Lawsuit: Fort Worth hospital fired employee who reported rape attempt by male nurse
A Texas woman who was fired from her job as a surgery technician after she reported that she had been sexually assaulted by a nurse is suing her former employer, North Hills Hospital, for more than $1 million.
According to her complaint, on October 30, 2012, a nurse named Gregory Henderson sexually assaulted her.
The victim claimed that she and Henderson were working at a nurse’s station adjacent to the surgery area. Henderson “massaged” her shoulders for a few minutes, then motioned for her to accompany him. She did so, thinking he needed help with a job-related function, but instead he pulled her into a unisex bathroom, pulled up her shirt and began kissing her.
As she attempted to fight him off, he “penetrated” her with his finger. She eventually escaped his clutches, and filed a report with both the police and North Hills Hospital the next day.
The victim claimed that Henderson had sexually harassed other female employees, and that North Hills Hospital failed to abide by its own “zero tolerance” sexual harassment policy and fire him. When it refused to fire him again after she reported his assault, the victim requested a transfer to another unit, but the hospital refused.
On April 20, 2013, North Hills Hospital fired the victim, in what the complaint claimed was retaliation for reporting on Henderson.
Jason Smith, one of the victim’s attorneys, told The Star-Telegram that he and his client ” believe the evidence will show that North Hills Hospital failed to protect my client from severe sexual harassment by its employee in violation of Texas law, especially when this employee apparently had done this type of thing before.”
North Hill Hospital spokesman Matt Eiserloh said that he could not speak to the specifics of the case, but that his employer “takes any concern raised by an employee or former employee very seriously, and for this reason, we have a very rigid policy and code of conduct in place to resolve any issues in a timely and accurate manner.”
