Trump yet again opens door to new E. Jean Carroll lawsuit during Monday interview: expert

Donald Trump may have once again put himself at risk of another defamation lawsuit from writer E. Jean Carroll during an interview on CNBC Monday morning.
Just two days after he attacked Carroll at a Georgia rally, which came a day after he posted a $92 million bond while he appeals his two court losses to her, he was at it again during a phone interview with the hosts of "Squawk Box."
As CNN reported, a rambling Trump stated, "And if I didn't win on appeal on these ridiculous decisions, if I didn't win on appeal is the most ridiculous decisions and putting Miss BergdorfGoodman, a person I never — I never met, I have no idea who she is."

On MSNBC, legal analyst Lisa Rubin said Carroll's attorney might have cause to haul the former president back into court again.
"I think one of the things that they have to think about is what would be the damages," Rubin explained. "Even if the goal is to punish former president Trump for his continued defamation, they have to show in the first instance that she has been damaged."
"So, for example, they might have to wait a little while to determine whether she is damaged by new rumors spread about her on the internet or disparaging things said to her that caused damage to her career as a writer," she added. "If they can establish that, and particularly given the comments on CNBC this morning, it might give them reason to sue in New York."
"I think that you can expect E. Jean Carroll's lawyers to at least look at whether a future lawsuit is necessary and also to consider whether they should ask the court for injunctive relief."
On X, conservative lawyer George Conway called out the former president's "blunder."
"The fact that Trump libeled @ejeancarroll on @CNBC @SquawkCNBC is highly significant for a procedural reason in addition to a substantive one," he wrote. "Were E. Jean to sue Trump just for the speech he gave in northwest Georgia the other day, she would have had to sue in the U.S. District Court for the Northern District of Georgia. But now that he libeled her on Squawk Box, which is anchored in Manhattan, she may now sue in the U.S. District Court for the Southern District of New York."
" If she does that, the case would be assigned to Judge Lewis A. Kaplan as a case related to the earlier two cases that produced $88.3 million in damages awards," he added.
