Obama seeks longer PATRIOT Act extension than Republicans

Faced with a looming vote on a planned one-year extension of special powers authorized in the USA PATRIOT Act, the Obama White House did not object or propose reforms, as the president vowed to do as a candidate.

The Obama administration instead asked Congress to grant those powers for an additional three years.

As a US Senator and candidate for the presidency, Barack Obama never actually argued for a repeal of the Bush administration’s security initiatives. Instead, he’s consistently argued for enhanced judicial oversight and a pullback on the most extreme elements of the bill, such as the use of National Security Letters to search people’s personal records without a court-issued warrant.

While many in his own party opposed the PATRIOT Act outright, as president Obama has said repeatedly that the emergency measures remain a valuable tool for law enforcement engaged in national security prerogatives.

On Tuesday, ahead of a House vote to reauthorize the PATRIOT Act for another year, the White House did something unexpected: they asked for even more.

A prepared statement issued Tuesday afternoon said that President Obama “would strongly prefer enactment of reauthorizing legislation that would extend these authorities until December 2013.”

The move was likely aimed at avoiding the potential conflation of national security legislation and an election year’s hyper-partisan atmosphere.

The House voted last night 277 to 148 in favor of the single-year PATRIOT Act extension, falling 23 votes short of the two-thirds majority needed to pass it. Some two dozen tea party-backed Republican freshmen ended up joining with a majority of Democrats in voting against it.

The power-shift caught Republican leadership off guard. Even after keeping the 15-minute vote open far longer than the rules permitted, they did not have a two-thirds majority.

Some suggested that the House’s most liberal member, Rep. Dennis Kucinich (D-OH), might have played a role in the sudden spurt of rebellion. He issued a challenge on Tuesday aimed at Tea Party Caucus members in the House, urging them to join him in standing up for civil liberties by resisting the PATRIOT Act’s extension.

“I am hopeful that members of the Tea Party who came to Congress to defend the Constitution will join me in challenging the reauthorization,” he wrote.

While the brief alliance might not be enough to stave off the extension, as the PATRIOT Act was expected to return after its unexpected defeat, it could be the first inklings of a political common ground between libertarian-leaning tea party Republicans and progressive Democrats, especially since both groups are largely seen as disillusioned with the two-party system and partisan gridlock.

The only significant proposal to reform the PATRIOT Act came from Senate Judiciary Committee Chairman Patrick Leahy (D-VT), who proposed last month that Congress add greater judicial oversight to the bill. Leahy’s bill would have also extended the PATRIOT Act’s powers until 2013, shifting the extension away from 2012′s election season.

When the act was first signed into law, “sunset” provisions were employed to quiet the concerns of civil libertarians, who were largely ignored once Congress set about on their successive extensions of the emergency powers.

Unfortunately, the concerns of civil libertarians proved to be well founded, and a 2008 Justice Department report confirmed that the FBI regularly abused their ability to obtain personal records of Americans without a warrant.

The only real sign of strong opposition to the act was in 2005, when a Democratic threat to filibuster its first renewal was overcome by Senate Republicans.

    I have a problem with the use of the word EMERGENCY.

    At the risk of sounding extreme, we have been with the civil liberty-killing Patriot Act for almost 10 years and seeing that Egypt’s tyrannical government has just expired (as a concession to the protests) their own 30 year-old state of emergency, isn’t this a similar path?

    Obama may be not a dictator but the powers at his disposal, seem are one’s that he doesn’t want to relinquish. Doesn’t sound very Democratic to me. First he brings his knee-pads to the Chamber of Commerce and now this?

    It is interesting that today the Pakistani protesters are saying the United States is the source of all terrorism. Are they right? If you remember that mythical boogieman Bin Ladin, he was CIA trained, and a close friend to the Bush family. Where is the investigation of that?

    Think about how shocking it was back in 2007 when virtually unknown junior Sen. and Presidential hopeful MuBarack Obama publicly showed his hand for the first time when he flipped from noisily claiming that he would not only oppose the FISA amendment and telco immunity to voting for it intact. And here we are 3 1/2 years later.
    I have to wonder if Stephen C. Webster thinks Obama’s FISA flip flop was because the big, mean Republicans made him do it too. Personally, I accept no such excuses.

    America is under emergency rule today and has been for 9 years. Obama renewed it in Sept. 10, 2009.

Relyea, a specialist in national government with the Congressional Research Service (CRS) of the Library of Congress, has written, “when the President formally declares a national emergency, he may seize property, organize and control the means of production, seize commodities, assign military forces abroad, institute martial law, seize and control all transportation and communication, regulate the operation of private enterprise, restrict travel, and, in a variety of ways, control the lives of United States citizens.”

    Yet, while Dr. Relyea opines that Congress and the judiciary, as well as public opinion, “can restrain the executive regarding emergency powers,” nothing of the sort has occurred.

    Again, at the risk of being redundant, failure to investigate the obvious inconsistencies, regarding 911, and many other events since then, both here and in other countries, allows the future possibility of faked events (“exercises” if they get caught) as a tactic on the part of certain insiders to pass bogus legislation violating important rights.

    One recent, glaring example, as many already know, Anwar Al-Awlaki, the man charged with masterminding terror attempts/attacks such as the Fort Hood Shooting, The Christmas Day Bomber, and The Times Square Fizzler was also a lunch guest of military brass at the Pentagon within months of the Sept. 11, 2001, terror attacks, Fox News has learned.

    When are people going to learn?

    1. Do they take money from large corporations, especially banks

    2. Does MSM treat them with respect before and during a campaign

    3. Does the political party they are a part of consider them a part of the crew or an outsider

    4. Are they talking about continuing the wars or “supporting Israel”

    If they do any of these things AVOID THEM.

