Looks like ‘dithering’: CNN legal analyst shocked DOJ hasn’t acted upon Bannon criminal referral
Attorney General Merrick Garland was criticized on CNN on Wednesday for "dithering" on taking action on a criminal contempt referral of Steve Bannon.
On October 21, Congress voted 229-202 to refer Bannon to the Department of Justice after the Trump advisor refused to comply with a subpoena from the House Select Committee to Investigate the January 6th Attack on the U.S. Capitol.
CNN anchor John Berman interviewed CNN chief legal correspondent Jeffrey Toobin for analysis about the delay.
"Merrick's got to decide," Berman said. "He's had three weeks, he hasn't said a peep."
"I find this really kind of remarkable," Toobin said.
"Frankly, it looks like dithering on the part of the Justice Department. This issue was in the pipeline for weeks, there is no reason why it is taking so long for the Justice Department to decide whether they are going to prosecute Steve Bannon or not," he explained.
"If they decide no, this investigation is effectively over, because all these other witnesses will similarly refuse to testify knowing that they have no risk of being held in contempt," he added.
"Dithering is such a good verb and can't be overused in Washington," co-host Brianna Keilar added.
