President Donald Trump's latest election scheme has one lawyer on edge.
On Monday, Trump announced on social media that he is going to lead a "movement" to get rid of mail-in ballots ahead of the 2026 midterm election. He also accused Democrats of "cheating at levels never seen before" to win elections.
Trump's claims set off alarm bells for lawyer Marc Elias, who specializes in voting rights. Elias discussed Trump's move with progressive YouTuber Brian Tyler Cohen on his show "Democracy Watch" on Monday.
"This needs to be a major wake-up call to everyone," Elias said.
There are several legal issues with Trump's plan, Elias said. One of the largest is that the federal government does not play a role in elections, even though Trump claimed in his post that "States are merely an 'agent' for the Federal Government in counting and tabulating the votes."
Cohen asked about whether the announcement could inspire GOP leaders to take state-level action to implement Trump's plan.
"What about the Ron DeSantises (R-FL) and Greg Abbotts (R-TX) of the world who are listening to what he's saying and taking it as gospel?" Cohen asked, referring to GOP governors who have aligned themselves closely with Trump.
"What he may very well have in mind is what you're suggesting, which is that he's going to tell Republican state governors and Republican state legislators to simply abolish mail and voting," Elias added.
"When Donald Trump violates the Constitution as blatantly as he is threatening to do here, we need to bring all of the weapons available to us to the legal table, and we need to bring litigation," he continued.
