UK court bans man from having sex because of low IQ

What does a “vigorous sex drive” and a low IQ get you?

In Britain, the answer seems to be a court order preventing you from having sex.

In a ruling that was attacked by some as homophobic and insensitive to disabled peoples’ rights, a British court ordered last week that a man with a low IQ be banned from having sex.

The man, a 41-year-old identified in public only as “Alan,” was involved in a relationship with another man. Social aid officials from his local town hall had argued in court that Alan’s “vigorous sex drive” combined with his “moderate” learning disability made him incapable of consenting to sex, the Telegraph reported.

They argued that, even though he is capable of understanding the mechanics of sex, he is not capable of understanding the health risks involved. Officials also reportedly argued Alan should be kept away from sex education because it could “confuse” him.

In ordering the sex ban, the judge noted that the case is “legally, intellectually and morally” complicated because sex is “one of the most basic human functions.”

Alan’s order came from the Court of Protection, a body PinkNews described as “a secret court dating from medieval times” that holds trials in secret.

According to the Telegraph, the court was given new life by a 2005 law that authorizes government officials to make personal decisions for people deemed not mentally competent.

Under the Mental Capacity Act 2005, its judges have the power to make life or death decisions for people deemed to lack the intelligence to make them for themselves – such as ordering that they undergo surgery, have forced abortions, have life-support switched off or be forced to use contraception.

Alan reportedly came to the attention of authorities in 2008 when it was alleged he made “lewd gestures” at children at a dentist’s office and on a bus. No police action was taken, but a year later the local town council began proceedings to stop Alan from having sexual relations with his male partner.

The judge’s order requires “close supervision” of Alan to make sure he isn’t engaging in sexual relations. Officials told the Telegraph Alan was being closely monitored at home, except when alone in his bedroom.

“This may not be outright homophobia, but I think a general distaste for gay sex underpins the council’s attitudes,” a retired lawyer and blogger told PinkNews. “The court debates issues of informed consent, wondering if any partner might be accused of raping him. Would this issue even have been raised if they were discussing a heterosexual relationship?”

    Ah as all ways people have to see things in black and white. The Court is evil and out get everyone. Diminished mental capacities are acknowledged as leaving a person without the ability to consent to sex. If a person is slipped a drug that leaves them with diminished mental capacities or even having too much alcohol it is considered rape. Because the person lacks the established mental ability to consent.

    Using those standards the court must decide if this man has the mental capacity to consent to sex. Not knowing the state of his disability who is to say if he’s even able to function without constant aid. We can all agree having sex with someone who is in a “vegetable” state is rape. Now at what point do you believe someone gains the ability to consent to sex.

    Sorry not knowing the details of the case or the severity of this man’s retardation it’s entirely unfair to attack the court from the safety of your computer with no knowledge of this case than a few lines.

    This man was deemed by the courts to be of diminished mental capacity that left him unable to consent to sex. The same as if you drug someone or ply them with alcohol till they are entirely wasted courts recognize that the Consent to have sex requires a certain level of mental ability. If this man lacked that mental ability to consent to sex under the law he is being raped. The Courts have an obligation to protect people it sees as not being able to take care of themselves.

    Of course I know the Bill of Rights is part of our Constitution. Had it not been included centralized government would have been the norm from the beginning. Because of the Bill of Rights, the 2%ers have had to fight hard for centralized control using deception and manipulation to convince the people we are a democracy, not a democratic republic. Having established that falsity in the minds of the people, all that was left to do was to manufacture opinions by using brainwashing techniques employed in advertising.

    Now, as long as the left/right opposition is maintained by the MSM and the two major faces of the one political party, all that is needed for the subjugation of the US Constitution is a majority opinion, carefully cultivated and counter to the interests of a free people.

    You are mistaken – gay men contribute to the gene pool in ways other than traditional heterosexual reproduction methods. I personally know gay men couples who have donated their sperm to gay women couples who then impregnate themselves using a turkey baster, resulting in two separate families of two parents each who rear the same offspring .

