Gunman who terrorized black child's birthday party with a shotgun doesn't think he should be in prison

Jose Ismael Torres has been sentenced to 20 years in prison for making "terroristic threats." But now he is hoping to get out.

Torres and others associated with a pro-Confederate "Protect the Flag" group were caught on video disrupting a black child's birthday party in Georgia. The incident occurred shortly after the massacre of nine black churchgoers in Charleston, South Carolina in 2015.

Their taunts led to a confrontation with the African American family holding the party and Torres was accused of threatening to kill them with a gun.

"Many people tried to make the case about simply flying the Confederate Battle Flag," Douglas County District Attorney Brian Fortner said in a statement. "This case was about a group of people riding around our community, drinking alcohol, harassing and intimidating our citizens because of the color of their skin."

Torres was convicted on three counts of aggravated assault, one count of making terroristic threats and one count of violating of Georgia's Street Gang Terrorism and Prevention Act in 2017. His girlfriend, Kayla Norton, was also sentenced to 6 years in prison.

But now Torres wants to be released while his case is under appeal, according to 11Alive.com.

He has asked a judge for bond and has a hearing set for Monday morning.
