On Tuesday morning’s Fox & Friends, conservative pundit and former New Jersey Superior Court Judge Andrew Napolitano called for the impeachment of President Barack Obama. Media Matters reported that Napolitano objected to the exchange of prisoners from the U.S. prison at Guantanamo Bay for U.S. Army Sergeant Bowe Bergdahl, a prisoner of war held by the Taliban in Afghanistan.

Fox & Friends co-host Brian Kilmeade said, “Here’s the thing, and I don’t even know if this is a legal question. You’re not exchanging this guy for a bag of cricket balls. You’re exchanging him for four of the worst of the worst.”

“Everybody agrees that they’re more than likely to go back to terror,” Kilmeade said, “and be part of the brain trust of the Taliban.”

“That’s why I say the president may well have committed a federal crime,” said Napolitano, “by giving material assistance to a terrorist organization. He knows — ought to have known — that that’s what these guys will do.”

“The president should be impeached for this,” he said. “In my view, it’s a very, very valid argument that people are going to start talking about.”

Previously, Napolitano and Fox have called for Obama’s impeachment over the war in Libya, the sequester spending cuts of 2012 and 2013, the mistakes in the roll-out of the Affordable Care Act, the president’s executive order on guns following the massacre at Sandy Hook Elementary School in Newtown, CT and a number of other actions.

On Tuesday, Napolitano said that “the last time” a U.S. president was impeached, it was over “nonsense,” which was why President Bill Clinton remained in office. This newest offense by Obama, he contended, is “far, far more serious.”
