Arizona ‘death panel’? State Medicaid cuts poised to let some poor patients die

A law in Arizona that cuts Medicaid funding for certain transplant operations is likely to bring about the deaths of poor residents in need of such procedures.

Starting in October, a measure passed by the Republican-led state legislature began denying Medicaid funds for organ transplants such as bone-marrow, lung, heart and liver transplants, which can be very expensive and are often performed in life-threatening cases.

The New York Times reports that Arizona doctors deem it a “a death sentence for some low-income patients, who have little chance of survival without transplants and lack the hundreds of thousands of dollars needed to pay for them.”

Procuring Medicaid funds for such procedures can require poor patients to sit on a waiting list for lengthy periods of time, and the law is denying funding to those who have waited for years before its enactment.

“I appreciate the need for budget restraints,” Dr. Andrew Yeager, director of the Blood and Marrow Transplantation Program at the Arizona Cancer Center, told the Times. “But when one looks at a potentially lifesaving treatment, admittedly expensive, and we have data to support efficacy, cuts like this are shortsighted and sad.”

The law has brought about a wrenching twist of fate for Arizona patients who need a transplant but lack the money, especially those at the front of the waiting list and denied the option at the last minute.

Arizona physicians and transplant centers have unsuccessfully lobbied for temporary funding. Republican Gov. Jan Brewer’s office described it as a “literally as a last resort” option to bridge the state’s budget shortfall.

But Democrats, such as State Sen. Leah Landrum Taylor, weren’t having any of it. “We made it very clear at the time of the vote that this was a death sentence,” she said. “This is not a luxury item. We’re not talking about cosmetic surgery.”

The law has been dubbed across the country by opponents as Arizona’s “Death Panel” — a reference to Sarah Palin’s false yet influential claim last year that the Affordable Care Act permitted government officials to deny care to patients at their discretion.

The Associated Press chronicled the plight of Arizona patients on Medicaid who need organ transplants and must produce the money or face death.

“Something needs to be done,” said Dr. Emmanuel Katsanis, a bone marrow transplant expert at the University of Arizona, according to the Times. “There’s no doubt that people aren’t going to make it because of this decision. What do you tell someone? You need a transplant but you have to raise the money?”

    here in arizona is the model for a republican controlled legislature and the results…
    brewer claimed that the state budget was balanced during her campaign knowing full well it was almost a billion dollars in the red, we had state parks closed because they stole the money that was funded for them, we had the only rest areas on the highways closed because they weren’t funded, they tried to steal money slated for children’s health programs to balance the budget but the voters turned them down, and now we have REAL death panels. oh and by the way the very first thing they proclaimed after the election was they were lowering business property taxes and RAISING personal property taxes to pay for it. so much for the Taxed Enough Already party.

    Organ transplants are hardly experimental. They are proven life-savers. I have met several people who have had different types of transplants – they’re aren’t some kind of Frankenstein (that’s Fronk – en – steen, sorry couldn’t resist). They are normal, productive citizens. The US spends more on health care with worse results than any other developed nation in the world.

    I kept reading down the comments, wondering if anyone was going to point this out. It’s true, and has been for years, if not forever. The poor are denied treatment every single day, and that includes life-saving treatment. The middle class are, too – probably even more. Anyone who thinks that insurance is going to cover their needs should open their eyes. Ain’t so.

    Keith Olbernann has been reporting on this story for weeks, and as far as I know was the first person or news outlet to do so. He has also been linking to a website that is taking contributions for the two cases that he has been watching, one heart transplant and the other a liver transplant. Both transplant patients who KO has interviewed along with their families on his show, are for young men in their 30s with wives and children who are either out of work because of job loss or because of their actual physical conditions, since both seem too far advanced now to be employable.     This is how Republicans balance their budgets. It is truly an abomination. Where is Sarah Palin on this? Seen any tweets from her on this? I didn’t think so!

I only differ in that I don’t think we’re likely to see any major protest of these issues in the foreseeable future…reason being that those most affected by this are bombarded constantly by messages from the Conservative Media Complex telling them “everything’s OK, it won’t happen to you, no worries, go about your lives…” again and again and again…..until the message is internalized and you find yourself voting for/supporting people or policies that are against your interests.