    Here is what you should be looking for.

    1. Ending the Current monetary system

    2. Bringing the troops home

    3. Cutting foreign aide to dictators

    4. Ending the 1984 style police state

    5. Buying local, North America first, Canada and US, not Mexico because of lack of Living standards (unless that changes)

    6. Ending fake free trade

    7. Ending aggressive foreign policy.

    Its real easy.

    I have a dream….No PATRIOT act renewal. Dismantle DHS and tell the truth about what happened on 9/11. Bring the troops home from Iraq, Afghanistan, and for God’s sake Europe. Prosecute the Bush/Cheney admin for their war crimes.     The Patriot Act is an issue of “Big dirt/Little dirt.” Politicians, bankers, Pentagon, and all those types, torturers, human traffickers, money launderers, drug runners, etc. have the “Big Dirt” and they are the ones sitting on the top of the pile. All of us have a “little dirt,” a stolen candy bar, an odd comment, an expression of negative emotion caught in a recording, etc. The “Big Dirt” needs to have the dirt on the “Little Dirt” to stay in power and to keep from being held accountable. Wouldn’t one say this is the essence of the Wikileaks issue? We all generate “little dirt” in our daily lives and can’t help but doing so given the nature of the “Beast.” We can certainly limit our dirt piles to a small size, but we can’t get out from under the Big Dirt.

Total BS….he should do what he promised and he should do it NOW….this 3 year renew is just to so it will not come up during 2012 elections – because he knows if they do it now he can BS his way out of WHY…and people will forget by the elections – if it comes up for renewal next year it will be in peoples faces and they will REMEMBER that he was for the Police State we are not becomeing.

    Allow five days of public comment before signing bills
    Tougher rules against revolving door for lobbyists and former officials
    Urge states to treat same-sex couples with full equality in their family and adoption laws
    Allow bankruptcy judges to modify terms of a home mortgage
    Re-establish the National Aeronautics and Space Council
    Support human mission to moon by 2020
    Reduce earmarks to 1994 levels (probably not possibly anyway – give him a pass on this one
    Allow penalty-free hardship withdrawals from retirement accounts in 2008 and 2009
    No family making less than $250,000 will see “any form of tax increase.”
    Appoint federal-level coordinator to oversee all federal autism efforts
    Forbid companies in bankruptcy from giving executives bonuses
    Reinstate special envoy for the Americas
    Reinstate special envoy for the Americas
    Form international group to help Iraq refugees
    Limit term of director of national intelligence
    Create a National Commission on People with Disabilities, Employment, and Social Security
    Require plug-in fleet at the White House

    And of those he kept – most were so minimal or thinned out by “compromise” they are meaningless (yes finance reform).

    I voted for Obama and am really disappointed in him. He and the Democrats gave the republicans a basically republican health care bill. He leans to far right. He gave them an extension of the bush tax cuts even though he knows they are bad for the country. He has passed some good bills but it isn’t enough for me to overcome the feeling he is trying too hard to make nice with the repubs and not enough to make nice with the people who put him in office. The repubs will only work with him if he does what they want. Now the next big test is Social Security. I think he will make a deal with the repubs on this and start to dismantle Social Security. That will officially make him the first black republican president. I didn’t look for reagan or bush to keep their campaign promises because I knew they would do very little to please me and I was right! We are still paying for reagan and bush’s mistakes and will for generations. I expected more from Obama. The republicans have managed to make him seem very weak. Almost like he is intimidated by them.

    It was on All Things Considered last night, an NPR program, which is also available online. It was in interviews with Pakistanis who were rioting about the embassy staffer who gunned down men in the street there. It is of course purely somebody’s opinion to my knowledge, but plausible. The US was refusing to tell Pakistan what the man’s function was at the embassy, which is required in Pakistan to have immunity.

    I just had a thought. If Obama were the Manchurian candidate, he would be a Republican clothed as a Democrat, but he would still be subject to the questioning of his loyalty in that too long a time was spent among the “enemy,” thereby tainting him.

The only people standing against this ignorance and continuing enlargement of the national security state are Democrats and 24 tea-party Republicans. And who made these teaparty Republicans finally put up or shut up–Dennis Kucinich–a guy who has received more grief than nearly any other Democrat in Congress and a member who has traditionally had very little power.

    The post above is just plain idiotic and stupid. There are a lot of reasons why I am dissatisfied with Obama that have nothing to do with the kind of ignorance displayed in that post. They have to do with sellouts to big pharma and an unwillingness to end the war in Afghanistan; an willingness to stand with the people of Egypt; an unwillingness to close Guantanimo; an unwillingness to use the power of the presidency to promote the agenda that he ran on; an unwillingness to give up right wing ideology on tax policy as an incentive for job creation; and an unwillingness to use the presidency to govern as a Democrat.

    He is turning out to be a bigger disappointment than Clinton. And has been subjected to the same kinds of idiotic condemnations from the right. But instead of condemning Clinton for his policy positions which were bad enough, people, except for Joe Lieberman, this kind of condemnation came mostly from the right, got hung up on the idea that he had sex in the oval office or that he lied about extramarital sex. Those complaints were as ignorant as the time wasted on the impeachment and only created a martyr and raised Clinton’s approval into the stratosphere.

    People who make these kinds of comments are doing the same thing for Obama, who is much further right, I think than even Clinton was. Obama has been perhaps the biggest disappointment of my lifetime. I’m embarrassed to say it now but I cried when I voted for this guy and he’s taking away the heat subsidy from the poor and aged for chrissakes, what kind of a Democrat would do such a thing?

    And yet people like you want to claim he is a foreigner–stupid, stupid, stupid! He’s a damn Republican.
