CNN's Toobin explains why departure of White House counsel McGahn will cripple Trump if Democrats come after him

Responding to a Washington Post report that President Donald Trump seems to be unaware of what awaits him should the Democratic Party take control of the House -- and possibly the Senate -- CNN legal analyst Jeffrey Toobin said the departure of White House counsel Doug McGahn will exacerbate Trump's problems.

According to the Post, Trump "has neither the staff nor the strategy to protect himself from a possible Democratic takeover of the House."

Speaking with CNN hosts John Berman and Alisyn Camerota, Toobin brought up the imminent departure of McGahn after former White House aide Anthony Scaramucci blew off the imminent exit as no big deal.

"There are a couple different things going on," Toobin began. "What Anthony is talking about is the [special counsel Robert] Mueller investigation and whether Don McGahn is an incriminating witness. He either is or isn't. His story has been told."

"The administrative job that he has as White House counsel is a very important one," he continued, "and it's not only that Don McGahn is leaving, four of his five deputies are leaving too and there's work that has to be done. If there's a Democratic Congress or House of Representatives there will be a new set of work that this White House never had to deal with. They've had a compliant Congress for two years."

"Interesting," host Camerota interjected. "There has to be manpower and people don't see the manpower if he leaves."

"Right, and remember one of the unsung successes of the administration has been the nomination and confirmation of an enormous number of central judges including, of course, two supreme court justices, one not confirmed yet," Toobin explained. "Don McGahn has been the principal person working on that. For [Republican Senate Majority Leader] Mitch McConnell, it's a huge priority of his, he wants to make sure the pipeline continues for the next two years."
