A legal expert on Friday suggested that the potential testimony of a Trump organization employee who according to a published report was contacted by prosecutors – though not necessarily critical to special counsel Jack Smith – could help seal the deal in the prosecution of the former president on allegations he mishandled classified documents.
Former U.S. attorney Joyce Vance said such testimony would be “icing on the cake” for Smith during an appearance on MSNBC’s “All In with Chris Hayes.”
Vance was responding to an ABC News report indicating Smith recently sent a “target letter” to a Trump staffer suspected of lying to investigators. The letter threatens the employee with potential charges, according to the report.
“Well it could be very significant if they're able to obtain this person's cooperation, but the reality is Jack Smith already has very strong evidence on obstruction of justice,” Vance said.
“An additional witness who can testify directly to what they did, why they did it, at whose orders they did it, would be icing on the cake. Not essential, but prosecutors never mind redundancy.”
The ABC News report suggests that the letter indicates Smith has become interested in how the Trump Organization handled surveillance footage and may have worked to thwart efforts by prosecutors to secure such evidence.
“And so this is something that would signify the case has become even stronger, but also that Jack Smith is deeply committed to making sure that anyone who engages in wrongdoing, whether it's perjury, obstruction or substantive crimes, that they're held accountable for it,” Vance said.
