Defense attorneys representing one of the Capitol rioters this week claimed that their client wasn't to blame for his actions because he'd been "radicalized" by Fox News.
CNN legal analyst Carrie Cordero on Friday explained to host Brianna Keilar that it was unlikely any jurors would buy into this so-called "Foxitis" defense of MAGA rioter Anthony Antonio.
"This is something that his defense attorney is certainly entitled to argue, but it is not going to be a persuasive defense to the conduct that is being alleged," Cordero explained. "Let's talk about the actual affidavit filed in this case. What it alleges the defendant did on January 6th includes a wide range of charges: Unauthorized entry into the Capitol complex, disorderly conduct, physical violence."
She then detailed how there is apparently evidence that Antonio assaulted a Capitol police officer and stole his riot shield and gas mask, and she said it will be very hard for him to plead that Fox News made him do it.
"What the court... is going to be looking at is the actual conduct and the video evidence and other evidence that exists in the case, not his allegations that he was brainwashed by watching TV," she said.

Right-wing extremists face humiliation as plans for new 'White Lives Matter' rallies start to crumble
Right-wing extremists are planning another series of "White Lives Matter" marches less than a month after their last attempt flopped, and this round seems similarly destined for failure.
White supremacist groups are planning to hold rallies at various unspecified locations Saturday around the U.S., just weeks after their April 11 marches failed to draw more than a handful of participants, and some of the new events have already been canceled before their scheduled start, reported Newsweek.
"This location will not host an official event on the 8th of May," said one post on the encrypted messaging service Telegram. "Activism will happen in each and every location, however, due to the decentralized way of organizing, it is up to you to do the best YOU can for our people in your states/country."
A new "White Lives Matter Official" Telegram channel set up to promote the marches has more than 3,700 subscribers, with dozens of individual channels for various locations, but most of those discussions have not revealed any specific details about the locations of the rallies.
Two locations in Florida, one in Naples and another in Sarasota, have been discussed in that state's channel, with organizers urging attendees to wear masks to protect their identities, but that discussion group has only 91 subscribers.
A rally last month in Huntington Beach, California, drew dozens of participants but more than 200 counter-protesters.
During a "Morning Joe" panel discussion on the Republican Party sticking with Donald Trump despite losing the White House, along with the Senate and the House, regular MSNBC contributor Donny Deutsch expressed incredulity that the party can't seem to comprehend that he is a "loser."
After host Mika Brzezinski reported that conservative pollster Frank Luntz is stating that Donald Trump could be the primary reason why Republicans don't reclaim either the House or the Senate in 2022, the clearly exasperated Deutsch wondered why Republicans don't see what is coming.
Referring to the Luntz interview, Brzezinski stated, "Donald Trump single-handedly may cause people not to vote and he may be the greatest tool in the Democrats arsenal to keep control of the house and Senate in 2022."
According to Deutsch, "It will take a cycle or two," before Republicans recover from Trump and the images of the Capitol insurrection, before getting to the Republican Party still hitching its star to the former president as Sen. Lindsey Graham (R-SC) did on Thursday night.
"But I want to say again to the Republicans watching, Donald Trump is a losing proposition," he explained. "Those images that we were playing of people storming the Capitol, that's all you have to say about Donald Trump."
"So what is so insane about the Republicans -- and by the way he will be indicted between now and the next election -- he is unelectable. Donald Trump is unelectable. You are fools. Forget right or wrong, you are losers with Donald Trump. Get that in your thick, dumb, skulls," he exclaimed only to be greeted by stunned silence from the panel.
