MAGA supporter facing possible prison time in Jan. 6-related case despite Trump pardons

A supporter of President Donald Trump was facing a possible prison sentence in a case related to the Jan. 6 attacks despite pardons for other defendants.

CBS News Texas reported Monday that a federal judge was expected to move forward with sentencing for Abigail Jo Shry after she threatened to kill U.S. District Judge Tanya Chutkan and former Rep. Sheila Jackson Lee (D-TX).

After Chutkan was assigned Jan. 6-related cases, Shry was said to have used voicemail for racist threats against the judge.

"You are in our sights, we want to kill you," Shry said, according to an affidavit. "Trump doesn't get elected in 2024, we are coming to kill you, so tread lightly, b----."

Shry also used the N-word and "slave" in her voicemail. She was charged with one count of "communication containing a threat to injure the person of another."

The call was placed just days after special counsel Jack Smith charged Donald Trump with election subversion related to the Jan. 6 riot. Shry's sentencing was scheduled for May 5 after pleading guilty following the November election.

"Judge, my greatest concern in this case is that she starts watching Fox News again, gets herself spun up, she goes out, she gets a case of beer, continues to get herself spun up," a prosecutor told the federal judge last year. "There's no way to gauge what's going to happen here, except to look at what she's done in the past six months. I mean, not even a year, the past six months."

In his pardons after taking office, Trump said he was forgiving all crimes "to all other individuals convicted of offenses related to events that occurred at or near the United States Capitol on January 6, 2021."

The Justice Department has taken a broad view of the pardon language, dropping charges for gun offenses and other crimes that did not occur on Jan. 6.
