this last shred of privacy. If they don’t own it, the corporations will. Then they will decide just what information gets online. And by then it will be too late. WE will continue to read and see just what the corporations want us to see and know.

    Lemme ‘splain something to you Lucy….

    Us conservatives aren’t against “net neutrality” in the sense that we are against the net being an unbiased and open forum for all content.

    Truth is we looked at the legislation and found that it wasn’t about freedom at all, it was about expanding FCC control of what we see as a fundamentally free-market driven system. The best legislation to protect the net is NO legislation.

    We want unfettered access to the net for everybody but we’re confident in the market’s ability to deliver. Every time some major corporate interest has tried to dominate the net, their version has been rankly boring. Nobody bought into it, we bought around it. What more FCC control does is prevent us from creating a new internet, a true open-source thing in the future when the control creeps finally get their way.

    The bill is sponsored by two Republicans (Hatch and Voinovich), neither of whom are far-right, and seven Democrats- Leahy, Klobuchar, Whitehouse, Schumer, Kohl, Specter, Durbin, Feinstein, and the retiring Bayh. Yes, many of the Democrats are considered “moderates” as well, like Bayh and Specter, but not all.

    The previous version of the bill in 2008 (http://news.cnet.com/8301-13578_3-10050080-38.html?tag=mncol;txt) passed out of committee 14-4, with all 4 votes against coming from right-wing Republicans like Cornyn of Texas. It only failed to become law because GWB threatened to veto it.

    Part of the reason that the supporters are trying to ram it through in the lame-duck Congress is that they’re afraid (but don’t know for sure) that the GOP may actually be less friendly to this bill than the current Democratic Congress. Otherwise the MPAA, RIAA, et al. would just wait until the after the new Congress was seated.

    But go ahead and keep blaming it on Republicans.

    This is so horrible, this is going to make the US into a freaking walled off society. I can’t believe that this is happening, this will destroy innovation coming out of the US in regard to IT and even research of other fields. Small online businesses will be hampered too, do you know that most of online bandwidth is porn. You may say so what, but what until you start to see DNS errors everytime you go to a site you used to like either here or overseas because somebody in govt. said that hosted copyright material. What they are setting up in a round about way is making it where americans will be limited to going to sites that are under a corporate umbrella and after that this coporate umbrella will be made into teirs of service. Essentially making the net in regard to the US into the television networks of today or the big brick businesses of today and yesterday. Where the decide what is right or wrong and have the govt. in pocket to do their bidding against any upstart trying to take them down via innovation.

    The US is turning into a third world nation and eventually the sleeping masses will see the full extent of this. Our benefits will be cut, our taxes will be increased and the police and the federal and local govt. will do whatever they want. The rich and wealthy will live in guarded communities and the rest of us will be fighting for scraps that fall off the table. We are being cut out of the world because people are able to see news and information from other parts of the world that contradicts the news in the US.

    We are slowly being put into a massive jail that will be called the US of A.

I have nothing to add, except that, ironically, it is the case that liberals have often proposed more harmful technological nanny legislation than Republicans. Republicans have always seemed more concerned with promoting militarization, torture and the police state. Copyright tyranny, surveillance and paternalism seem to be in the Democrat ballpark. Americans always get the worst of both worlds, oscillating in election cycles.

    The object of this bill, having purposely been written broad and vague in scope is to wreak havoc with free expression and access to information the government (take your pick of regimes) doesn’t currently like. If it passes, expect the net to be nothing but FOX all the time, anytime.
    Culture will go straight down the toilet, as will what remains of education and any intellectual thought. My republican congressman and both US senators are ready to vote yea. I have written letters and made phone calls to their offices about this matter, only to be told that my representatives believe it is in the best interest of the country to redact, edit, eliminate all forms of free access to information that we are so used to being able to obtain through the NET. I am angry and deeply, profoundly disturbed by this. How, pray I ask, does this distinguish the USA from say China or Putin’s Russia or any other draconian regime that holds the thoughts and minds of its citizen hostage?

    We could always create a new form of file sharing, and communication. There are plenty of people who have the technological prowess to do this.     Here we go again. It happens to be a fact that criminals can easily acquire firearms – making most gun-control laws moot because only law-abiding citizens would bother filing the paperwork. In short, the laws go after the little fish, not the big fish. Now, law enforcement is seizing domains. The problem?

    Most domains hosting or giving linkage to copyrighted material are hosted on offshore servers … many of which use dynamic hosting techniques (meaning their IP numbers can change from one minute to the next). So, the only domains they can “seize” are domestic domains registered and hosted here in the USA.

    Can they “temporarily” block a domain? Sure … right up to the moment the IP number changes. Then, they have to find and block the new location … right up to the moment when the IP number changes again. It’s an electronic version of the “Whack-A-Mole” games you see at most carnivals (grin). Whack one mole and another one comes up.

    Of course, it makes good press to say they’re fighting the evil pirates – not to mention justifying budgets to play a never-ending Whack-A-Mole game against them.

    P.S. Regarding the “great Aussie firewall” blocking parts of WikiLeaks. Uhhh … do you know how many mirrors WikiLeaks has – all over the globe?

    This is bulls***. The COICA is allowing the U.S. Government too much freedom to use the powers listed within. And besides, we still have Frostwire and other P2P applications. They may have shut down the Limewire service, but the network it ran on is still up, allowing other P2P applications to run on it, thus making one wonder: Are they just using infringement as a cover, or are they just too stupid to understand how the Internet works? I personally don’t think that they’re doing this to prevent infringement at all. What are you really doing this for, Congress?

    I don’t think this is “feel-good legislation;” I think it is darker than that. Of course they have been planning ways to get the internet for a long time but this is, I think, an attempt to get Wikileaks. “Asange is both the reason for their wanting to take it over as well as an opportunity–he is getting our soldiers killed and putting other Americans and their friends at risk,” and other such self justifying nonsense. If you don’t want American soldiers killed get them out of places they don’t belong! It’s simple. JWC
