Ed Martin, U.S. Attorney for the District of Columbia, declined to drop charges against some Jan. 6 defendants for fleeing after President Donald Trump gave them full pardons.
In a Thursday court filing, Martin said he was not moving to dismiss charges against Olivia Pollock and Joseph Hutchinson for failure to appear.
The U.S. Attorney said that other counts against the defendants would be dropped.
"Pursuant to Federal Rule of Criminal Procedure 48(a), the government hereby moves to dismiss Counts One, Four, Eleven, Twelve, Nineteen, Twenty-One, Twenty-Three, and Twenty-Four against defendants Joseph Daniel Hutchinson III Olivia Michelle Pollock," the filing said. "The government cites to the Executive Order dated January 20, 2025, Granting Pardons and Commutation of Sentences for Certain Offenses Relating to the Events at Or Near the United States Capitol on January 6, 2021, as the reason for this dismissal."

According to the Department of Justice, Hutchinson and his sister were initially arrested for assaulting officers, theft of government property, entering a restricted building, and violent entry.
On his X (formerly Twitter) account, Martin posts pro-Trump and pro-Christianity messages daily.
"Freedom is a gift from God," he wrote after the inauguration. "Thank God. And President Trump."
