'Sky's the limit' when it comes to Giuliani's defamation damages: legal expert
December 15, 2023
Rudy Giuliani's words could cost him dearly, as the one-time New York mayor may be expected to cough up tens of millions of dollars in the defamation case that wound down on Thursday as the jury began deliberating to render a verdict.
Former federal prosecutor Glenn Kirschner, appearing on MSNBC's "The 11th Hour," said he expects the sum that the former New York City mayor and attorney to former President Donald Trump will be forced to pay out will be substantial.
"I would argue the sky's the limit given the vile, racist, defamatory statements that Rudy made over and over again, including during the course of this trial," said Kirschner.
Giuliani was expected to take the witness stand on Thursday but decided against it.
However, he couldn't help himself to speak to a scrum of reporters outside of the Atlanta courthouse and continue belittling both Georgia election workers – Ruby Freeman and her daughter, Shaye Moss.
"Of course I don't regret it," he said. "I told the truth. They were engaged in changing votes."
They are seeking damages of up to $43 million dollars.
Already, a judge determined that Giuliani defamed the two by peddling publicly baseless claims that they were involved in “surreptitious illegal activity” and "passing around USB ports as if they’re vials of heroin or cocaine" in a supposed scheme to trim votes from Trump in favor of giving Biden a boost.
As eight jurors are working to decide how much Giuliani must pay, Kirschner hopes it's the kind of sum that will dissuade future bullying.
"Hopefully, the jury's award will go a long way to deterring others," he said. "The other Rudy Giulianis out there and those of his ilk who would be willing to sacrifice good folks who are just doing their civil duty, keeping elections free and fair and up and running. I actually expect a really hefty jury award."
