74 members of Congress file letter questioning impartiality of Justice Thomas

Seventy-four Members of Congress have signed a letter calling for Supreme Court Justice Clarence Thomas to recuse himself from cases involving the Patient Protection and Affordable Care Act because of his family’s financial ties to groups dedicated to lobbying against it.

“The appearance of a conflict of interest merits recusal under federal law,” the letter, written by Rep. Anthony Weiner (D-NY), said. “From what we have already seen, the line between your impartiality and you and your wife’s financial stake in the overturn of healthcare reform is blurred.”

Thomas faced questions this week about his judicial impartiality after his wife, Virginia, launched the lobby group Liberty Consulting.

Critics say Virginia Thomas’ activities at Liberty Consulting could easily create a conflict of interest for her husband whenever he rules on a case affecting one of his wife’s clients. And they argue Virginia Thomas’ political involvement is yet another sign of the “politicization” of the nation’s highest court.

“Your spouse is advertising herself as a lobbyist who has ‘experience and connections’ and appeals to clients who want a particular decision – they want to overturn health care reform,” the letter continued. “Moreover, your failure to disclose Ginny Thomas’s receipt of $686,589 from the Heritage Foundation, a prominent opponent of healthcare reform, between 2003 and 2007 has raised great concern.”

According to the government watchdog group Common Cause, Justice Thomas failed to report income that his wife earned from her work at two conservative think tanks, the Heritage Foundation and Liberty Central. The Ethics in Government Act of 1978 requires Supreme Court justices to disclose their spouse’s income.

“It’s shocking that you would have a Supreme Court justice sitting on a case that might implicate in a very fundamental way the interests of someone who might have contributed to his wife’s organization,” Deborah L. Rhode, a law professor at the Stanford University Center on the Legal Profession, told the New York Times in October 2010.

“Given these facts, there is a strong conflict between the Thomas household’s financial gain through your spouse’s activities and your role as an Associate Justice of the United States Supreme Court,” the letter added. “We urge you to recuse yourself from this case. If the US Supreme Court’s decision is to be viewed as legitimate by the American people, this is the only correct path.”

As Members of Congress, we were surprised by recent revelations of your financial ties to leading organizations dedicated to lobbying against the Patient Protection and Affordable Care Act. We write today to respectfully ask that you maintain the integrity of this court and recuse yourself from any deliberations on the constitutionality of this act.

The appearance of a conflict of interest merits recusal under federal law. From what we have already seen, the line between your impartiality and you and your wife’s financial stake in the overturn of healthcare reform is blurred. Your spouse is advertising herself as a lobbyist who has “experience and connections” and appeals to clients who want a particular decision – they want to overturn health care reform. Moreover, your failure to disclose Ginny Thomas’s receipt of $686,589 from the Heritage Foundation, a prominent opponent of healthcare reform, between 2003 and 2007 has raised great concern.

This is not the first case where your impartiality was in question. As Common Cause points out, you “participated in secretive political strategy sessions, perhaps while the case was pending, with corporate leaders whose political aims were advanced by the [5-4] decision” on the Citizens United case. Your spouse also received an undisclosed salary paid for by undisclosed donors as CEO of Liberty Central, a 501(c)(4) organization that stood to benefit from the decision and played an active role in the 2010 elections.

Given these facts, there is a strong conflict between the Thomas household’s financial gain through your spouse’s activities and your role as an Associate Justice of the United States Supreme Court. We urge you to recuse yourself from this case. If the US Supreme Court’s decision is to be viewed as legitimate by the American people, this is the only correct path.

We appreciate your thoughtful consideration of this request.

    How this clown ever became a justice is beyond me. As to lawmakers demanding he recuse himself… fat chance. We have very few ‘lawmakers’ from either party, but we do have corporate hacks galore on both sides. After the GOBP take the Senate in 2012 (not a certainty but very very likely) and Obama is replaced (I hope the spineless DINO stays, only because it could be much much worse)… we are going to march back in time at a rapid pace, both morally and economically.

    I would like to know when the DOJ will launch the investigation of Thomas for 20 years of false financial disclosures. If I, as a common citizen were to file a similar disclosure for 1 year I would be facing Federal prosecution under similar circumstances. For Christ sake this A$$HOLE sits on the Supreme Court and has filed these things forever.

    Common Cause has asked for an investigation. I also wrote to CREW last night and asked that they start requesting the same.

    Recuse himself? Are you kidding? He should be impeached along with scalia. There should be term limits on the supreme Court if they are going to be politically influenced and active.     In my opinion, President Obama’s lack of interest in holding the Bush administration accountable for anything, has resulted in the following Conservative position:

    Make no mistake, that is just what they are doing. And why shouldn’t they? They successfully punked our President time and time again.

    They’re not about to stop now. The only one who CAN stop them is Obama. I pray he has the courage to do so.

    Obviously, he can’t wave a magic wand, but he CAN throw a little support to his base, he CAN at least recognize Liberals, he CAN stand up to the GOP instead instead of caving on every issue. So far, I’m convinced he’s a great speaker. But not much else.

    Between 2003 and 2007, Virginia Thomas, a longtime conservative activist, earned $686,589 from the Heritage Foundation, according to a Common Cause review of the foundation’s IRS records. Thomas failed to note the income in his Supreme Court financial disclosure forms for those years, instead checking a box labeled “none” where “spousal noninvestment income” would be disclosed. [...]

    Virginia Thomas also has been active in the group Liberty Central, an organization she founded to restore the “founding principles” of limited government and individual liberty.