    As for the balance of your post: This man is certainly capable of deciding for himself if he wants to engage in sex or not, the problem arises when he does not understand certain implications of the sex act such as potential for pregnancy and spread of disease. The least restrictive control would be to prevent his engagement in sexual activity only if he refuses to use a condom or other adequate method of birth and disease control.

    And by the way, there is no comparison between having a low IQ and being in a drug-induced or otherwise caused coma. Your suggestion in other posts that these two states are equivalent is false.

    There are laws which prevent people in the US from having sex with certain other people of diminished capacity. Statutory rape is not limited to those too young to give meaningful consent. Too low an IQ, insane, drugged or inebriated, or those who have dementia are all barred from engaging in sex legally.

    By chance I got to know a couple who lived a couple of blocks from my home in Columbia MO. Previously they had been in a program for for people with physical and psychological disabilities. One of the rules was that patients could not engage in sex or get married. So when the program director found out that they had married they were discharged from the program and lost both their residence and medical treatment.

    Rather than helping these people find housing and alternate treatment they were simply shown the door because of an arbitrary rule. It didn’t matter if they loved and cared for one another, they had no right to do so. What is particularly onerous is that whether it is a court of law, a bureaucracy, or even a “charitable” organization there remains a hubris in which “we” know what is best for those who find themselves dependent. Never mind the very human need for love and compassion regardless of our idiosyncraticity.

My sympathies lie with neither party and my own interests are promoted by neither. Both parties have some claims on my values but both are enough opposed to certain other values I hold, that I can support neither party except partially.

    You can’t make blanket statements like the one you made and be factual, nor do you have such superior intelligence to gay people who vote Republican, to make the second part of your comment anything other than insulting and deprecating of gays’ rights to think for themselves and act in what THEY determine is their best interest. If you call such statements evidence of a liberal perspective, you have minimal understanding of the meaning of the term. Liberals don’t go around deciding for others what they should think and do. We all know you’ll never get profit-mongers to give a shit about anything but profits, and they will fight tooth and nail to block ANYTHING that will cost them even 1 penny.

    It’s funny to me how people twist “cost of living” into “tax” when they just don’t want to do something. The right-wing has successfully morphed virtually every discussion of “money” into “taxation” so they can rile the anti-tax crowed. And it works on the vast sea of simple minds in this country.

    Without more info, I don’t believe this is necessarily homophobic, and I advocate for LGBT equality. Anyone who has the emotional and rational capacity of a child must be protected as a child by a compassionate society. However, this is the wrong way of going about it. If a child does something sexual you don’t put them in jail. If it’s with an adult, the adult gets charged with rape since the child did not have the capacity to say no. This is no different.

    While I agree with the arguments for freedom and love, would you argue for children being allowed to do the same? There’s a reason we have an age of consent; the same principles should be applied. Problem is, in the case of people that are developmentally challenged, they still have all the biological drives, ranging from pheromone response to arousal, that adults have. It is our job as a society to keep them safe. Either in a structured environment or by surrounding them with a plethora of protective laws and services. Sadly our society often chooses neither.

    I think everyone would agree that having sex with someone who is in a coma would constitute rape. Having sex with a child is statutory rape. Having sex with someone who is severely mentally retarded and has the mind of a 2 year old is also rape. At some point people gain the intelligence and judgement in order to consent to sex. The judge has ruled that this person does not posses the faculties for informed consent. It may be judicial overreach aka “nanny state” but it also may be perfectly justified.

    “Moderate learning disability” does not sound like he is incapable of making decisions.

    Why do you think it “may be perfectly justified” for a judge to make a medical decision about the mental status of an individual? Is this not the job of doctors?

    Someone who the Court has recognized doesn’t possess the mental ability to consent to sex by the Law cannot consent to sex. If the court has deemed this man due to his dysfunction lacks the ability to fully understand and consent to sex it’s the same as a person being in a drug induced state that impairs their ability to consent to sex.

    The mental capacity of the victim is all that is important. The reason for that mental incapacitation is unimportant the only difference is this man is permanently mentally incapacitated. And the court is attempting to protect him not punish him or target him because of his orientation.
