Why Trump's latest attempt at a 'do-over' of E. Jean Carroll trial is doomed: legal expert

Former President Donald Trump and his legal team, spearheaded by attorney Alina Habba, have tried multiple times to get the E. Jean Carroll judgment thrown out and retried — but none of their efforts carry any real legal substance, argued analyst Lisa Rubin on MSNBC Tuesday evening.
This comes as Habba is already backing down from her accusation that Judge Lewis Kaplan has a conflict of interest because he was briefly employed at the same law firm as Carroll's attorney Roberta "Robbie" Kaplan, no familial relation.
"Let me start on this, they're trying to get a new trial, Trump's lawyers?" asked anchor Chris Hayes.

"They've insinuated that they're gonna file a motion for a new trial," said Rubin. "That's even in the letter where they've conceded that there actually isn't a problem between the two Kaplans, they dropped a footnote saying we're going to address this bias problem that the judge has with us in the post-trial motions including potentially under Rule 59, the shorthand for a motion for a new trial."
"Chris, I want to point out to you and your viewers, they've tried a lot of these wacky things so far," Rubin continued. "They've asked for a recusal of Judge Kaplan, on the basis of his relationship with another one of E. Jean Carroll's lawyers, and asked for a mistrial after E. Jean Carroll admitted to deleting death threats against her."
"This is the third time they tried to get a do-over or cutting it short based on bias or alleged improprieties, because they know they don't have real substantive grounds for appeal," she added.
