Trump will not appeal to Supreme Court after all — looks to new immigration order instead

Despite Donald Trump’s promise on Thursday to “SEE YOU IN COURT” over the Ninth Circuit Court of Appeals’ decision not to reinstate his executive order on immigration, an administration official on Friday said the president will not appeal to the Supreme Court.

The Ninth Circuit Court of Appeals dealt the president his first major blow Thursday evening, denying an emergency request to reinstate order, which barred visitors from seven predominantly Muslim countries and halted the U.S. refugee program. issued a temporary restraining order against the travel ban, prompting the Justice Department to launch an appeal; the restraining order also prompted Trump to publicly disparage the “so-called judge” who checked the president’s executive overreach.

At a press conference Friday, Trump vowed to continue the legal battle against the judge’s decision, telling reporters, “we will continue to go through the court process and ultimately, I have no doubt we will win that particular case.”

But for now, it looks like the president is considering drafting an entirely new executive order with the hopes of making it through the U.S. judicial system.

“We also have a lot of other options, including just filing a brand new order,” he told reporters Friday aboard Air Force One.