    When Palin was complaining about health care reform she wasn’t talking about these poor people. She was afraid that along with efforts to remove the requirement for wealth to get good health care, somehow some people who are rich would not continue to get better health care than the rest of us. The teaparty is made up mainly of rich, older white people who want to strengthen the capitalist system that measures worth in all things by wealth, which suits them as they have the wealth. “I’ve got mine, to hell with you” is their motto.     An article I read yesterday said Arizona had 300million+ in funds that have been ‘allocated’ but not disbursed in the budget. Brewers office wouldn’t respond to inquiries as to where the money was allocated.

    Her story was particularly compelling since she is still employed by a Catholic High School as an assistant basketball coach but has no health insurance and evidently the Catholic School or the Catholic Church is not willing to pony up the money to help her get her lung transplant. I thought this was a particularly heinous aspect of her story. In fact, I was outraged.

    It was on the network news on broadcast tv the day the it went into effect, here in Arizona. They were reporting about a man that was already prepped and anesthetized for his liver transplant when they pulled the plug and said no. He woke up to find out he didn’t have a new liver, and wasn’t going to get one. His daughter volunteered to provide part of her liver for him, but they said that won’t work because they would have to give it to someone else because he was no longer eligible for the livers under the new rules. The doctor argued for the transplant anyway and was overruled by the hospital bureaucracy. Talk about cold-heartes SOBs!

    I think that what all of this is proving, is that it is time to reboot the system. Scrap it all, and start over. Govt. has gotten so large that the left hand doesn’t know what the right hand is doing, and both feet are kicking at something they cannot even see. Everyone is trying to patch the problem but, like a tire with a hole in it, with each falling patch, the cost just keeps going up. Eventually, you need to throw out the tire and buy a new one.

People in rural areas generally do not have satellite radio and rely on their ministers, rush limbaugh and glenn beck for “news”.     Most states are trimming medicaid benefits in some way……WA ST has discontinued it’s dental/vision care, even emergency. It no longer even offers a state plan for low income insurance if you don’t qualify for medicaid. Medicaid is available only to children, disabled, destitute elderly and only adults with children. Medicaid is NOT this wonderful “cover everybody who is destitute” plan – it only covers the edges of the worst needs.

    In what possible way is Obama care relevant to this situation? That is just childish. Arizona choosing not to fund health care is not related to health care reform. Most of the provisions of health care reform won’t kick in until 2014, and not at all if conservatives have their way. And if George Soros is contributing to Planned Parenthood that is his right as a citizen. Only good can come from planning children and only having them when they are wanted and can be afforded.

    well i guess the proof is going to be in the pudding so to speak hugh… in the north east there is a state with a progresive governor that is asking to do basicley create single payer medical state insurance, this will provide a cheeper insurance program than say a for profit insurance company that pays a ceo 40 million a year to the CEO who to trim costs to give his stock holders profit denies coverage and remodies for ailments, basicley as compared to our republican governor who is actually telling people they cant have life saving procedures…

    I have worked as a nurse for 24 years. Many decision about healthcare are decided because of money. I have seen patients kept alive by machines for weeks because families are unable to let the family member die and the insurance is still paying. Someone has to pay for this cost.     I have worked as a nurse for 24 years. Many decision about healthcare are decided because of money. I have seen patients kept alive by machines for weeks because families are unable to let the family member die and the insurance is still paying. Someone has to pay for this cost. Usually not the families of these patients. Laws need to instruct doctors that they can’t save everyone and that they don’t have to live in fear of being sued if they don’t.

    1. Who will be sued?
    2. Who will sue?
    3. What is the petitioner’s ‘standing’?
    4. What is the cause of action?
    5. What is the venue?

    Before doing your ‘research, I remind you – there is no ‘right-to-life’. There is no right of treatment. How creative can you get? It is not that I think this is proper or defensable behavior on the part of Arizona – I just don’t believe they are liable for this reprehensible behavior.

    You give her too much credit. To her, the poor are worth-less. They won’t
    make campaign donations or contribute to her Political Action Committee;
    they won’t vote for her or her ‘friends’, and ‘worst’ of all, will absorb
    social services paid by taxes.
