Court now sides with Chamber of Commerce two-thirds of the time

Those who have been arguing that the Supreme Court is growing more friendly to corporate interests while becoming less friendly to everyone else will now have statistical ammunition for their arguments.

A study has found that the Supreme Court under Chief Justice John Roberts has undergone a fundamental shift in its outlook, ruling in favor of businesses much more often than previous courts.

According to the Northwestern University study, commissioned for the New York Times, the Roberts court has sided with business interests in 61 percent of relevant cases, compared to 46 percent in the last five years of Chief Justice William Rehnquist, who passed away in 2005.

And the study notes the Rehnquist court itself was considerably more pro-business than earlier courts.

Meanwhile, a second study, from the Constitutional Accountability Center, has charted the growing influence of the US Chamber of Commerce on the courts. The chamber started filing amicus briefs with the top court three decades ago in an effort to prompt more business-friendly rulings.

According to the study, the Roberts Supreme Court has sided with the Chamber 68 percent of the time, up from 56 percent under the Rehnquist court, and noticeably higher than the 43 percent during the relevant part of Chief Justice Warren Burger’s court, which ended in 1986.

Robin Conrad, VP of the Chamber’s litigation unit, told the Times that her group’s growing influence is not about an ideological court, but rather the result of the chamber’s ability to argue cases better, as well as a shift in the cases it chooses to support.

“Why have we been successful?” she asked. “I’d like to think it’s because of the quality of the arguments and the briefs we present to the court.”

But Doug Kendall of the Constitutional Accountability Center told the Times his group’s study was evidence that the court has grown more corporate-friendly over the years. He also said his study showed “a sharp ideological divide that did not exist before 2005,” when Roberts ascended to the chief justice’s chair.

Kendall says conservative-leaning judges are more likely to side with a conservative opinion — and liberal judges with a liberal opinion — than they have been in the past.

The chamber itself has benefited from the pro-corporate environment on the country’s highest bench. This year, following the Citizens United ruling that upended nearly a century of campaign spending restrictions on corporations and unions, the chamber spent at least $75 million on the mid-term elections, campaigning against financial reform and climate change legislation, among other things, and donating primarily to Republican causes.

In all, shadow groups unofficially campaigning in the mid-term elections spent a quarter of a billion dollars on their efforts, a phenomenon possibly only thanks to Citizens United.

But the Times reports there is another phenomenon at work: The relatively recent practice of US solicitors general — the lawyers who argue for the US government in front of the Supreme Court — taking jobs as lawyers for large corporations.

This trend means corporations now have lawyers practiced at Supreme Court arguments working their cases.

Whereas solicitors general used to move on to work at law schools or private practices, “starting in 1996, every former solicitor general, with one exception, has gone on to supervise a Supreme Court practice at a major law firm, earning as much as $5 million a year,” the Times reports. “The exception is Justice Elena Kagan, who joined the court in August.”

The court is expected to rule soon in two cases that could once again benefit corporations. A case involving AT&T Mobility and another involving Walmart will challenge the practice of class-action lawsuits. If the court sides against customers in the AT&T case — or against plaintiffs claiming gender discrimination at Walmart — it could restrict or even end class-action lawsuits, which many legal observers say are among the most powerful tools to redress corporate misbehavior.

When I look at the decisions we saw in the 60s, decisions calculated to recognize the rights of the little people, and compare them to the protection afforded by our courts these days to the most powerful interests, it is enough to make me weep. WHERE are the champions of the poor, destitute, or even of the middle class in our courts? WHERE are the judges who recognize that individual rights must be protected against the overreach of the ultra-powerful?

People heard Justice Scalia say he votes Political and even campagins for the Republican Party knowing all is a violation of his position. Chief Justice Roberts openly lied under oath during his confirmation hearing and proudly says his votes go the group that pays him as he makes his baseball calls. President Reagan didn’t think Roberts was qualified for a Judgeship let alone a Justice post. Alito let it be known while serving as a Judge in New Jersey he ruled for business and Corporation even when they were guilty. Justice Slappy Thomas is a brought and paid for modern slave and Scalia tells him how to vote. Slappy lied twice, once at the Anita Hill hearing and then at his confirmation hearing. Republicans denied the 7 woman Slappy had sexually harassed from testifing at the hearing. Roberts quickly asked for a raise in salary and was turned down because of the Recession. Well he got the big bucks from Corporations for allowing them to have the same rights as citizens. If there were an audit of the Supreme Court Justices we’d be down to 4. Founder Chief Justice John Jay is in heaven watching the hightest Court become corrupted, while the American people are clueless. Without honest Justices the Court fails and China is waiting to take charge as we owe them 12 Trillion dollars and wont be able to pay the loan as Law Makers fight to destroy Obama and the USA.

When these scumbags finally outsource every job possible, eliminate social security and medicare/medicaid and steal our pensions, there will be no money to spend on goods and services, thus eliminating their source of income. Only then will the US cease to exist as a democracy. Then it will truly become frightening as the US will probably become a fascist state. We’ll be working for meager wages while the wealthy continue to feed upon the populace.

    I never thought I’d see this happening in my lifetime, but as I sit and breathe, I can sense doom for the US. Maybe I’m just paranoid, but I doubt it.

    So very true. Funny how our ‘Founding Fathers’ felt no need to write into our constitution some of them eloquent words against the tyranny of corporations. They’d just fought a war against one (East India Trading) and won, yet didn’t think it could happen on our soil, apparently. Maybe short sightedness? Hubris of a victor? Whatever the reason they didn’t even feel the need to differentiate between human citizens and corporate citizens (women were considered for a month, but didn’t make the final cut) in all those fancy documents about life, liberty and happiness. They were well aware of the dangers. I’m starting to think that our country was founded by opportunists who figured they’d be the ones on top after the reset.

