Whoopi Goldberg hits SCOTUS for being states-rights — unless it involves a woman’s body

The co-hosts of "The View" were floored to see the Supreme Court pick Congress as the decision-makers on the move to boot Donald Trump from state ballots using the Constitution's 14th Amendment insurrectionist clause.

The justices ruled Monday that Colorado could not remove the former president from its ballot — and that only Congress could make that decision when it comes to federal offices.

Whoopi Goldberg was particularly annoyed that the High Court would rule against states' rights even as they pushed states rights on a woman's right to choose.

"The Supreme Court has just ruled unanimously that Colorado courts cannot keep you-know-who off the state's ballot for engaging in insurrection, finding that a state cannot make a call that could have a national impact on a federal election," she said.

"Of course, unless it's about a woman's right to choose, but let's not get into that," said Goldberg, who refuses to say "Donald Trump's name. "What do you all think of this? I mean, is anybody surprised by this decision?"

Sunny Hostin, a former federal prosecutor, said that she wasn't surprised, but what did shock her was that the Court would go beyond the case before them.

"If you read the dissent by Justices [Sonia] Sotomayor [Elena] Kagan and also [Ketanji Brown] Jackson, they are saying the Supreme Court went too far here because they answered a question that wasn't before them," she said.

"The only question that was before this court was, can a state do this? Instead, what they did was, they insulated all alleged insurrectionists from holding federal office."

"I had far too much hope that the Court would be united in this and not overstep in favor of Donald Trump, and I think what we saw was a court where justices behaved in a partisan manner, and that disappoints me," she said.
