Fani Willis faces a 'difficult question' after judge drops 3 charges against Trump: lawyer

Fulton County District Attorney Fani Willis faces a "difficult question" after three charges she levied against former President Donald Trump were dropped, a conservative attorney argued Wednesday.
Judge Scott McAfee dropped a total of six charges in the election interference case, including three accusing Trump of soliciting Georgia's former House Speaker David Ralston and Secretary of State Brad Raffensperger to tip the 2020 presidential election in his favor.
Lawyer and Fox News contributor Jonathan Turley swiftly took to X to unpack what this means for Willis, who he says must now decide if she wants to redraft and refile the original charges, which McAfee said failed to give "sufficient detail regarding the nature of their commission."

"Judge McAfee dismissal of the six counts presents a difficult question for the prosecution," he wrote. "If they try to secure a superseding indictment to correct the earlier mistakes, it will make it difficult to try the case before the election."
Turley explained the potential delay is linked to the defense's right to time to prepare rebuttals to any newly filed charges.
"That will take time off the clock," Turley said.
But failing to refile the charges could leave the Fulton County District Attorney's office with an increasingly difficult case to prosecute, Turley said.
He believes Willis' team hoped to use multiple charges to present a pattern criminality to prop up the racketeering charges levied against Trump.
"That theory was already thin soup and it just got a bit thinner," wrote Turley.
"This does not disable the case," Turley added, "but it adds yet another set back for the prosecution as it awaits the disqualification decision."
Willis' case has already been marred after attorneys representing one of Trump's co-defendants accused her of misconduct over a personal relationship with the lead prosecutor she hired to the case, Nathan Wade.
