Donald Trump recently asked his "favorite judge" to throw out the entire criminal case brought against him for allegedly unlawful document retention, but that request is a "house of cards" that special counsel Jack Smith will have no problem blowing over, a former federal prosecutor said on Friday.
Trump's bid for dismissal, which took the form of several different filings, included a number of arguments in favor of tossing the case, including presidential immunity and even "unconstitutional vagueness." The case itself was brought after Trump allegedly refused to honor authorities' requests to return certain classified docs.
The filings were panned by legal scholars, with one attorney using the phrase "insultingly stupid" to refer to one of Trump's motions.
Former federal prosecutor Glenn Kirschner said on his "Justice Matters" show on Friday that Trump's requests amount to a "hail Mary" pass, and found himself wondering if Judge Aileen Cannon will be waiting in the end-zone to catch the pass.

"Donald Trump just threw a Hail Mary pass, asking the judge to just dismiss the case against him, just throw out all the charges," Kirschner said. "Let's hope Donald Trump's favorite judge down in Florida, Judge Aileen Cannon, isn't standing in the opponent's end-zone waiting to catch Trump's Hail Mary pass."
The legal expert who frequently appears on MSNBC went on to say Trump did the same thing with these "bogus motions to dismiss" as he did in the D.C. case.
"I've done a quick review of Donald Trump's motion to dismiss," he said, calling it a "house of cards built on a foundation of sand."
"It's not gonna take much for special counsel Jack Smith to knock it all down."
