'It handcuffs me': Arizona Sec of State says law leaves him powerless to boot Trump from ballot

Arizona's Secretary of State said he has no choice but to qualify Donald Trump for the state's election ballot, despite challenges that claim he should be disqualified under a law that bans insurrectionists from standing, AZCentral reported.

Adrian Fontes is bound by a state law that says a candidate can qualify for the state's ballot as long as they're qualified in two other states.

"It handcuffs me to two other states," said Fontes, who is a Democrat. "Here’s the bottom line ... I’m basically a time and date stamp.”

Fontes had claimed – like several other states – that there's a provision in the 14th Amendment to the U.S. Constitution – the insurrectionist law.

"That provision, Section 3, prohibits anyone who has previously taken the oath of a public office and engaged in 'insurrection or rebellion' against the government from qualifying for the ballot. Legal scholars from the left and the right have argued that this would pertain to Trump and his role in inciting what became an insurrection at the U.S. Capitol on Jan. 6, 2021," AZCentral's report stated.

"This is an unanswered question," he said. "That is up to the courts, not to me.”

He said that, if the courts do not bar Trump and at least two other states list him on the ballot, Arizona state law leaves him without any other option.
