Rep. James Comer (R-KY) said the felony charges against Rep. LaMonica McIver (D-NJ) carried a prison term that was "a little excessive" after she protested at an Immigration and Customs Enforcement facility.
On Wednesday, Acting U.S. Attorney for New Jersey Alina Habba announced the charges against McIver in a post on X.
"While people are free to express their views for or against particular policies, they must not do so in a manner that endangers law enforcement and the communities those officers serve," Habba argued.
Fox News host Will Cain pointed out to Comer that the charges carried a maximum sentence of 17 years.
"What do you think about these charges now facing your colleague there in Congress?" Cain asked.
"Well, obviously this was a stunt that went bad," Comer said of McIver's protest. "The Democrats make a big deal every day, including today on the House floor, about an insurrection and different things like that. So I think it's serious to do what she did."
"The penalty seems a little excessive, in my opinion," he added. "But at the end of the day, I think people need to be held accountable for, you know, obstructing law enforcement and doing exactly what she did that was caught on film."
