Trump 'absolutely' engaged in insurrection and should be barred from office: legal expert

Former federal prosecutor Glenn Kirschner weighed in on Thursday during his "Justice Matters" podcast regarding the Colorado 14th Amendment trial against former President Donald Trump — a case that could hold the former president ineligible for office under the Insurrection Clause.

The case against Trump, as far as Kirschner is concerned, is cut and dried.

"So friends, based on the evidence — not the hyperbole or the histrionics or the House January 6 Select Committee report — based on the evidence, Judge Wallace should conclude, should find, should rule that absolutely Donald Trump engaged in, and gave aid and comfort to, an insurrection," said Kirschner.

"Here are just half a dozen facts that support that conclusion," Kirschner continued. "One, Donald Trump corruptly pressuring state legislators: sending his attorneys down to Georgia to lie about election fraud. Two, Donald Trump corruptly pressuring state election officials: the 'just find me 11,870 votes' phone call to Brad Raffensperger. Three, Donald Trump's corrupt pressure campaign on his vice president, Mike Pence: 'You know what your problem is, Mike? You're too honest.' Four, Donald Trump launching the angry mob on the Jan 6th: telling them 'Go the the Capitol' and 'Stop the steal.' Five, Donald Trump pouring gas on the fire during the attack: 'Mike Pence didn't have the courage to do what he should've done.' Six, Donald Trump gave aid and comfort to the insurrectionists: pledged pardons and his love to the rioters."

Furthermore, he continued, there is one question that people are overlooking in all of this: "Do we have to let someone pursue the presidency who tried to cling to power, contrary to the expressed will of the American voters? Do we have to let someone pursue the presidency who has said that if elected, he would cancel the Constitution? Do we have to let someone pursue the presidency who has pledged to deploy the military against the American people? And do we have to let someone pursue the presidency who has, in a very real and direct and determined sense, tried to bring an end to American democracy?"

"Do we have to let a person like that pursue the presidency?" he repeated. "Put another way, are we required to freedom our democracy to death? If so, I guess we might as well just check our common sense at the door, just leave it behind."
