'Hoax!' Trump gloats after Minnesota case seeking to nix him from ballot is tossed
November 08, 2023
A lawsuit in Minnesota seeking to disqualify former President Donald Trump from the ballot under the 14th Amendment has been dismissed by the Minnesota Supreme Court.
The order, signed by Chief Justice Natalie Hudson, does not preclude the case from being re-filed to keep the ex-president off the general election ballot, should Trump win the primary.
Trump took to his Truth Social platform following the release of the decision. "Ridiculous 14th Amendment lawsuit just thrown out by Minnesota Supreme Court. 'Without Merit, Unconstitutional.' Congratulations to all who fought this HOAX!" he posted.
The litigants argued that Trump is ineligible to hold office under the Insurrection Clause in Section 3 of the 14th Amendment, which prohibits anyone who has engaged in insurrection against the United States from holding office unless a supermajority of Congress waives the restriction.
A similar case is currently advancing in Colorado.
These cases, which have the backing of numerous legal scholars including former Harvard Law Professor Laurence Tribe and former conservative federal Judge Michael Luttig, face a number of obstacles, chiefly that there is not clear precedent in law for how to enforce the restriction, and whether the state officials being sued have that authority.
