An off-duty Florida deputy shot a man after breaking up his late-night tryst in an apartment complex swimming pool.

The deputy, whose name has not been released, went to the pool at Reflections of Boca Del Mar, where he lives, about 12:20 a.m. Saturday.

There he found a man and woman engaging in a sex act, reported the Sun Sentinel, and he told them he was a deputy and asked them to leave.

The couple, who didn’t live at the West Boca apartment complex, reluctantly followed the deputy’s instructions, authorities said.

The deputy sat down in a poolside lounge chair, and the couple returned a short time later.

The man, identified as 49-year-old Tony Ribeiro, “hovered over (the deputy) in a threatening manner” and the two began arguing, said a spokeswoman for the Palm Beach sheriff’s office.

Ribeiro raised what investigators have described as either a wine glass or empty Champagne bottle, and the deputy shot him.

The victim was taken to an area hospital and remains listed in critical condition.

The deputy was placed on administrative leave while the shooting is investigated.
