A Missouri woman faces possible jail time after a topless picture of herself and one of her teenage daughters was circulated online.

KMOV-TV reported on Monday that the picture, showing the two in a hot tub, was passed around two high schools in the St. Charles area after being posted on the online app Snapchat. The app is designed so that pictures “self-destruct” within 10 seconds after going live, but experts have warned that the feature is relatively easy to circumvent.

“The issue here is the fact the daughter was 14 and the mother was clearly present and involved when the picture was taken,” county prosecutor Tim Lohmar told KMOV, adding that he believed the picture was a posed shot with “sexual overtones.”

The mother, who was not identified in order to protect her daughters, told KMOV that she was not posing, but was actually getting out of the hot tub when her other daughter took the photo.

“I was aware that the photo was taken by my 13-year-old daughter,” the woman said. “I specifically told her at that second, ‘Please delete that photo.’”

The woman has been charged with misdemeanor child endangerment, and could be sentenced to probation or up to a year in jail. Lohmar did not seem to accept her argument that she asked for the picture to be deleted, though, telling KMOV she chose poorly.

“I don’t think she had any intention that this would blow up the way it did,” Lohmar said. “But it did, and she only has her poor judgment to blame for that.”