    In his 2009 disclosure, Justice Thomas also reported spousal income as “none.” Common Cause contends that Liberty Central paid Virginia Thomas an unknown salary that year.

The man is a part of a government agency that has the motto: “Equal Justice Under Law” emblazoned on the west facade of the building and “Justice, the Guardian of Liberty” on the east facade. I am 100% behind impeaching him and subjecting him to the full extent of “Equal Justice”…the Law against hiding $1MILLION in income on his tax returns over a 20+ year period,. The man is a crook….a tax cheat…and law enforcement has used ‘tax evasion’ many, many times in the past to put away such criminals. Why not him? Is he ‘untouchable’? Not in MY book.     In my opinion the Supreme Court sold its soul and the American people on April 25, 1938 overturning the standing precedents of the prior 150 years concerning “COMMON LAW” in the federal government.

    “THERE IS NO FEDERAL COMMON LAW, AND CONGRESS HAS NO POWER TO DECLARE SUBSTANTIVE RULES OF COMMON LAW applicable IN A STATE, WHETHER they be LOCAL or GENERAL in their nature, be they COMMERCIAL LAW or a part of LAW OF TORTS.” (See: ERIE RAILROAD CO. vs. THOMPKINS, 304 U.S. 64, 82 L. Ed. 1188)

    The Common Law is the fountain source of Substantive and Remedial Rights, if not our very Liberties.
    The members and associates of the Bar thereafter formed committees, granted themselves special privileges, immunities and franchises, and held meetings concerning the Judicial procedures, and further, to amend laws “to conform to a trend of judicial decisions or to accomplish similar objectives”, including hodgepodging the jurisdictions of Law and Equity together, which is known today as “One Form of Action.” [See: Constitution and By Laws, Article 3, Section 3.3(c), 1990-91 Reference Book, see also Colorado Methods of Practice, West Publishing, Vol. 4, pages 2-3, Authors Comments.]

    Why would the Supreme Court overturn 150 years of precedent case law?
    Why did the Supreme Court replace 150 years of “Common Law” with “Commercial Law”?

    Just a nitpick…he didn’t hide the income from the IRS, he hid it from the Judicial Oversight Committeee (or whatever it’s called) by answering “No”to a question whether his spouse had any earned income. That form was designed to provide information that could lead to a recusal request on conflict-of-interest basis.

    I’d be shocked if any of this could be made to stick. Thomas is insulated by staggering amounts of cash…he may be a disgrace to the bench…and everyone knows it…but why should he care when he’s untouchable and plugged into a community of corruption that will back their investment by guarding him at any cost? In an era distinguished by partisanship in the judiciary, he stands like a breed apart…the single most incompetent, undeserving, amoral and unethical creature ever to have been shat into the public arena. Serving him his walking papers and throwing him out would send a chilling message that other judges need to hear…urgently.

That being said, Thomas is such a disgrace that words and labels can’t describe him, however, BIDEN should resign from politics for delivering Thomas to the bench since he’s the one who chaired the committee that allowed Clarence to join the club in the first place. BIDEN had ample opportunity to bring a plentiful cast of witnesses into the confirmation hearings where the entire world would have discovered what a low-life, egotistical, sexual harrassing, uncle T (my “labels” could be much worse here), which would have overwhelmingly bludgeoned Thomas to the point where he would have never wanted to show his face in public ever again, yet, I believe, BIDEN was “black”mailed and succumbed to pressure from the right, like most Democrats, and now our Republic is forever changed by the one we call Clarence sitting on the Nations highest Federal Bench.

Scalia needs to go, and then Congress could look into Alito and Roberts – the architects of the decision that handed our elections over to Corporate America. Without a fair and impartial Supreme Court who exactly are the people to trust to settle our differences? To adjudicate complicated decisions that affect the very foundation of our life and liberty? We need a real Supreme Court, not one that has been bought and paid for by those who are attempting to exert their dominance over the entire population.

    Imagine if ten thousand judges from around the country, five thousand law professors from the leading law schools, thousands of d.a.’s and state attorneys general wrote this same kind of letter to Clarence, and became signatories to a public copy? What a message it would send. American justice is not for sale to any one.

    Most of the time the courts decisions can be predicted based on the history of and knowing their biases. This is proof that the high court’s very existence today is antithetical to the original purpose of the court. Thomas’s decisions can be predicted with uncanny accuracy.
    They don’t rule according to the Constitution, they rule according to their partisan precepts and then use debating tactics to rationalize it to the Constitution. It’s an exercise in idiocracy.

    Thomas is the most blatant example of partisan rulings as well as gross incompetence.

    Why hasn’t Issa begun an investigation into Thomas? After all he broke the law. I agree with one of the comments below, that the corporations, the Koch brothers, and the republicans will defend him tooth and wallet. Impeachment is the word we should be hearing from congress.

    As was said at the time, Thomas wasn’t the most qualified African-American for the seat, he wasn’t even the most qualified conservative African-American for the seat. But then remember, Bush apparently though that Dan Quayle was qualified to be President, as well. That says all you need to know about his judgment.

Democrats controlled both the House and the Senate in 1991 when Thomas was confirmed and had every opportunity to NOT vote him onto the bench. I’m in total AGREEMENT that Thomas is a king sized JOKE, but the longer we lie about who was or wasn’t responsible for this type of ill fated political decision… the longer it’s going to take for us to GROW UP and get this stuff right. Take some responsibility, I don’t care what your political leanings are, just be honest. If your team makes a mistake, admit it and correct the errors. You’ll be better for it.
