A heckler who threw a banana peel at Dave Chappelle during a 2015 performance is suing the comedian for emotional and physical damages.

The Santa Fe New Mexican reported that Christian Englander — the man who threw the peel at the comedian during a 2015 performance in Santa Fe — claimed the incident was not racially-motivated, but that he threw the fruit refuse at Chappelle because he didn't like a joke that was made about his friend.

Englander alleged in his suit that Chappelle's presumed bodyguard (who he is also suing) hit him twice "without provocation" when he was restrained, and he subsequently suffered "unspecified nonmedical expenses, physical and emotional pain and suffering, lost income and earning capacity and 'loss of enjoyment of life,'" the New Mexican reported.

Englander was initially charged with battery and "disturbing the peace," but charges were dropped because Chappelle was unwilling to participate in court proceedings related to the 2015 incident. The alleged assault was not recorded in the original police report from 2015, but Englander's lawyer said it would have been brought up if his client had gone to trial.
