Here's why Trump's latest lawsuit tactic is likely to fail

This Tuesday, former President Donald Trump filed a defamation suit against author E. Jean Carroll alleging that she falsely accused him of rape. According to Forbes, it's a tactic that will likely be unsuccessful and costly.

Trump filed the countersuit against Carroll after a jury in May ruled that he Trump sexually abused her in a Bergdorf Goodman dressing room in the 1990s, then defamed her by calling her allegations a hoax, awarding her $5 million in damages.

"Defamation cases can be hard to win, especially if the plaintiff is a public figure, which requires proof of 'actual malice,' meaning the defendant knowingly made a false statement or did so with reckless disregard for the truth," Forbes' report states. "Success in all defamation suits is dependent on plaintiffs proving the defendant made an objectively false statement, acted with negligence and harmed the plaintiff."

Trump's counter-suit is another chapter in a years-long legal battle with Carroll that began in 2019 when she published an excerpt of her memoir that contained the allegations.
