Trump lawyers should stop citing Nixon to get ex-president out of trouble: legal analyst

MSNBC legal analyst Lisa Rubin had a suggestion for Donald Trump's lawyers: lay off the Nixon references.
Speaking to Alicia Menendez, Rubin explained that there are some "real doozies" in the Trump filing.
"The most important takeaway is [Trump saying], 'yes, the Supreme Court should weigh in. This is an issue of first impression, just not now,'" she characterized. "All of his reasons why it should be some time, but not now, don't carry a lot of water."
First, Trump claims that special counsel Jack Smith didn't suffer any injury that would require an expedition of his case to the High Court.

"But, of course, the stay occasioned by Judge [Tanya] Chutkan's opinion, that is the opinion that's on appeal here, is a real injury. It means no pretrial proceedings, much less the trial itself can happen," said Rubin. "They also say that Jack Smith's invocation of the public interest is nakedly a partisan interest. I want to push back on that. All members of the public would be benefited by understanding whether Donald Trump will face criminal liability here, especially if he is qualified before they make their decision at the ballot box."
Menendez asked why Trump wouldn't want to move forward if he believed himself to be innocent.
"You would think, but he doesn't," Rubin said. "It reveals the truth of what he's trying to do, which is delay. If he's so confident of his immunity and keeps invoking Nixon — the very existence of Nixon should remind us all that former President [Gerald] Ford would never have pardoned him if there wasn't some understanding that former presidents could be criminally prosecuted for things they did while in office. Of course, Trump doesn't want to invoke that, but every time he mentioned the word Nixon here, that's what it calls to mind for me."
