Georgia anti-abortion bill would require investigations of miscarriages

Legislation recently introduced to the Georgia legislature by House Republican Bobby Franklin would make abortion the legal equivalent of murder and require miscarriages to be investigated by authorities.

The bill, known as HB 1, was uncovered by the progressive blog The Daily Kos.

Franklin’s bill would classify the removal of a fetus from a woman for any reason other than to produce a live birth or to remove a dead fetus as “prenatal murder.” Physicians indicted for alleged “prenatal murder” would have their license suspended until they were found innocent of the crime.

Although the legislation would not place any criminal penalties on natural spontaneous abortions, it would require miscarriages to be reported by hospitals and other medical institutions, and a fetal death certificate issued.

Authorities would be required to investigate the cause of fetal death in cases where a miscarriage occurs without attendance at a medical facility.

“The State of Georgia has the duty to protect all innocent life from the moment of conception until natural death,” the bill stated. “We know that life begins at conception. After nearly four decades of legal human prenatal murder, it is now abundantly clear that the practice has negatively impacted the people of this state in many ways, including economic, health, physical, psychological, emotional, and medical well-being.”

State Rep. Franklin also recently introduced a bill mandating that victims of rape, stalking, harassment, and family violence be re-classified as “accusers.”

If passed, the legislation (.pdf) would amend state criminal law “in the context of a number of statutes making reference to circumstances where there has not yet been a criminal conviction; to provide for related matters; to repeal conflicting laws; and for other purposes.”

Critics said that they feared Franklin’s bill would decrease reports of rape, which is itself already an underreported crime (.pdf), according to the California Coalition Against Sexual Assault.

The Facebook page for State Rep. Franklin was teeming with angry comments about the two pieces of legislation on Tuesday.

“Have you had the nightmare of experiencing rape or miscarriage?” one woman asked. “It must be nice to think you have the right to define and legislate things you have no clue about.”

    You know there always some crazy bills introduced by the whackos, usually in state legislatures (virus now having spread to federal level). We need to keep track of those things but maybe we should wait until they at least have a hearing or get passed at the committee level before we make a big deal of it.
    Reacting to the individual psycho in a random way doesn’t really inform us of much. Maybe a quarterly or semi-annual listing of them might help us see if there is a real pattern to be concerned about.

    You’ve got to be kidding… I live in Georgia and I shouldn’t be shocked – but I am. It’s hard to imagine what these “God Fearing” conservatives (Sic) will come up with next. This bill has absolutely no chance of passing, and if it did, it would likely be ruled unconstitutional by SCOTUS. (My Bad… Forgot about the Fascist Five at SCOTUS. Never mind – I was speaking about the rule of law, which has since been declared dead and stinking by SCOTUS in the Citizen’s United Case.)

He recently introduced a bill mandating that victims of rape, stalking, harassment and family violence be re-classified as “accusers.” He hates gays and says America should become a Christian nation, and Islamic terrorism is not the greatest threat to America. God is the biggest threat. Oh, I forgot to mention he is a church going Christian who has a wife and three children.

    He believes that civil government should return to its biblical and constitutionally “defined role.” I say he should return to the mental institution that he escaped from with the help of his legislative cohorts. His appointment with an psychiatrist and a couch is long over due.

    This piece of walking insanity was voted into office in 1996. Along the way he sough to abolish the Georgia Health and Human Services Department. The said public schools are a sinking ship and all children should be home schooled or sent to private schools. He doesn’t believe drive should be required to have drivers licenses because they represent oppressive times. And just think, this Alice in Wonderland dweller does not feel that a woman has a right to make a decision about what to do about an unwanted pregnancy.

    I wonder at what point a woman would have to register her pregnancy. Would she have to carry a card to prove that she has registered. Would this need to be carried when she is “showing”? Would all women who have not been certified as being post menapausal have to have maditory pregnancy tests? Would all women have to have on their person a certificate and card showing that she had been tested monthly and the results of that test? Would all women have to register that she did menstrate on or near the expected date of her cycle. Would the tests be paid for by the woman or would the state do the testing? Would there be a mobile unit that would go to the address on file for each woman in the state so that the woman could be tested and the results turned in to the states woman data base? I love it when the government stays out of peoples lives.

    How do they plan to uphold that kind of law without taking away the individual liberties of the woman? Just a few (of the millions of questions) a bill like this raises are:

    1. Do all pregnancies have to… register with the state?

    2. If we’re investigating all miscarriages, how is that funded and who is the person sitting in judgement?

    3. Do we lock up women who may have accidentally or unintentionally done something to cause harm to their fetus (let’s say a health issue like gestational diabetes, if women are caught eating sugar during that time in a pregnancy will they be charged for harm to the fetus?)

    4. Many women don’t have health care & many insurance companies consider pregnancy a pre-existing condition. If harm comes to these fetuses during pregnancy because the woman doesn’t have health care is the woman to blame? Or does the state plan to make all women see state hired doctors during their pregnancies?

    It’s all very messy and not small government AT ALL!

    Since life ‘begins at conception’, why is it that an embryo (a clump of less than 100cells, I believe) is NOT viable, and a fetus is not viable (i.e. cannot live on its own outside the womb of a woman) before 22 weeks of gestation?

    Also, why does it only concern these extreme Christian Taliban when the life form is INSIDE a woman’s womb – but once it is viable and outside the womb, it is OK to kill it via sending soldiers into war to kill other people, and also by killing doctors who perform abortions, or by not providing life-saving health care???