    Then, after that original set of men & their proteges passed on, we the People were subject to the Railroads and their almost total ownership of the courts ranging from local to the SCOTUS. The Corporations gained so very much during that era.

    Then there was that odd little blip of socialism and communism and all that other ‘common man’ philosophy during the early part of last century. Pretty much squashed by the aftermath of WWI, it’s only vestige was in the Labor Unions. Well, they are pretty much dead, leaving only the Corporations. First the Military Industrials, later the Pharma’s and a few others. And guess who funded them all (and the Railroads)? Banking. And they answer to no one.

    I suggest that Corporate and the Chamber of Commerce are separate issues. The corporate entity before the court could be any number of structures. It could be Americans who were able to grow their business, or it could be somebody like Citibank, whose ownership is vague and probably foreign money. The Chamber, as we have been learning, is a different animal. It could merge with a campaign committee. Their financing is secret, and as far as the evidence shows, in primarily foreign. Again we show a crying need to say, what is an American corporation? An individual from Tibet will not get access to the US courts, why does a foreign corporation get treated differently?

    Sadly, and extremely scary, is the fact we’re moving more and more to the Ayn Rand/John Galt school of corporate control.     This study is very important because it not only confirms what many of us have already concluded about the SCOTUS, it provides statistical proof that supports the argument. And consider that within the next 2 to 4 years, there are probably going to be a couple of SCOTUS justices who will be retiring. Think about that. The last thing we need is another republican president adding a couple of more anti-American justices to the SCOTUS. If that occurs, the subversion of our democratic-republic will be complete.

    The people should be demanding the recall of John Roberts–he flat out lied to Congress–and then there’s Scalia, Alito and Thomas. Those four activist justices have utterly betrayed the trust of the people and should be removed from the high court. The republican party, the US Chamber of Commerce, the named SCOTUS justices, and the corporately-owned media, all seem to be collaborating to destroy our democratic-republic.

    Under such circumstances, displays of civil disobedience by the people en masse against those named above is not only warranted, it’s vital to the preservation of our Constitution, our rights, liberties and freedoms. You think it’s bad now–consider what the corporately-owned republicans and their teatards are threatening to do once they regain control of the house in January–shutting down govt, eliminating SS, medicare, medicaid and destroying anything else that benefits the people–they’ve even indicated they want to go after our right to vote. And consider the millions upon millions of people who will be left utterly destitute. They seem to think that our tax money is for the sole purpose of personally enriching themselves and their corporate masters.

    And you don’t hear one word out of the republicans about what they plan to do to create jobs that will get people back to work–nothing. You won’t hear them say one thing about creating anything beneficial for the people–they’re all about destroying everything and are doing so under the guise of “the American people have spoken,” all while they and their corporate masters continue to rob us blind. They are the enemy within.

    What gets me about stupid Americans though (and unfortunately, it’s the majority of the country), while they’re out complaining about ‘big business running their lives’, they’re still shopping at Wal Mart, Target, Costco, and buying from Exxon et al.

    What do you EXPECT if you keep supporting these fuckers? If you must buy at big business, support Trader Joe’s or Whole Foods, at least they’re fighting for the same things you are.

    I can count on one hand the number of times I’ve bought anything from a big corporation in the last year. In Thailand, much of what we still have is independent sellers and I wouldn’t set foot in McDonalds, Starbucks, KFC and all the other crap American junk food pushers we have if you paid me a million. I buy most of the stuff I use at a local weekend market (15,000 independent sellers who sell everything) and even my supermarket is a local family concern.

    Stop buying from these assholes or you’ve only yourselves to blame. I just don’t get Americans :(

Believe it or not, even the most politically progressive of American workers pay taxes. I’m one of them. Difference is, we don’t bitch and moan about it like you and your ilk. Why?     That the Supreme Court has already ruled that corporations are people, trumps any reason to have a study of the obvious. Governance has already been purchased by plutocrats and their corporations. That’s why politicians don’t give a shit about the will of their constituents anymore.

    well since this court ruled that corporation could take your property if they wanted it and, that they could contribute as much money as they wanted to election campaigns without revealing it,
    this study just ends up stating the obvious. since the american chamber of congress can lobby to it’s heart’s content (including against the health benefits for the first responders) we have become The Unitied States of America Incorporated.

    In 1887 the SC ruled that corporations were not people. A bought off clerk wrote an interpretation of the courts ruling that corporations were people and that interpretation has been used ever since to give personhood to an inanimate invention called a corporation. Since that day we as Americans have lost our soul to corporate rule. Since when has it become patriotic to do the bidding of corporations? This one thing has to change before any of us can get our democracy back.

    At least, this is my approach. It may not work for everyone, but from what I can figure, these are the best actions I can take to deprive the machine of the resources I would normally blindly supply. I quit my job in 13 days.

    If TONA (the original 13th amendment, ratified into law on March 12, 1819, by the State of Virginia) hadn’t been made to disappear (see amendment-13.org), we wouldn’t be having a lot of these problems. Although it is still the Law of the Land and has never been repealed, very few know about it. Now, it’s a corporate world for sure; or, as Rutherford B. Hayes, our 19th President, said, “A government of the people, by the people and for the people no longer. A government of the corporations, by the corporations and for the corporations.” Even by the 1880′s, the banks and their attendant corporations had taken over.
    Perhaps bringing TONA “back” would stop this. If enough presure is brought to bear, then it could possibly be ressurrected.