    His hostility towards women is no joke. This guy seems like a witch-hunter looking for a victim. Yeah, he does sort of have that serial killer look – they are usually dweeby white males.

    Perhaps it is best to attack him on the grounds that he wants the State, that awful Leviathan, to interfere in a woman’s bathroom activities, for which there is no justification. Most miscarriages (25% of all pregnancies) happen without warning and without serious health consequences, so that when you call the doctor, they don’t care if you come in now or next week – just as long as it settles down and you’re not in continuous pain. They’re used to it. It is nature’s way of stopping something that isn’t working right, brutal as that sounds. Would he second-guess nature? Or an Act of God?

    Of course an actual child, stillborn, needs to be looked into. That isn’t the same as a miscarriage. Obviously, someone would need to be seen by a doctor if that suddenly happened.

    As for stalking, rape, etc. — once again he wants to mess with language and call the woman an “accuser”. Well, until the truth of the matter is settled, that is what she is – a state’s witness against the accused. Along with the plain old American state like in “People of Georgia vs. Accused Rapist.” Innocent until proven guilty – but so is she, unless it is proved in a Separate Action that she lied to get him jailed. He’s asking for the “presumption” to be changed, only there is no presumption except the accused rapist’s presumption of innocence. But he gets tried if there’s enough evidence to go to trial. And the woman is NOT to be intimidated into dropping the matter because she is a Citizen, and she has a Duty to look out for the next victim. She may not be the first, and she may not be the last.

    So this guy just seems like a person who is far from being a conservative. He is saying a lot of ignorant and crazy stuff and he wants his prejudices to have the force of law. He’s an anarchist.

The general population suffers dramatically, the country loses it’s international standing, we turn against OURSELVES because that is the GOAL of conservatives. It’s all destroy, tear down, and rebuild NOTHING. Hell, conservatives don’t even want to conserve what we already HAVE. Look at the great job we’ve done taking care of our infrastructure for the last 30 years. It’s crumbling, and the right is standing in the way of even taking care of fixing THAT.

    You don’t even have to go there. His actions as mayor of Milwaukee, let alone as governor, are enough to have him hauled up on charges of malfeasance and corruption. His actions weren’t brought up before the election, so they weren’t an issue. If they had been, I doubt he would have won. He SHOULD have been locked up as a danger to himself and others. Why we don’t do that to elected officials is beyond me. Regulations are not written until after a bill is passed into law. And, those regulations could very well include everything you have stated. This proposed law is so outrageous that anyone with any real sense would NEVER vote for it. It does not protect the unborn. It does not protect women. It does not protect society. It simply puts in place a whole plethora of extreme possibilities for harassing the innocent and turning the lives of women who have had a miscarriage thru no fault of their own into potential CRIMINALS! It isn’t enough that they are suffering from the loss of their unborn, now the law would punish them for their loss!!!! Unbelieveable.     I just read the bill. Contrary to what Daily Kos and all of you are claiming, there is nothing in the bill that makes miscarriage a crime in any manner. The only thing it does with regards to miscarriages is establish a legal procedure whereby miscarriages result in the generation of a state death certificate. Yes, the bill would also outlaw abortion in Georgia, but this is irrelevant to this discussion. In short Daily Kos lied…wow, what a surprise.

That’s s large part of the reason behind “Christian”: homes for unmarried, pregnant girls. It wouldn’t happen that they would all be forced to adopt five – but it certainly would happen that at least healthy white babies would be snapped up very quickly. They are highly desired.

    You obviously missed mine: these are the last people who should be in charge of children. Handing a child over to any of them would be giving it over to abuse, intellectual and emotional, at the very least. “Love the fetus, hate the child”? The way to end abortion is to make men and women realize that a fetus is alive and it’s human and it’s as much their child as one they will, in the future, “want.” Their “wanting” or “not wanting” cannot change reality. When men and women actually DO take “control of their bodies” and make the “choice” not to create a human life they don’t “want”, then abortion will end.

    Didn’t we all learn in health class that quite often women will have miscarriages before they even know they were pregnant and never really show any signs of it? How would that be regulated? Would us women need to be scanned once per week to make sure we weren’t inadvertently committing murder?

    This is absolutely an invasion of privacy between a doctor and a patient. That is sacrosanct. These so-called men are trying to keep women under foot no matter what it takes. Alot of women have miscarriages before they become pregnant for a live birth. What are they going to do? Stalk us all to see if we’re having our periods or having miscarriages? What a waste of time and tax dollars for GA.

    I’m sorry that it seems as though the impression is floating about that Conservatives do not care about others. perhaps it is the continuing stream of consciousness statements about “Protecting Life” by any means neccessary. including murder of providers of a legal service,combined with cuts to child nutrition, education and health care. As a man thinketh in his heart. so is he. and what the
    Christian Comservatives, as a group, seem to be thinking is frankly terryfying…protect freedom my ass.

    It sounds true, but then they would be supporting the “Nanny State”…I think it is their plan to produce more workers for thier corporate masters to use as Child workes when the succee in reversing child labor laws and reintroduce the Sweat Shops ooof the 19th century.
    For further evidence, look up the term Constitutional Convention an see who just proposed holding one. Once that can is open, they can pretty much repeal any amendment at will, despite what they say.
